About this file
This is a FAR Part 6 Justification and Approval document for other than full and open competition procurement.
The U.S. Army Contracting Command-Aberdeen Proving Ground, Tobyhanna Division, seeks approval for a $502K non-competitive contract award to NSI-MI Technologies Inc. (CAGE: 7MSX5) for a Near-Field Range (NFR) upgrade to support vertical cylindrical near-field (CNF) measurements at Tobyhanna Army Depot. The firm-fixed-price contract runs from 19 June 2026 through 19 January 2027 and is fully funded with Other Procurement, Army (OPA) funds. NSI-MI will supply and install one MEC-AZ-20 azimuth antenna positioner, two ELE-ARC antenna range controllers, RF absorber paneling, an equipment controller, CNF measurement software, cabling, and provide installation and calibration labor. Specific deliverables include delivery of equipment by 19 December 2026 and completion of installation and calibration by 19 January 2027. Pricing includes equipment costs ($42,782 for the positioner, $110,783 for software, $5,000 for RF absorber, $17,802 for controller, $27,930 for two controllers, $32,086 for cabling) and labor costs ($17,512 for installation support, $11,039 for calibration, $3,839 for shipping).
The justification is based on the "one responsible source" exception under 10 U.S.C. § 3204(a)(1), citing that NSI-MI components are the only ones engineered to natively interface with TYAD's existing NFR infrastructure, structural mounts, safety interlocks, and power distribution systems without requiring costly mechanical and electrical redesigns. Market research conducted April-May 2026 via Request for Information (W51A1126NFRANTPOS on SAM.gov and RFI1808888 on GSA eBuy) yielded two responses; only NSI-MI's was applicable. An Intent to Sole Source was posted 22-26 June 2026 on SAM.gov, and NSI-MI confirmed continued interest. The document certifies that the price is fair and reasonable based on price analysis, without requiring certified cost or pricing data per the commercial products exception.

5. Authority Cited: Title 41 U.S.C. §1901(e)(2) as implemented by Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) 6.103-1(b), One responsible source.
6. Reason for Authority Cited: The use of the NSI-MI equipment previously described is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency's needs. The technical justification is based on the following critical factors:
a. Background: The requirement is to procure, install, and calibrate an azimuth antenna positioner, antenna range controllers, RF absorber paneling, equipment controller, along with CNF measurement software and associated cabling into an existing NFR to support vertical CNF measurements. TYAD currently utilizes an established NFR architecture. The proposed vertical CNF capability is an augmentation to this existing range, not a standalone system. The NSI-MI MEC-AZ-20 positioner and ELE-ARC controllers are the only components engineered to natively interface with the facility’s existing range structural mounts, safety interlocks, and power distribution systems without requiring extensive, costly mechanical and electrical redesigns of the facility.
The testing of complex antenna systems requires absolute precision and zero-latency communication between the positioner, the Antenna Range Controller, and the data acquisition software. The ELE-ARC utilizes proprietary firmware and communication protocols to synchronize movement and RF measurement. Introducing a third-party positioner or controller would require the development of custom middleware, breaking the seamless hardware-software integration and invalidating the precision calibration required for DW C5ISR systems. To utilize a different manufacturer's azimuth positioner or controller, TYAD would be forced to replace the entire existing NFR control ecosystem, including the overarching range software, data acquisition subsystems, and structural mounting points. This would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition. Furthermore, the engineering and integration time required to force third-party components to communicate with the legacy system would incur additional labor costs. The estimate for open competition is based upon a previous contract (W25G1V-19-C-0012) to
JUNE 2025
replace all the equipment and software in the NFR. This is a substantial duplication because the $1M estimate of full replacement eclipses the $502K effort that NSI-MI will be able to perform to provide TYAD vertical CNF measurement capability.
b. Alternatives: N/A
c. Impact if not approved: If the justification is disapproved, there will be duplication of cost in engineering labor and materials to interface with the existing NSI-MI architecture
NFR.
7. Efforts to Obtain Competition: Market research was conducted, details of which are included in the market research section of this document. The Contracting Officer has published the notices required by FAR 5.201 and any bids or proposals received shall be considered.
a. Effective competition: There is no expectation for competition to identify a vendor that isn’t NSI-MI with a solution that interfaces effectively with the existing NSI-MI architecture in the TYAD NFR.
b. Subcontracting competition: This section is not applicable as NSI-MI will not need to subcontract any of the supplies or labor required with this acquisition.
8.Actions to Increase Competition: This is a one-time requirement for TYAD and no future similar acquisitions are anticipated.
9.Market Research: Market research was conducted by TYAD engineers and ACC- APG Tobyhanna Division from APR – MAY 26 in accordance with FAR 10.002. On 27 April 2026, Request for Information W51A1126NFRANTPOS was posted on SAM.gov and RFI1808888 was posted on GSA eBuy both for a period of 19 calendar days.
Interested offerors were requested to contact the Government and submit a capability statement. The Government received two responses, one from NSI-MI and one from Fairwinds. Only the NSI-MI response was applicable to TYAD’s use case of a near-field range. The RFI did not reveal any additional sources for this requirement that could provide a solution with native compatibility to the existing infrastructure and proprietary software and firmware. Therefore, Government technical experts concluded that NSI-MI is the only source that can provide the requirements for the near-field range upgrade to support vertical CNF measurements. Market research cannot identify any sources beyond NSI-MI that can meet the Government’s requirements.
Also, an Intent to Sole Source has been posted on SAM.gov on 22 June 2026 and closed on 26 June 2026. The sole source company NSI-MI has responded to the Intent to Sole Source on SAM.gov. They showed that they are still interested in quoting to the requirement.
JUNE 2025
10.Interested Sources: NSI-MI and Fairwinds are the sources that have written to express interest in the acquisition. Fairwinds is unable provide the requirements for the current near-field range upgrade to support vertical CNF measurements.
11.Other Facts: N/A
a. Procurement history. Contract files were obtained for previous modifications to the near-field ranges and far-field ranges that are at TYAD.

b. Other facts: The previous contracts were completed using full and open competition.
The circumstances under the previous contracts required a full replacement of the infrastructure within the near-field ranges that allowed for the potential introduction of vendor equipment not produced by NSI-MI. This is not the same circumstance as the current requirement without incurring substantial duplication of costs.
