About this file

This document is a justification for a sole source contract award. Evans Army Community Hospital requires maintenance services for its NaviCare Nurse Call software system from Hill-Rom, the original equipment manufacturer. The services include software maintenance and support for the nurse call stations used in all in-patient areas at the hospital. The contract would be awarded on a sole source basis to Hill-Rom under the authority of FAR 13.501(a)(1)(ii) for commercial items. The period of performance would be from September 2023 to March 2026 with a total value of $XXX. Market research including a sources sought notice did not identify any other potential vendors since Hill-Rom is the only organization certified to maintain the proprietary nurse call system.

This action is a follow-on to contract W81K00-20-P-0259. The contract was not competed under authority 13.106-1 (b)(1). Paragraph, “Actions to Increase Competition” of the previous justification, stated: The government will continue to seek new resources will satisfy these requirements through continued market research, request for statements of capability, searches on the internet and telephonic inquiries.

Hill-Rom is the Original Equipment Manufacturer (OEM) for the NaviCare Nurses Call System housed at Evans Army Community Hospital, Fort Carson, CO. Hill-Rom does not currently use any subcontractors, distributers, or resellers. Without these services the NaviCare Nurses Call System would not be serviced or repaired. Special Notice of Intent for the proposed limited source award will be posted on SAM.gov for which any responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency for future requirements. 8. Market Research: A search on GSA was accomplished on 16 JUL 2023 using Schedule 65IIA, Medical Equipment and Supplies, category A-200, Medical Equipment and Supplies. This search identified 44 vendors in total, 37 which are small businesses.

An additional search was conducted for the suggested source and incumbent contractor, Hill-Rom, Inc. This vendor has a GSA contract (V797P-4434B), however, not under the applicable A-200 category. Hill-Rom, Inc. has supply items in schedules: A- 45, A-69, A-74 and A-77. Hill-Rom is the Original Equipment Manufacturer (OEM) for the NaviCare Nurses Call System housed at Evans Army Community Hospital, Fort Carson, CO. Hill-Rom does not currently use any subcontractors, distributers or resellers.

A sources sought was submitted to Sam.gov from 23 Jun to 30 Jun 2023. This sources sought generated zero responses. During market research conducted by the customer, Hill-Rom, Inc. submitted a letter dated 26 Jul 2023 that stated, “Hill-Rom Direct Support and Maintenance is the only OEM services organization certified to maintain Hill-Rom NaviCare Nurse Call System.

The current requirement is currently awarded to other than small business Hill-Rom, Inc.

under NAICS 811219. There is reasonable expectations that the follow-on will not be set aside for small business concerns. Market research has indicated, that this requirement will be sole sourced to Hill-Rom, Inc. a large business.

Software and equipment Maintenance is customarily available in the commercial marketplace. Based on this market research and IAW FAR 10.001(a)(3)(ii), this requirement meets the definition of a commercial items as defined in FAR 2.101(a) “Commercial Item”.

Per FAR 19.502-2 a review for small business socioeconomic contracting programs was conducted. A search of the Small Business Administration’s (SBA) Dynamic Business Search (DSBS) using NAICS 811210 and using keyword “nurse call maintenance”, identified zero matches.

A review of mandatory sources to include GSA/VA Schedules, in addition to open market and knowledge of the current contract indicates that NaviCare Nurse Call System maintenance is commercial in nature and only available on a sole source basis to Hill-Rom, Inc. Hill-Rom, Inc. is the only OEM service organization certified to maintain Hill-Rom NaviCare Nurse Call System.
