About this file
This document is a justification and approval for a sole source award on the Next Generation Jammer Mid-Band Low Rate Initial Production Lot III contract. The Navy will award a sole source contract to Raytheon for the engineering and manufacturing development of the NGJ-MB program. Raytheon is currently the incumbent contractor and has delivered a technical data package under previous awards. The contract will continue the low rate initial production phase of the program. The program office has determined the anticipated costs to be fair and reasonable based on certified cost and pricing data and field pricing support. Raytheon will be required to submit formal price proposals for negotiation. After closure of the prior contract, Raytheon will deliver a complete technical data package during LRIP I/II to enable competition for sustainment work.

J&A_21-0389 program as required by FAR Part 10. The program will continue to publicize new contracts in accordance with the FAR and will evaluate industry responses accordingly.
7. Determination of Fair and Reasonable Cost. The PCO has determined that the anticipated cost to the
Government for the supplies/services covered by this J&A will be fair and reasonable. In accordance with FAR 15.402, the PCO shall ensure that all supplies and services provided under the contract action described herein are procured at a fair and reasonable price. The contractor will be required to submit formal price proposals with certified cost or pricing data and sufficient information to support the accuracy and reliability of their estimates. The contractor’s proposals will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of necessary field pricing support.
The PCO will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition. After closure of the PCA, Raytheon will deliver a complete TDP during the LRIP I/II contract which will be used during the sustainment phases of the NGJ-MB program. The Government will validate the TDP once it is delivered. Because this is a follow-on effort for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior CJ&A was provided to the approval authority for review. Approval of this J&A signifies that the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
