About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) under Simplified Acquisition Procedures for the repair of a flood-damaged Hyundai 30D-9 forklift at U.S. Coast Guard Station Sand Key in Clearwater, FL. The justification cites authority 10 U.S.C. 3204(a)(1) for a sole source award to Ring Power, with an estimated value of $30,000.
The forklift was damaged during Hurricane Helene and requires extensive repairs including replacement of multiple electrical components (parking brake pressure switch, solenoid, wiring harnesses, seat switch, seat belt, glow plug relay, starter), as well as various filters and fuel system components. Ring Power has already diagnosed the forklift and has it in their possession. The Coast Guard justifies the sole source award because moving the inoperable forklift to another vendor would incur additional transportation and diagnostic costs, and Ring Power is the only local vendor with the capability to perform the repairs. The unit is currently paying for a rental forklift for daily operations, and Ring Power can complete repairs within 30 days.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
After Hurricane Helene our forklift was flooded which required an offsite repair.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED.
The machine needed to be torn down and diagnosed. Using a 213RR we paid for the diagnoses and transportation of the machine.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).
We located a lift truck repair provider that is also utilized by MacDill AFB. Finding a dealer to take on the project due to the significance of the hurricane was a challenge as our unit flooded and we only procured research through one vendor as the machine needed to disassemble to be diagnosed.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
This vendor has our machine, and the parts to repair it. At this point it would not be beneficial to government to move the machine, diagnose again, and recreate a new parts list.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
The primary concern of our market research was that we found a SAMS vendor. But the other outstanding issue was the machine needed to trailer offsite to be diagnosed.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
This machine was flooded, and Ring Power performed all the necessary troubleshoot and diagnoses. The machine is a Hyundai, 30D-9. The machine is currently not able to be moved without being trailered. On the original 213RR, EQ-HURRICANE-MILTON-24-IC-SECTOR ST. -0019. The USCG paid for 4 hours of troubleshooting and a pickup/delivery of the machine. It would not be cost efficient of the government to continue to trailer this equipment to other locations and pay for another quote/diagnosis of this equipment. Ring Power can repair and get this machine back to the unit within 30 days. This equipment is essential to the units daily operating routine. Unit currently has a renal forklift costing the unit more funds to have this equipment on hand necessary for daily operations.
