About this file

This is a Question and Answer Log for Amendment 1 to a Navy fuel transfer hose solicitation (N6883626Q0055). The document addresses six key industry questions regarding specification and compliance requirements.

The primary issues raised concern clarification of the correct military specification for hose construction. Industry questioned whether the solicitation's reference to "MIL-DTL-2240G(SH)" was a typographical error for "MIL-DTL-22240G(SH)," the historically standard specification for synthetic fiber-jacketed fuel transfer hose. The government response clarified that hoses must comply with MIL-DTL-22240G(SH), not merely be marked with the specification number. A secondary question proposed that, given the commercial product acquisition approach, performance-based requirements should be prioritized over prescriptive military design specifications to allow for commercially viable alternatives that meet operational performance standards for pressure testing and fuel handling. The final substantive question addressed Buy American and Berry Amendment compliance requirements for textile-reinforced hose components. The government confirmed that DFARS 225.7002-2 exceptions apply since the acquisition is below the $200,000 threshold, and therefore DFARS 252.225-7012 will be removed from the solicitation documents. These clarifications establish that offerors must supply hoses compliant with MIL-DTL-22240G(SH), meet salient performance characteristics identified in the Description of Requirements, and are exempt from Berry Amendment textile sourcing restrictions.

QUESTION & ANSWER LOG
AMEDMENT 1
QUESTIONANSWER
1Section 1.4(III) of the DOR states:

"All Hoses must have MIL-DTL-2240G(SH) Alongside Fueling/First Article Test/Branding Proper Markings..."

However, MIL-DTL-2240G(SH) is not the military specification commonly associated with fuel transfer hose. We believe the Government intended to reference MIL-DTL-22240G(SH), which is the specification historically used for synthetic fiber-jacketed hose applications and contains the branding requirements cited in the solicitation.MIL-DTL-22240G(SH)
2As currently written, the solicitation does not explicitly require the hose to comply with MIL-DTL-22240G(SH). Instead, it states that the hose must be marked with the specification number and revision letter as part of the branding requirements.

There is a significant difference between:

•A hose that is marked with a specification number, and
•A hose that has been designed, tested, and qualified to all requirements of that specification.Recommend: PWS will read "All hoses are required to comply with MIL-DTL-22240G(SH) specification .
3The solicitation is being conducted as a commercial product acquisition and evaluates products based on whether they meet the "salient physical, functional, and performance characteristics identified in the DOR."

Consistent with the Government's preference for commercial products and performance-based acquisition approaches, consideration should be given to defining the required performance outcomes rather than prescribing a specific detailed military design specification.

For example, Company A manufactures fuel transfer hose that meets or exceeds the operational performance requirements associated with fuel transfer operations, including pressure testing and fuel handling performance, but has different physical characteristics and construction than products built to the historic MIL-DTL-22240G design configuration.Recommend: The quted products meet the salient physical, functional, and performance characteristics identified in the DOR section 1.4.
4The solicitation currently requires offerors to identify the product's country of origin and includes Buy American representations.

However, fuel transfer hose constructed with synthetic textile reinforcement may involve materials that fall within categories historically addressed under Berry Amendment restrictions implemented through DFARS 225.7002 and DFARS 252.225-7012.

If the Government intends to procure domestically manufactured hose utilizing U.S.-produced textile components, yarns, and reinforcement materials, the solicitation should expressly require Berry Amendment compliance rather than relying solely on country-of-origin disclosures.

Whether Berry Amendment compliance is required for this procurement. Per RFO DFARS 225.7002-2 Exceptions, Acquisitions in the following categories are not subject to the restrictions in 225.7002-1: (a) Acquisitions not exceeding $200,000, except for athletic footwear purchased by DoD for use by members of the Army, Navy, Air Force, or Marine Corps upon their initial entry into the Armed Forces (37 U.S.C. 418(b)(4)).

DFARS 252.225-7012 will be removed.
