DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR

CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C262-24-AP-1122 ; PR: 691-24-2-8661-0018

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Long Beach, 4811 Airport

Plaza Drive, Ste 600, Long Beach, CA 90815.

2. Nature and/or Description of the Action Being Processed: In accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. VA Greater Los Angeles Healthcare System (VAGLAHS), Health Care for Homeless Veteran (HCHV) program requires A Bridge Home (ABH) transitional housing and supportive services for Thirty (30) male Veterans experiencing homelessness. This will be awarded as a new single award Sole Source, Firm Fixed Priced (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Volunteers of America, Los Angeles (VOALA) shall provide housing, and supportive services for up to Thirty (30) Male Veterans experiencing homelessness on the West LA Campus of GLA through Contracted Emergency Residential Services (CERS) within the Veterans Affairs Greater Los Angeles Healthcare System (VAGLAHS), Health Care for Homeless Veteran program (HCHV) program.

VOALA shall offer a safe and secure environment that supports Veterans goals for recovery from homelessness by rapidly housing male Veterans requiring residential services and treatment at VAGLAHS, addressing mental health, substance abuse and other psychosocial problems. The ultimate goal of this program is to provide transitional housing while Veterans actively search for and obtain permanent housing within 90 days under this CRS contract.

VOALA will provide a team-based staff composition that is a mix of mental health and addiction treatment professionals, licensed social workers, licensed mental health counselors, nurses, psychologist, and housing and/or peer specialists.

Volunteers of America of Los Angeles (VOALA) is a Non-Profit Business, otherwise recognized as an Other Than Small Business, and has been identified as being able to meet the needs required by VAGLAHS in providing ABH transitional housing and supportive services for six (6) months, (period of performance 04/01/2024-09/30/2024), while a long-term requirement is being procured competitively.

The below chart provides a breakdown of the estimated cost of the contract period of performance.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Since 2019, VOALA has been providing transitional housing services to VAGLAHS. They have established a great working relationship with VAGLAHS staff and are currently providing residential housing services to four (4) contracts under the HCHV CERS program.

They provide services to Veterans experiencing homelessness, mental health, and substance abuse problems under VAGLAHS IDIQ contracts# 36C26219D0062 (T House) & 36C26219D0063 (Avalon), two (2) 40-bed Low Demand Safe Haven programs. With this program VOALA provides services to Veterans in a low-demand environment with a minimum set of rules designed to re-establish trust in chronically homeless Veterans and engage them in needed treatment services.

VOALA provides services to Veterans under IDIQ contract# 36C26219D0055, a 10-bed recuperative care and supportive service contract. Services rendered under this program is for the rapid stabilization of Veteran’s medical, mental health, substance abuse and other psychosocial issues they are dealing with in an effort to place them in an appropriate transitional or permanent housing within 90 to 180 days, as well as providing short term medical care and case management to eligible Veterans recovering from an acute illness or injury, or with chronic medical concerns whose conditions are exacerbated by being homeless or living in a non-specialized shelter.

VOALA also provides case management, and supportive services under IDIQ contract# 36C26219D0051, a 25-Bed Residential & Supportive Services contract. VOALA is

6. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Under contract# 36C26220D0015 VAGLAHS paid the rate of $119.86 per Veteran per day for the base year of the contract that provided the same services in 2020.

Under that contract there was an approximate 2.3 percent rate increase at the renewal of each option year. On the final option year of the contract, in 2023 VAGLAHS paid a rate of $128.52 per Veteran per day which is a 1.1 percent difference of the current rate. In addition, other contracts awarded in 2020 providing similar services such as contracts# 36C26219D0062 (T House) & 36C26219D0063 (Avalon) both with VOALA, VAGLAHS pays a rate of $110.00 & $121.00 per Veteran per day respectively. Although the rate of $130.00 per Veteran per day is a 16 percent increase difference for (T House) and a 7.4 percent increase difference for (Avalon) there are other factors to consider such as cost of living increases of slightly over 3 percent per year since 2020 and the changes caused by COVID-19 to the marketplace and the economy. Therefore, the CO considers the anticipated rate of $130.00 per Veteran per day that covers Veterans space allotted for sleeping, eating, case management, and clinical services to be fair and reasonable.

7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted through searches in Veterans Small Business Certification, SAM and FPDS. The search in Veterans Small Business Certification provided 176 SDVOSBs and 12 VOSBs. However, none appeared capable of meeting this emergent requirement. The search in Veterans Small Business Certification showed SDVOSBs and VOSBs that supported Consulting, Logistical and Construction services.

A search conducted in SAM and FPDS provided two (2) sources Volunteers of America, Los Angeles (VOALA) a Non-Profit Organization and PATH a Non-Profit Organization.

VOALA and PATH are currently providing similar services to VA Greater Los Angeles Healthcare System (VAGLAHS) under contracts# 36C26219D0062, 36C26219D0063, 36C26219D0051, and 36C26219D0055 (VOALA) and contract# 36C26220D0019 (PATH).

In addition, after reviewing the past performance for both VOALA and PATH, both appeared capable of meeting this emergent requirement. Correspondence was made to both VOALA and PATH for this requirement. However, PATH declined due to not being able to meet the staffing requirement by the start date of the contract. VOALA provided a response stating they could meet the staffing requirement and provide the services in a timely manner.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition: This is an urgent need due to the previous contractor failing to provide the services until the originally agreed upon contract end date of 03/05/2024. VAGLAHS is currently procuring a long-term contract to provide the same services. While the long-term contract is being

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research was conducted and as seen above, there are at least two

(2) capable vendors who appear to meet the needs emergent requirement. Correspondence was made to VOALA and PATH but only VOALA expressed interest in supporting this requirement. In addition, due to the urgent need to continue services until a long-term contract is procured, Volunteers of America, Los Angeles is best suited to carry out case management and supportive services for Veterans experiencing homelessness. The anticipated award date for the long-term contract is March 1, 2025.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
