2. Description of the Action Being Approved.
These acquisitions are for individual components of an instrumentation system used in support of the flight test system of the E/A-18G and Next Generation Jammer (NGJ) program. This justification and approval authorizes and approves on a sole source basis contracts to Ampex Data Systems Corporation, Hayward, California, and Avionics Interface Technologies (AIT), Omaha, Nebraska, for providing a quantity of up to fifteen (15) Fiber Channel Audio Visual (FCA V) units and up to fifteen ( 15) 16 Port Fiber Channel Interface Units (FCIU).
The authority to act under this CJ&A expires September 30, 2020.
3. Description of Supplies/Services.
The NGJ project includes the purchase of Electronic Assemblies/Airborne Instrumentation items which includes up to 15 FCA V units manufactured by Ampex and 15 FCIU units, AIT part number FCIU-FC16, which are required to support the NGJ program. These FCAV and FCIU units will be integrated into the NGJ compatible aircraft instrumentation system and installed on aircraft not currently equipped with this configuration. The FCA V does not have a specific part number but consists of multiple part numbers which specifies the required configuration as defined below:

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(l), Only one responsible source and no other supplies or services will satisfy agency requirements. There is only one responsible source for the FCA V and one responsible source for the FCIU.
5. Rationale Justifying Use of Cited Statutory Authority.
The purpose of this requirement is to purchase up to 15 additional FCA V units from Ampex and up to 15 additional FCIU units from AIT. The FCAV was developed for and purchased by the Navy under contract number NOOO 19-16-C-0032 with Boeing who subcontracted to Ampex to develop the FCAV units and manufacture a quantity of 7 units. The government did not require delivery of any drawings except what was necessary to facilitate a flight clearance. Those drawings are not sufficient for manufacturing purposes nor can they be released without authorization from Ampex. An additional 2 units have previously been purchased by the Navy under contract number N68936-17-C-0041 .
The FCIU was also developed for and purchased by the Navy under contract N00019-16-C-0032 with Boeing who subcontracted to AIT to develop the FCIU and manufacture a quantity of 7 units. The government did not require delivery of any drawings except what was necessary to facilitate a flight clearance. Those drawings are not sufficient for manufacturing purposes nor can they be released without authorization from AIT. An additional 4 units have been procured under Navy contracts N00421 -16-P-0588 and N68936-l 7-P-0018.
The 15 additional FCA V and 15 additional FCIU units needed by the NA WCWD El A-l 8G and NGJ programs need to be identical in form, fit, and function with the previously supplied units in
Redacted order to be interchangeable among the aircraft utilized for testing at either the Pacific or Atlantic Test Range facilities.
The FCA V units are highly specialized and available only from Ampex, the original developer and manufacturer. The FCA V unit captures 4 standard video streams, encodes, and multiplexes the 4 video streams as one and outputs it in a GigE format. In addition, the unit captures one FC A V channel and converts it to GigE. This data will be telemetered to ground stations located on the test ranges.
The FCIU is a specialized piece of equipment that is only available from AIT, the original developer and manufacturer. The FCIU accepts 16 Fibre Channel inputs and has the capability to filter data. The FCIU has 2 Ethernet outputs and two PCM outputs.
A ward to any other source would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition. All FCA V and FCIU units need to be identical in form, fit, and function, in order to maintain systems between the two test ranges that are analogous, to ensure cross site capability in support of the program. The only way other manufacturers could provide these supplies would be if the Government competitively awarded contracts to other sources to produce these units. If the Government awarded to other sources, the 9 FCA V units and 11 FCIU units currently in operation would need to be replaced at an estimated cost of
) for the FCIU. In addition, development, requalification of the instrumentation system, and non-recurring engineering costs would be necessary, although those costs cannot be estimated at this time.
Further, award to another source would likely require additional development time which would delay the testing program schedule for up to 1 year. Once units would be delivered, the program would experience an additional delay of 3-6 months for requalification, acceptance testing, and integration for each item. Any delay in providing test data to the test customer would delay delivery of critical defense capability to the fleet and ultimately increase fleet vulnerability.
Acceptance testing and integration efforts would incur, at a minimum, an additional cost of for each item.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was not conducted because if the Government changed vendors, there would be a substantial duplication of cost that is not expected to be recovered through competition (see Paragraph 5). As required by PGI 206.302-1, a Sources Sought notice for the FCA V was posted to the FEDBIZOPPS website on 17 July 2017. No responses were received. As required by the Small Business Act (15 U.S.C. 637(e)) and 41 U.S.C. 1708, a Presolicitation Notice for the FCAV was posted to the FEDBIZOPPS website on 04 August 2016. No responses were received.
As required by PGI 206.302-1, a Sources Sought notice for the FCIU was posted to the FEDBIZOPPS website on 17 July 2017. No responses were received. As required by the Small
Business Act (15 U.S.C. 637(e)) and 41 U.S.C. 1708, a Presolicitation Notice for the FCIU was posted to the FEDBIZOPPS website on 09 August 2016. No responses were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15 .402, the Contracting Officer shall ensure that all supplies and services provided under these contracts are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with other than certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. Proposals from Ampex and from AIT will be reviewed by experienced technical analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and/or price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
NA WCWD China Lake, CA has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NA WCWD China Lake, CA will assess whether competition for future requirements is feasible.
Because this effort is a follow-on for supplies previously awarded on a non-competitive basis, in accordance with DF ARS PGI 206.304(a)(i), the prior J&A for the FCA V was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DF ARS PGI 206.304(a)(ii).
