About this file
This is a Contract Advertising Exemption Request and Non-Competitively Bid (NCB) Contract Justification submitted by the Air Resources Board (ARB) to the California Department of General Services Procurement Division. The contract is for a Disaster Recovery site for storing critical Information Technology data, provided by Terremark Federal Group LLC dba Verizon. The contract period runs from 11/1/15 to 5/31/17 and involves an amendment to accommodate specialized equipment requirements for ARB's server rack storage needs.
The original contract amount was $70,208.00, with an amendment of $41,018.00, bringing the total contract value to $111,226.00. The amendment was necessary because ARB's equipment required a deeper server rack (47.2 inches) than Verizon's standard rack depth (29.25 inches), necessitating the construction of a secured cage area within Verizon's data center to accommodate ARB's equipment. The contract is marked as IT Goods & Services, will not be financed, and has received all required departmental approvals. The ARB currently hosts over 90 mission-critical and public-facing applications, and Verizon is noted as the only current service provider supporting these disaster recovery services.

EXEMPTION JUSTIFICATION (Attach additional sheets if necessary)
Air Resources Board (ARB) hosts and supports more than 90 mission critical and public facing business applications and databases at the California Department of Technology Center in Rancho Cordova, California. These systems are typically custom built and developed specifically to meet ARB business needs, and to serve and deliver air quality informati_on to ARB stakeholders and to the general public. In the event of a disaster, whether natural or man-made, ARB mission critical and public facing applications and databases could become unavailable.
ARB therefore requires a suitable Disaster Recovery site for storing backups, archives, and reconstituting its most critical systems in case of an extended outage. Currently, there is no other service provider supporting these services for ARB.
In ARB's release of the original Request for Quote (RFQ), ARB indicated a technical requirement of a standard height rack to store ARB's equipment (a 47 rack unit server space). The specific dimension of ARB 's equipment was never mentioned in the RFQ. The lack of clarity provided in the RFQ lead to a difference in definition of a standard height cabinet for ARB and Verizon. ARB's definition of a standard rack is an American Power Conversion NetShelter which is 48 inches tall and has a depth of 4 7 .2 inches; while the depth of a standard rack for Verizon's data center is approximately 29.25 inches. Since ARB's equipment will not fit into a standard Verizon rack, Verizon is able to build a secured cage area within their data center that will allow ARB to install an ARB owned rack deep enough to hold ARB's equipment at an additional cost of$41,018.00.
Approving this NCB will save State time and resources as ARB staff would need to cancel the current contract and rebid a new contract with more specific dimensions.
