Combined Synopsis Solicitation – NOAA AFSC ABL Fuel Purchase
i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with FAR Part 13.5, with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The National Oceanic & Atmospheric Administration (NOAA) intends to award a firm fixed‐price contract to supply fuel to the Alaska Fisheries Science Center (AFSC) Auke Bay Laboratories (ABL). All responsible small business sources may submit a quotation which will be considered by NOAA. The Government intends to select the contractor whose proposal represents the best value to the Government; however, the Government reserves the right to award no contract at all, depending on the quality of the quotations and prices submitted and the availability of funds.
ii) This solicitation is issued as a request for proposal (RFP). Contractor format is acceptable for proposals. See FAR 52.212‐1 and addendum below.
iii) The solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular No. 2022‐06, dated 26 April 2022.
iv) This procurement is solicited as a 100% small business set aside. The associated NAICS code is 324110. The small business size standard is 1,500 employees.
v) This combined synopsis/solicitation is for purchase of the following commercial supply line items:

CLIN 0005: Period of Performance shall be August 1, 2026 through July 31, 2027; Deliver fuel for heat, power generation, and operational needs at the Ted Stevens Marine Research Institute (TSMRI), Little Port Walter Research Station (LPW), and the Subport/Boathouse.
vi) Description of requirements is as follows:
STATEMENT OF NEED FOR SUPPLY/SERVICE
The Auke Bay Laboratory uses approximately 41,000 gallons of fuel annually for heat, power generation, and operational needs at the Ted Stevens Marine Research Institute (TSMRI), Little Port Walter Research Station (LPW), and the Subport/Boathouse. This request is to create a base contract with four options to obtain the required fuel to support these operations.
The current price for fuel is approximately $5 per gallon (June 2022). As the options are exercised, the dollar amount may need to be adjusted up or down due to the volatility of fuel prices. The actual charges for the fuel shall be based on the best government rate available on the date of delivery.
None of this fuel will be utilized for highway use.
Fuel will be delivered to two primary addresses.
250 Egan Blvd, Juneau, AK 99801
Two 500 gallon above ground storage tanks utilized for building heat. These tanks shall be filled with heating fuel Number 2 or DS2. These tanks shall be placed on a “keep full” delivery schedule to ensure that the buildings are without fuel, especially during the winter season. We anticipate up to 10,000 gallons annually for this purpose. The vendor shall provide a 24hr call out number in the event the fuel runs out so that the government can contact them for an emergency delivery.
Vessel Fueling, the government utilizes an Alaska Department of Fish and Game research vessel to transport fuel three times annually to our research station at Little Port Walter. The vessel will utilize 1,000 gallons of fuel (DS2) for itself, and up to 9,000 gallons of fuel (DS2) to be delivered to our research station. We anticipate this need to total 30,000 gallons annually. Fuel will need to be delivered via tanker truck to the vessel. The hose reel on the tanker truck should have approximately 100 feet of hose to ensure that the vendor has enough fuel hose to reach the vessel without driving onto the dock because of weight limitations.
17109 Point Lena Loop Road, Juneau, AK 99801
It is anticipated that we shall need no more than 1,000 gallons of fuel (DS2) annually at this location. However, if there is a problem with the building’s primary heating system, the boiler will be started and additional fuel delivery will be required.
TSMRI has two fuel tanks. The primary fuel tank is a 10,000 gallon above ground storage tank that provides fuel to the emergency generator and backup boilers.
The secondary fuel tank is a 350 gallon fuel pod utilized to fuel equipment.
Period of Performance: August 1, 2022 through July 31, 2023, with 4 options thru July, 2027.

FAR 52.209‐5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (AUG 2020)
(a)
(1) The Offeror certifies, to the best of its knowledge and belief, that—
(i) The Offeror and/or any of its Principals–
(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have □ have not □, within a three‐year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209‐7, if included in this solicitation);
(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;
(D) Have □, have not □, within a three‐year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104‐5(a)(2) for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples.
(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has □ has not □, within a three‐year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. FAR 52.212‐1 Addendum: Offeror Submission Instructions
As part of their proposal, the contractor shall submit the following:
a) The information included in FAR 52.212‐1(b) above
b) A technical proposal, detailing the offeror’s capability to provide the supplies as required as outlined in the Statement of Need, including types of fuel provided, ability to deliver to the locations required, ability to deliver at the schedule required, and other information as necessary to demonstrate their ability to successfully deliver the needed fuel.

FAR 52.212‐2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract(s) resulting from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. A lowest price, technically acceptable evaluation method will be used. The following factors shall be used to evaluate offers:
(1.) Factor A ‐ Technical capability of the supplies offered to meet the Government requirement:
Offerors will be evaluated on their ability to deliver the necessary fuel to the location and in accordance with the delivery schedule identified in the Statement of Need.
(2.) Factor B ‐ Past performance: The offeror's past performance will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services. The Government reserves the right to assess the past performance of proposed subcontractors.
The Government will use its discretion to determine the sources of past performance information used in the evaluation, the agency's knowledge of contractor performance, other government agencies or commercial entities, or past performance databases.
If an offeror does not have a history of relevant past performance, or if past performance information is not available, the offeror will receive a neutral past performance rating; however, an offeror without a history of relevant past performance may receive a lowered rating for the experience evaluation factor.
(3.) Price: The proposed prices will be evaluated but not scored. The price evaluation will determine whether the proposed prices are complete, and reasonable in relation to the solicitation requirements.
In the interest of wisely spending taxpayer dollars, the Government is seeking discounts beyond the current market rate of fuel. However, the Government also understands that the price of fuel is volatile, so the resulting contract will include the clause FAR 52.216‐2 Economic Price Adjustment‐Standard Supplies, which will allow for the adjustment of unit prices to reflect changes in the price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror(s) within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
x) Offerors are required to include a completed copy of the provision at FAR 52.212‐3 Offeror Representations and Certifications – Commercial Items (JAN 2021) with their offer(s).
FAR 52.212‐3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS‐COMMERCIAL ITEMS (JAN 2021)
