DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER WEAPONS DIVISION
1 ADMINISTRATION CIRCLE
CHINA LAKE. CA 93555-11100
575 I AVENUE SUITE 1
POINT MUGU. CA 93042-5049
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Weapons Division (NAWC-WD)- China Lake, CA
2. Description of the Action Being Approved.
IN REPLY REFER TO:
J&A_13_23462
This justification and approval authorizes and approves on a sole source basis a contract modification providing an additional Level-of-Effort of 49,920 hours within the current period of performance under contract N68936-08-D-0027, Aircraft Electronic Warfare Weapons Systems Modifications with Engility Corporation.
3. Description of Supplies/Services.
The objective of the Airborne Electronic Attack (AEA)/Integrated Product Team (IPT) EA-6B Engineering Services contract is to provide Engineering, Technical and Programmatic support services, including design, development, integration, test and distribution of all Operational Flight Programs (OFPs) to the Fleet, for development of Electronic Attack and Electronic Warfare products within the AEA/EA-6B IPT located at the Naval Air Warfare Center Weapons Division (NAWCWD), Point Mugu, California. Programs to be supported under this contract include: E-2C, MH-60R, EA-6B, EA-18G and other advanced electronic attack derivatives. The contract is an IDIQ, CPFF contract and this modification will increase the level of effort and corresponding cost of the contract by $6,032,149. The period of performance remains unchanged at 01 September 2008 through 31 August 2013.
See Appendix A for Estimated Dollar Value
4. Statutorv Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."
5. Rationale Justifying Use of Cited Statutorv Authority.
The need exists for a Level of Effort (LOE) increase on this contract due to unanticipated work, which includes the addition of EA-18G Foreign Military Sales to the Australian Defense Force, AEA integration for ACAT 1 D Next Generation Jammer, and Overseas Contingency Operations in direct support of United States Marine Corps EA-6B missions. This additional effort is in scope and is required to continue critical
J&A_13_23462 identification and understanding of emerging Electro-Magnetic threats and to enable the Navy to outpace those threats by delivering advanced fully integrated Electronic Warfare capabilities to the fleet. Engility Corporation is the current contractor providing effort under this contract. They are the only contractor with the required workforce, expertise, experience, and knowledge required to complete on-going projects because of the specialized requirements of this contract. The additional level of effort is mission critical and failure to provide upgraded threat detection and defeat capabilities will incur an unacceptable risk of safety and delay in fulfilling the Government's requirements to execute Overseas Contingency Operations upgrades to the EA-6B and EA-18G aircraft. It is in the best interest of the Government to allow the current contractor to continue performance so that the Government does not fail to meet mission requirements.
Failure to do so will result in undefined radar and communication systems threats that will prevent fleet operators from detecting and jamming these systems in support of kinetic strikes. This will degrade the fleet's ability to meet mission requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with FAR 5.201 (b)(1 ), this requirement was synopsized via the Federal Business Opportunities website on 1 0 June 2013. No responses or inquiries have been received at this point. Any future responses will be evaluated by the Contracting Officer.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR Part 15.402, the Contracting Officer will ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The contractor will submit a cost proposal with certified cost and pricing data and sufficient information to support the accuracy and reliability of the estimate. The Engility Corporation proposal will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary DCMA field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
Previous actions have removed barriers to enable full and open competition of the follow on contract.
Based on market research that identified multiple sources, the follow-on to this contract is being processed on a full and open competition basis.
