JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Weapons Division (NAWC-WD) China Lake, CA

2. Description of the Action Being Approved.

This justification and approval authorizes and approves on a sole source basis a contract between the Government and Eaton Aerospace Group, Grand Rapids Michigan in accordance with 10 U.S.C. 2304(c)(I), Only one responsible source and no other supplies or services and FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

3. Description of Supplies/Services.

Feel Trim Actuator (FTA) F/A-18 A-D and E-G Lateral and Longitudinal Stick Position Sensors Test Bench.

The estimated total value of the FTA contract is $690,000.00 and will be funded as set forth in the table below. The estimated contract value also includes: trainers; delivery, and software.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(I), Only one responsible source and no other supplies or services will satisfy agency requirements.

S. Rationale Justifying Use of Cited Statutory Authority.

This test stand has technical data, software, and hardware requirements only available through Eaton. Software requirements includes labview, the software used to operate current US Navy FT As was previously owned by McDonald Douglas. Eaton has purchased the software rights for this test stand. This equipment supports the actuators forthe FA-18's and Navy regulations mandate that all FT As have the same software and hardware to enable standardization of any Navy Fleet Readiness Centers or maintenance locations with FT As in order to perform the maintenance and work necessary.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

J&A Number: 18-0507 In accordance with DFARS PG! 206.302-l(d), a Sources Sought announcement was posted to the Federal Business Opportunities (FBO) website on 17 August 2018 with responses due on 23 August 2018. No responses were received.

Two companies were surveyed: Redacted with expertise in the field of aerospace and industrial test systems and both companies indicated that they would not be able to satisfy the complete requirement due to software license rights.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the price. Eaton's proposal will be reviewed by experienced cost analysts and contract specialists. In addition, the analysis will include comparison of the proposed price with prices found reasonable on previous purchases, current price lists, catalogs, or advertisements, the contracting officer's personal knowledge of the item being purchased, comparison to an independent Government estimate, and any other reasonable basis as determined by the Contracting Officer.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NA WCWD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges or the required software to operate the US Navy FA/18 FT As become open source, NA WCWD will assess whether competition for future requirements is feasible.
