Control Number 18-042
Justification and Approval Document
FOR OTHER THAN FULL AND OPEN COMPETITION
Of requirements valued less than $100,000
1. Contracting Activity: United States Property and Fiscal Office for Nebraska
USPFO P&C
2433 NW 24th St.
Lincoln, NE 68524
2. Nature and/or description of the action being approved:
DDC Controls Software Upgrade to all ANG HVAC systems - $18,843.50
3. Description of the supplies or services required to meet the agency’s need:
4. Authority Cited: (Identify the statutory authority, FAR title and FAR citation permitting other than full and open competition)
FAR Part 13.106-1(b)
Provide and install new ADX software upgrade to the latest version. Provide and install the software upgrade to all NxE panels.
This requirement must be procured using less than full and open competition. Johnson Controls Inc. must be the preferred manufacturer of the equipment being incorporated into the existing building control systems to ensure its correct and efficient operation.
Johnson Controls uses a proprietary communication language between their devices which other manufacturers are unable to copy and use. This effectively eliminates the possibility of other devices working effectively with the existing Johnson Controls system.
All of the existing HVAC control equipment on base was manufactured by Johnson Controls Inc. making parts interchangeable and minimizing the number of spare parts that need to be maintained by the installation.
All of the training our maintenance personnel have received, or will receive, will be to maintain and operate Johnson Controls systems.
5. Reason Authority Cited: (State explanation describing circumstances preventing full and open competition and describe what harm will come to the Government if this action is not taken)
6. Actions to Increase Competition: (Provide a description of the efforts made to ensure that offers are solicited to as many sources as practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under 5.202 applies)
7. Market Research: (Describe the extent of the market research conducted to identify all qualified sources and the results thereof or a statement of the reason market research was not conducted.
“Market Research” means collecting and analyzing information about capabilities within the market to satisfy agency needs)
8. Other Interested Sources: (Provide a listing of the sources, if any, that expressed, in writing, an interest in the acquisition)
9. Subsequent Acquisitions: (Provide a statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services are required)
10. Procurement History:
Previous Contract or Purchase Order Number: W91243-12-F-0040 Previously Competed? Yes Previous authority for less than Full and Open Competition: Yes
None.
With the current base DDC system and infrastructure in place, a replacement of the entire system would be necessary to consider alternate sources. As this course of action is cost prohibitive and would produce a significant negative mission impact this is not a valid option.
Only this brand of equipment will satisfy the requirements of the existing base wide HVAC digital data controls system.
11. Fair and Reasonable Price Determination: IAW with FAR 13.106-3(a)(2), I have determined that the anticipated cost to the Government is fair and reasonable based upon one or more of the following: (Contracting Officer check as appropriate)
____ (i) Market research;
_XX_(ii) Comparison of the (anticipated) price with prices found reasonable on previous purchases;
____(iii) Current price lists, catalogs, or advertisements. However, inclusion of a price in a price list, catalog, or advertisement does not, in and of itself, establish fairness and reasonableness of the price;
____(iv) A comparison with similar items in a related industry;
____(v) The contracting officer's personal knowledge of the item being requested;
____(vi) Any other reasonable basis. Competition through CHESS
11. Certification: I certify that the information included in this J&A is accurate and complete to the best of my knowledge and belief:
