DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C244-25 -AP-0274

1. Contracting Activity: Department of Veterans Affairs, VISN 04, Wilkes-Barre VA Medical Center, 1111 East End Blvd, Wilkes-Barre, PA 18711. 2237# 646-25-1-233-0021.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The VA Pittsburgh Healthcare System (VAPHS) has a brand name requirement for the Neoprobe Gamma Detection System (GDS) for use by surgical services. The system consists of one (1) Neoprobe console model, one (1) Neoprobe portable storage system, one (1) AC power cord, and one (1) one-year service contract.

The total estimated cost of this acquisition is

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: VAPHS, University Drive Campus, currently uses the Neoprobe GDS to perform precision cancer treatment surgeries. The Neoprobe system is the only system interoperable with the the Neoprobe probes currently in use. Additionally, there are patient outcome considerations as the Neoprobe surgical probes have significantly smaller head diameters which allow for small incisions. The smaller incisions have many benefits, to include decreased opportunities for post surgical infections.

4. Description of market research conducted and results or statement why it was not conducted:

There are two known providers of the Neoprobe GDS, which are the manufacturer and an SDVOSB reseller, Marathon Medical. The Contract Specialist confirmed only the SDVOSB reseller is on GSA and there are no other mandatory sources of supply. As such, the Brand Name Only requirement will be posted on SAM.gov to maximize competition.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
