Statement of Work (SOW) NMR Console and Probe Service Contract

Background The National Institute of Standards and Technology (NIST), Material Measurement Laboratory (MML), Applied Chemicals and Materials Division (ACMD) utilizes a Bruker Nuclear Magnetic Resonance (NMR) spectrometer to support the NIST mission by serving as the national reference laboratory for measurements in the chemical, biological and material sciences. Activities range from fundamental and applied research on the composition, structure, and properties of industrial, biological and environmental materials and processes, to the development and dissemination of tools including reference measurement procedures, certified reference materials, critically evaluated data, and best practice guides that help assure measurement quality. ACMD’s NMR spectrometer (serial number 10026169) is a 600 MHz instrument from Bruker-BioSpin with an Advance III console and a variety of probes and accessories.

Objectives This contract provides maintenance and repair services for the console electronics and BBO probe of a Bruker NMR spectrometer in Boulder, CO. The OEM considers the console end-of-life due to parts availability. Multiple third parties offer service and maintain parts inventories to extend the useful life of the equipment. The Contractor shall provide preventive maintenance and unlimited best effort repairs. In general terms, service and maintenance coverage shall include (1) remote support by phone or videoconference to diagnose instrument malfunctions within 48 hours, (2) repair or replacement of any malfunctioning component within the main console or the BBO probe, and (3) at least one on-site preventive maintenance visit per year.

Laboratory equipment must be maintained properly and repaired expeditiously. If not awarded, all service would have to be done on a billable basis which has a significantly longer turnaround time and additional administrative burden. Equipment downtime for this expensive instrument would increase drastically when repairs are needed, halting progress in programs dependent on this equipment, such as measurements on next-generation refrigerant formulations to facilitate the adoption of high-efficiency cooling systems and the IMS project that is developing faster and less expensive measurements of intermolecular interactions in solution (thereby improving chemical industry’s ability to design improved separations/purifications, catalytic reactions, and high-energy-density batteries).

Scope The goal of this contract is to ensure the functionality of the NMR spectrometer for current and planned research projects. It is important to note that some of the spectrometer’s accessories, including the cryoprobe and cryoplatform, are excluded from this contract because we have no current or planned work that requires them. Additionally, the magnet system is also excluded because it has a low probability of failure.

General Requirements

• The Contractor shall provide a service agreement for the repair and maintenance of the console electronics and BBO probe

• Due to the age of the instrumentation, it can only be maintained at a “best effort” level due to limited parts availability, as determined by the Contractor at the beginning of the contract. The Contractor cannot warrant that service provided under this contract will assure uninterrupted operation of the covered equipment.

• One annual preventive maintenance visit shall be included. Scheduling of preventive maintenance visits shall be incumbent upon the Contractor.

• Covered expenses shall include all parts, labor, and travel.

• The Contractor shall repair/replace all parts (i.e., hardware, software, accessory components/systems) required for the operation of the covered equipment. Parts may not be available for instruments determined to be best effort.

• Currently, all equipment is functioning in accordance with manufacturer’s specifications.

• Repair or replacement of parts from the NMR console shall be included. The console is the basic NMR system, supplied and manufactured by Bruker BioSpin Corporation, that consists of the electronic components that enable observation of NMR signals (and excludes the magnet system, probes, computer workstation, and peripheral devices). The console components are all located in the two-bay console cabinet.

• Repair or replacement of the room-temperature BBO probe (Bruker part number XXXXXX) shall be included.

• Unlimited remote support (phone or videoconference) during regular business hours shall be included in order to diagnose malfunctions or assist with the installation of new or repaired parts.

• In those situations where the NMR spectrometer is not operational, the Contractor shall use overnight carrier services to ship replacement parts to the NIST facility. If a replacement part is provided by the Contractor, they may choose to pay for the defective part to be shipped to them in exchange. In the case of an equipment repair, the Contractor shall use overnight carrier services to ship the defective part to themselves for an attempted repair, and also use overnight carrier services to ship the repaired part back to the NIST facility.

Specific Requirements

• Service Conditions, Repair Parts, and Repairs

1. All service provided under this agreement must be provided by personnel who are trained and fully competent in the operation of the covered instrument and accessories.

2. The Contractor shall only employ tools, instruments, test apparatus, methodologies, techniques, and practices approved for use with the instrument by the manufacturer.

The service protocols and instrument specifications shall be adhered to at all times.

3. The Contractor shall respond to remote service calls Monday through Friday, during regular business hours only. No remote service shall be required on the weekends.

Remote support to identify equipment problems is expected within two business days of the initial inquiry.

4. The Contractor shall make a reasonable effort to secure parts within 72 hours after identifying the need for a replacement part for the covered equipment.

5. Replacement parts provided under this agreement may be either new or remanufactured and the Contractor may exchange and/or repair existing components.

6. The Contractor shall make their best effort to repair the instrument so that it meets the manufacturer’s specifications for the NMR spectrometer as specified in the operation and maintenance manual for the instrument.

7. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. No shipping costs will be incurred by NIST under this contract. The Contractor shall assume liability for all parts removed from the NIST campus. Should a part need to be replaced, and that part is determined to be contaminated, NIST will dispose of the item. The

Government understands that rebates cannot be provided for items deemed to be contaminated.

• Preventive Maintenance

1. Provide one (1) preventive maintenance visit during each one-year term of the service agreement. This will include at least 6 hours of on-site time.

2. The Contractor shall be responsible for initiating scheduling with the technical point of contact and ensuring one preventive maintenance per year. Scheduling of the visits shall be consistent with the maintenance requirements of the instrument as detailed in the most recent operation and maintenance manual for each piece of equipment.

3. Preventive maintenance visits shall occur during NIST’s regular business hours. The Contractor must contact the NIST Technical Point of Contact (TPOC) in advance to schedule a mutually acceptable date and time for the preventive maintenance visits.

4. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. No shipping costs will be incurred by NIST under this contract. The Contractor shall assume liability for all parts removed from the NIST campus. Should a part need to be replaced, and that part is determined to be contaminated, NIST will dispose of the item. The Government understands that rebates cannot be provided for items deemed to be contaminated.

• Compliance with NIST Rules and Regulations

1. While on the NIST campus, the Contractor’s representative(s) shall abide by all NIST rules and regulations pertaining to visitors.

2. NIST is a restricted campus. An identification badge is required for access for entry into buildings and also is shown to the armed Security Police when entering the campus. Contractor personnel must wear the identification badge issued by NIST Security while working at any NIST campus. The Contractor shall provide all information necessary for the COR or TPOC to authorize entrance to the NIST campus in accordance with NIST Security Policy and Procedures. In the case of preventive maintenance visits, the Contractor shall provide at least thirty (14) days’ notice to the COR or the TPOC.

3. Regular business hours are Monday through Friday, 8:00 am to 5:00 pm local time.

Acceptance/Inspection by the government The Government reserves the right to conduct quality assurance testing to confirm that the NMR spectrometer meets the performance specifications. All Government testing will be completed within five (5) working days of the completion date of a maintenance, repair, or replacement.

Deliverables and deliverable due dates For the annual preventative maintenance visit, the Contractor shall submit a service ticket prior to departure from NIST. The service ticket shall include the following: date of service and time of arrival at NIST, narrative description of actions performed, results of diagnostic tests performed, model and serial number for any parts that were replaced or repaired, any additional comments or recommendations, date and time of departure from NIST, a printed name and signature for the service engineer, and a signature block for NIST personnel accepting the services rendered.

Travel Travel associated with the annual preventative maintenance visit shall be arranged and paid for by the Contractor.

Place of Performance The annual preventative maintenance visit shall take place on site at the NIST campus in Boulder, Colorado (325 Broadway St).

Period of Performance The period of performance shall be for one (1) base year from date of award with up to four (4) 1-year options. The period of performance shall not exceed five (5) years.
