About this file
This is a Sole Source Justification Memorandum issued by the Oregon Department of Education (ODE) Procurement Services Unit authorizing a noncompetitive contract award for external evaluation services related to the State Personnel Development Grant (SPDG) program. The contract will be awarded to Noonan & Gaumer Erickson, LLC to continue their ongoing development and management of Oregon's external SPDG evaluation plan, tools, and data analysis systems. The services are required to fulfill federally mandated external evaluation requirements, with the contract term extending through December 31, 2022. No specific bidder's meetings, site visits, or response deadlines are outlined in this justification document, as this is a sole source procurement exempting the agency from competitive bidding requirements.
The contract value is $60,000.00, with all associated costs included within this amount. The justification for sole source procurement is based on two primary findings: (1) Noonan & Gaumer Erickson is the sole source capable of maintaining the existing online data analysis portal currently used by Oregon educators and administrators, and (2) the vendor's continuous involvement in SPDG activities since 2011 makes them uniquely qualified to ensure seamless continuation of federally mandated monitoring without risking the loss of federal funding due to project delays. The procurement was authorized under Oregon Revised Statute 279B.075 and Oregon Administrative Rule 125-247-0275, with the designated procurement officer noting that reasonable effort would be made to ensure competition despite the sole source determination.

SOLE SOURCE JUSTIFICATION FOR SUPPLIES AND/OR SERVICES
Date: February 11, 2022
MEMORANDUM FOR FILE
Authority: Sole Source Justification pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275, the Oregon Department of Education finds a Sole Source Contract is necessary to efficiently acquire services to fulfill federally required external evaluation of Oregon’s State Personnel Development Grant (SPDG.)
Authority for Agency to enter into a Sole Source Contract: OAR 125-246-0170(2)(c)(H).
Background: Agency has awarded a contract to Noonan & Gaumer Erickson, LLC. It has been determined that it is in the Department's best interest continuing with Noonan & Gaumer Erickson, LLC as they developed Oregon's external SPDG evaluation plan, tools and systems and is the best option to assure compliance with the federal external evaluation requirements while simultaneously avoiding unacceptable project delays that would put Oregon's continued federal SPDG funding in jeopardy. This Contract will be in the amount of $60,000.00 and will be scheduled through December 31, 2022.
Market Research Findings Pursuant to ORS279B.075: Noonan & Gaumer Erickson were previously awarded a contract in response to their proposal submission to Agency’s Request for Proposal ODE-1686-
12. At that time it was determined that they were most suited to perform the work requested, and they remain as the best option to continue the body of work they developed during their previous SPDG projects.
The Contracting Officer makes the following determinations:
Pursuant to ORS 279B.075(2)(d): Additional findings that support the conclusion that the goods or services are available from only one source.
a. Pursuant to ORS 279B.075(2)(b):The goods or services required for the exchange of software or data with other public or private agencies are available from only one source. Noonan & Gaumer Erickson maintains an online data analysis portal for Agency’s SPDG and this portal is used by teachers and administrators across Oregon.
b. Pursuant to ORS 279B.075(2)(d): Additional findings that support the conclusion that the goods or services are available from only one source. Noonan & Gaumer Erickson has supported Agency in SPDG activities since 2011 and it is imperative to a seamless continuation of federally mandated SPDG monitoring that they continue their previous works.
The resulting contract will be in the amount of $60,000.00 and will be issued according to authority of OAR 125-247-0275 with reasonable effort made to ensure competition.
