About this file

This document is a State of California Contract Advertising Exemption Request from the Department of Forestry and Fire Protection (CAL FIRE) for a non-EDP/telecom related service contract with Chris Rowe for water supply to the CAL FIRE Hilton Fire Station. The contract period is from January 1, 2016 or upon approval (whichever is later) to June 30, 2017 at a contract amount of $10,250. The justification for the exemption is that since 1964 there has been a gentlemen's agreement between CAL FIRE and the adjacent property owner, Chris Rowe, to use his well and plumbing as the water source for the fire station, which does not have its own well and is not within the boundaries to be connected to a local water district. Continuing this contract with Chris Rowe is more cost-effective than CAL FIRE having to construct new water infrastructure for the fire station.

The pricing for the contract is $10,250 for the 18-month period. This is a non-competitive bid (NCB) exemption from advertising in the California State Contracts Register, which is allowed under Government Code Section 14825. No competitive bids will be accepted, as this is an existing arrangement between CAL FIRE and the incumbent contractor, Chris Rowe, that is the only feasible option due to the unique circumstances related to the Hilton Fire Station's water supply needs.

An exemption from advertising in the California State Contracts Register is not an exemption from Minority, Women and Disabled Veteran Business Enterprise (M/W/DVBE) participation goal attainment.

EXEMPTION JUSTIFICATION (Attach additional sheets if necessary)

When the Hilton fire station was built in 1964, a gentlemen's agreement was made between the adjacent property owner and CAL FIRE for the use of the property owners well and plumbing as the water source for the fire station.

This agreement, which has continuously been in place since 1964, is limited to Chris Rowe, the current property owner, due to the fact that his well is directly plumbed into the water tanks that supply water to Hilton fire station. The Hilton fire station does not have a well and is not within the boundaries to be hooked up to a local water district. If the department didn't continue the contract with Chris Rowe, it would require the department to spend significant funds on permitting, environmental mitigation, and viability options for well construction as well as the necessary distribution and storage systems of the water. Water delivery by truck would not be an economical option when compared to the annual cost gf the reposed contract. Connection to a municipal water system is not possible due ·to water district boundaries in ad 1tion to infrastructure costs that would be in excess of $2.1 million. See attached NCB for further details.
