About this file

This document is a Questions and Answers (Q&A) addendum for Request for Proposal (RFP) Number NDNR25-01, issued by the Nebraska Department of Water, Energy, and Environment on July 15, 2025, regarding the Perkins County Canal Project Third-Party Environmental Impact Statement (EIS). The Q&A addresses two key questions from potential bidders: clarification on document signature requirements and confirmation of new NEPA implementation procedures for U.S. Army Corps of Engineers (USACE) projects. The document allows for DocuSign signatures with a follow-up hard copy requirement within seven calendar days of the proposal opening date of July 18, 2025, at 1:00 p.m. Central Time.

The addendum also notes a significant administrative change, with the Nebraska Department of Natural Resources and the Nebraska Department of Environment and Energy officially merging into the Nebraska Department of Water, Energy, and Environment as of July 1, 2025. This merger occurred by operation of state law and will not require any additional actions from proposal respondents. The new NEPA regulations, effective July 3, 2025, will apply to the Perkins County Canal Project, and all resulting contracts will be issued by the newly formed department. No specific pricing, set-asides, or funding details are provided in this Q&A document.

NEBRASKA DEPARTMENT OF WATER, ENERGY, AND ENVIRONMENT

RFP NDNR25-01; Perkins County Third-Party EIS Questions & Answers July 15, 2025

Question 1. The RFP states in multiple places—Scope of Service #2, Page 1; Section I.K.1, Page 7; Section IV.A.1, Page 9; Solicitation Evaluation Criteria Mandatory Requirements #2, Page 38—that the State of Nebraska Request for Proposal For Contractual Services form must be signed in ink, but the actual State of Nebraska Request for Proposal For Contractual Services form on Page 16 of 37 of the RFP states that it can be signed using DocuSign. Can you please confirm that we can sign the form with DocuSign?

Answer 1. The original intention was to receive an original ink signature by the stated Opening Date and Time. However, copy of signed document(s) or form(s) referenced in the question above, will be acceptable to meet the submittal time requirements set for in the Request for Proposal (July 18, 2025, 1:00 p.m. Central Time). A follow-up hard copy of the original signature page(s), signed in ink must be received in the Department’s office within seven (7) calendar days of the Opening Date and Time set forth in the Request for Proposal in order to be considered responsive. All other submittal requirements remain unchanged.

Question 2. We would like to confirm that the project will be subject to the new (effective July 3rd) NEPA implementation procedures for USACE projects?

Answer 2. Yes. The new NEPA regulations would be effective for all applications received on or after the effective date of July 3, 2025. The Perkins County Canal Project would be using the new rule. See the following web link for additional information.

Additional Note:

As of July 1, 2025 the Nebraska Department of Natural Resources and the Nebraska Department of Environment and Energy officially merged into the Nebraska Department of Water, Energy, and Environment. The change occurred by operation of state law, so nothing will be required by respondents to this Request for Proposals. Any resulting contracts will be issued by the Nebraska Department of Water, Energy, and Environment.
