About this file

This document is a Contract Advertising Exemption Request from the California Air Resources Board (ARB) to the Department of General Services for a non-competitively bid (NCB) contract with the Local Government Commission (LGC). The contract is for LGC's participation in the Governor's CivicSpark program to build capacity for local governments in California to address climate change. The NCB is justified as LGC is the only organization appointed by the Governor to administer the CivicSpark program, which is the only AmeriCorps program in California dedicated to this purpose. The contract term is from the date of DGS approval through March 31, 2017 for a total amount of $23,400.

The NCB is exempt from advertising in the California State Contracts Register per Public Contract Code Section 10340(b)(4), as LGC is the sole provider of these climate change mitigation services through the CivicSpark program. Without this contract, local governments throughout California would be unable to comply with AB 32 mandates to adopt essential climate change mitigation strategies. This contract supports the development of a statewide database of climate change mitigation efforts to facilitate knowledge transfer between local governments.

EXEMPTION JUSTIFICATION (Attach additional sheets if necessary)

This non-competitive bid (NCB) meets the criteria in accordance with Public Contract Code Section 10340(b)(4). The Local Government Commission (LGC) in partnership with the Governor's Office of Planning and Research (OPR), has been appointed by the Governor to administer the Governor's Initiative AmeriCorps program, CivicSpark, to focus on climate change issues. CivicSpark is the only AmeriCorps program in California specifically dedicated to building capacity for local governments to address climate change. LGC, in partnership with OPR, is the only appointed administrator of the CivicSpark program. There is no other organization that is capable of providing ARB these AmeriCorps services.

As noted in the California Global Warn1ing Solutions Act of2006 (AB 32) Scoping Plan, and underscored by the recent passage of the Clean Energy and Pollution Reduction Act (SB 350), California cannot achieve its climate change goals without active participation by local and regional governments. As part of this effort, ARB is pursuing the development of a database of climate change mitigation efforts throughout the State. This database will be an important building block to facilitate the transfer of knowledge between local governments and will provide the needed information to enable conmrnnities to take additional steps to reduce their greenhouse gas (GHG) emissions.

LGC is the only organization through which ARB can acquire the services that are provided through the Governor's CivicSpark program.

Without this Agreement with LGC, local governments throughout California will be unable to comply with AB 32 mandates to adopt climate change mitigation strategies essential to meet GHG emission reduction goals.
