About this file
This Limited Sources Justification document supports a sole-source logical follow-on task order award to Starry Associates, Inc. for continued functional and technical support services for NIST's business systems until their transition to the DOC-wide Business Applications Solution (BAS) and Grants Enterprise Management Solution (GEMS) is complete.
The task order, valued at $9,196,621.21, covers the period from February 4, 2025 through February 3, 2026, with one 1-year option and one 3-month option. Starry will provide program management, tier 2 customer support, training, software management, application development, testing, Oracle database administration, and interface support for multiple systems including the Core Financial System (CFS), SmartPay3, CBS Portal, CSTARS, E2 Travel, GMIS, and various other business applications. These services support not only NIST but also other DOC entities including the Office of the Secretary, Bureau of Economic Analysis, National Telecommunications and Information Administration, and Bureau of the Census. NIST expects to complete its transition to BAS and GEMS in FY2027, and this follow-on award ensures continuity of critical system support from the incumbent who has provided these services since February 2014.

Limited Sources Justification Purchase Request No. NB167000-25-00075
I. Identification of the agency and contracting activity.
U.S. Department of Commerce National Institute of Standard and Technology Office of Acquisition and Agreements Management Acquisition Management Division 100 Bureau Drive Stop 1640 Gaithersburg, MD 20899-1640
II. Nature and /or description of the action being approved.
The U.S. Department of Commerce (DOC), National Institute of Standards and Technology (NIST( Office of Financial Resources Management (OFRM), Financial Systems and Reporting Division (FSRD) requires continued provision of functional and technical support services for multiple bureaus of the DOC until NIST completes its transition to the DOC-wide Business Applications Solution (BAS) and to the DOC-wide Grants Enterprise Management Solution (GEMS). This document sets forth the basis for a noncompetitive logical follow-on task order for that continued provision until the NIST’s transition to BAS and GEMS is complete.
III. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The NIST uses many software applications to manage its business requirements (including those for financial, acquisition, financial assistance, Other Transaction Authority awards, loans, and travel business operations) for not only NIST but also for many other DOC organizational entities. Those other DOC entities include the Office of the Secretary; the Office of the Inspector General; the Minority Business Development Agency; the Economic and Statistics Administration; the Bureau of Economic Analysis; the National Telecommunications and Information Administration; the First Responders Network Authority; the International Trade Administration; the National Technical Information Service; and the Bureau of the Census.

Under Contract No. 47QTCA20D00DG, Task Order No. 1333ND19FNB180358, Starry Associates, Inc. (“Starry”) provides the required functional and technical support services for the aforementioned systems. Services that Starry provides include program management, project management, tier 2 customer support, training & user documentation, interfaces, software management, application interface support, application support and development, software testing, technical support (software, data, and instance management), change management, Oracle database administration, and feasibility studies and research of products/functionality to support those applications. The task order expires on February 3, 2025.
The NIST currently anticipates completing its transition to BAS and GEMS in Fiscal Year 2027.
In order for NIST to adequately support its currently utilized business applications until NIST successfully completes that transition, the OFRM/FSRD requires Starry to continue to provide functional and technical support services for those applications to ensure work currently being performed under the task order is completed without losing progress already made toward the transition to BAS and GEMS.
The period of performance for the logical follow-on requirement is February 4, 2025 through February 3, 2026, plus 1 one-year option and 1 3-month option, if needed. The estimated value of the logical follow-on task order, including the option periods, is $9,196,621.21.
IV. The authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Authority: FAR 8.405-6(a)(1)(C), "In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.
The original order or BPA must not have been previously issued under sole-source or limited-sources procedures".
Supporting Rationale: The NIST competitively awarded Contract No. 47QTCA20D00DG, Task Order No. 1333ND19FNB180358 as a small business set-aside using FAR Subpart 8.404 procedures. The Contracting Officer (CO), in conjunction with the Contracting Officer’s Representative (COR) for that task order, has determined that it is appropriate to award a noncompetitive logical follow-on to the aforementioned task order so that Starry can complete the pre-transition legacy maintenance support services in progress. Award of a logical follow-on will allow NIST to capitalize on time and financial investment already made toward the process for NIST to transition to BAS and GEMS. Otherwise, NIST would be in jeopardy of losing Starry’s corporate knowledge of how these customized systems work specifically at NIST to meet OFRM/FSRD’s requirements. It would take a significant amount of time for a new GSA FSS contractor to amass a close approximation to the specialized experience that Starry has just to maintain legacy system operations. Transition of the required legacy maintenance support to another GSA FSS contractor before NIST completes its transition to BAS and GEMS is completed would also introduce risk to the accuracy and timeliness of the accounting records;
the processing of financial, budgetary, acquisitions, and grants transactions; and the financial and budgetary statements reported to the US Treasury, the Office of Management and Budget, and the public.
Starry remains a small business under Contract No. 47QTCA20D00DG and, otherwise, also under NAICS code 541511 which applies to the logical follow-on requirement.
V. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).
The CO will perform price analysis and will only award a GSA FSS task order if they determine the price to be fair and reasonable. The CO will rely on the IGCE, historical data, a detailed technical evaluation of the quoted solution by the COR, fixed GSA FSS hourly rates for applicable labor categories, and their professional judgment in making that determination.
VI. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No market research was conducted among schedule holders for the logical follow-on requirement; it is critical that the maintenance of legacy systems continue to be completed by Starry until NIST’s transition to BAS and GEMS is complete.
VII. Any other facts supporting the justification.
Starry has provided the required support for NIST since February 2014.
VIII. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
The Acquisition Management Division will closely scrutinize any subsequent requests for acquisition of the required services and will ensure that any restrictions to competition are adequately supported and documented.
IX. The ordering activity contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
The ordering activity CO signifies, by signing this justification, that this justification is accurate and complete to the best of her knowledge and belief.
X. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
The COR’s signature at the bottom of this document is evidence of their certification that the basis for this justification is accurate and complete.
XI. A written determination by the approving official identifying the circumstance that applies.
