About this file

This document is a Non-Disclosure and Non-Use Agreement (NDA) for the U.S. Army's 5.56mm Frangible, MK311 MOD 3 (AA40) cartridge program. The NDA outlines strict confidentiality requirements for recipients of technical data related to the AA40 cartridge, which is used in the M4A1 Carbine for training and reducing collateral damage in combat. The agreement mandates that recipients can only use the provided data for preparing a response to a specific Sources Sought opportunity, with stringent restrictions on data disclosure, reproduction, and third-party sharing.

The associated federal contract opportunity involves a planned single Firm Fixed Price Requirements contract for procuring approximately 418 million AA40 cartridges across Fiscal Years 27-32, with potential order quantities up to 83.6 million per ordering period. Initial delivery is set at 210 calendar days after award if First Article Test (FAT) is required, or 90 calendar days if FAT is not required. Interested firms must submit a signed AMSTA-AR Form 1350, Technical Data Request Questionnaire, and Non-Disclosure Agreement, and be registered with the U.S./Canada Joint Certification Office to obtain the Performance Specification (PRF16001A0006 w/Amendment 2).
