JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Training Systems Division (NAWCTSD) Orlando, FL

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves on a sole source basis the issuance of a Firm-Fixed-Price contract modification for Naval Air Technical Training Center (NATTC) Contractor Instructional Services (CIS) to Engineering Support Personnel (ESP), 2603 Discovery Drive, Suite 115 Orlando, Florida 32826. The period of performance is 01 August 2020 to 31 August 2023, if all six months of the 52.217-8 Option to Extend Services clause are utilized. NAWCTSD is currently tasked to provide Fielded Training Systems Support (FTSS) services in support of naval aviation maintenance training for the Center for Naval Aviation Technical Training (CNATT) in Pensacola, Florida. Under the NATTC program, the support currently consists of Contractor Operation and Maintenance Services (COMS) and Contractor Maintenance Services (CMS), which is being provided via contract N61340-18-C-0013. This $11.6 million firm-fixed-priced contract was competitively awarded to ESP, Inc., on 27 February 2018 and provides the aforementioned support services for the United States Navy/United States Marine Corps (USN/USMC) enlisted aviation maintenance training at Naval Air Station (NAS) Pensacola, FL and Joint Base McGuire-Dix-Lakehurst (JBMDL), NJ.

3. Description of Supplies/Services.

This modification will add CIS to the NATTC program, at Pensacola, Florida, where the training services will be conducted. The contractor will provide United States Navy/United States Marine Corps (USN/USMC) personnel with necessary control tower and radar knowledge to meet the Federal Aviation Administration (FAA) certification requirements. Under supervision at an Air Traffic Control (ATC) facility within the National Airspace System (NAS), the contractor will impart their technical knowledge and skills to fulfill technical requirements at the apprentice entry-level for an ATC facility ashore.

The contractor will provide USN/USMC personnel with knowledge regarding aviation fuel;

lubrication of oil service stations and pump rooms; piping; valves; pumps; tanks; portable equipment related to the fuel system; and instruction for the operation; maintenance; valve repair; and, piping of purging and protective systems aboard Air Department Schoolhouse spaces on ships. Furthermore, the contractor will provide knowledge and instruction for the operation and servicing of fuel farms and equipment associated with the fueling and defueling of aircrafts by instructing the servicing of motorized fueling equipment and by maintaining fuel quality

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with FAR 6.302-1(b)(1)(i), only ESP possesses the capability to provide the required instructional services without unacceptable delays in fulfilling the Navy’s requirements.

ESP was competitively awarded N6134018C0013 in FY18. This contract encompasses FTSS services for the NATTC program. The required services are otherwise part of the overall NATTC program for which ESP was competitively selected to support through August 2023. As a result, ESP is situated to begin these additional instructional services by the required need date of 01 July 2020. Selection of an alternative source through the establishment of a new contract would take no less than six months. This would result in at least a six-month delay in acquiring the services, if started immediately. Therefore, ESP is the only contractor able to fulfill the agency’s requirements without incurring an unacceptable delay.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In order to comply with PGI 206.302-1, the Procuring Contracting Officer (PCO) issued a sources sought notice to Contract Opportunities via Beta.SAM.gov on 26 February 2020. The intent of the notice was to seek information on the availability of potential comparable sources to provide the increased NATTC instruction services to the fleet. No responses were received.

In accordance with FAR 5.201, the PCO also issued a pre-solicitation notice to Contract Opportunities via Beta.SAM.gov on 07 May 2020. The intent of the notice was to ensure full consideration is given to all potential sources. One response was received, from .

The Task Order Manager, Contracting Officer's Representative and Contract Specialist assessed the capability of this potential source. was determined not capable of fulfilling the requirements for the following reasons. First, there is an increased risk whether can execute the requirements in such an abbreviated timeframe because the company has no record of past performance. Second, ’s response showed a lack of understanding of the requirement because it proposed a labor category for Instructor/Course Developer where there is

J&A 20-0158 no course development requirement. Last, 's fully burdened rates were approximately % higher for the site manager and % higher for the instructors than ESP’s fully burdened labor rates. Thus, the PCO is not confident that will meet the requirement, meet the performance schedule due to not understanding the requirement, or provide a fair and reasonable price.

The lack of response from any capable sources to these outreach efforts confirms the assertion that no source other than ESP is capable of producing and delivering the NATTC instructional services in a timely manner. However, any additional responses received will be evaluated by the PCO prior to award. No additional market research was conducted because it is not practicable, for the reasons stated in paragraph 5 above, for any source other than ESP to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services ordered pursuant to this J&A are procured at a fair and reasonable price. Upon approval of this justification, the contractor will be requested to provide a detailed price proposal identifying each individual cost element for specific Government requirements. The cognizant Contract Specialist will utilize the information submitted to perform thorough cost and price analyses. In addition, any further information deemed necessary to perform a cost analysis will be requested if necessary. The Contract Specialist will incorporate the advisory input of the Task Order Manager, Project Manager, Defense Contract Management Agency (DCMA), and the cognizant Defense Contract Audit Agency (DCAA) Auditor as applicable.

8. Actions to Remove Barriers to Future Competition.

The FTSS program continues to be proactive in seeking additional sources. Additionally, this CIS effort will be competed as part of the overall NATTC effort going forward (FY23 and future iterations), thereby allowing for continued future competition.
