About this file

This is a Justification and Approval (J&A) for use of other than full and open competition for a federal procurement action.

NAVSUP FLCJ and SERMC are procuring multiple parts for the Number 1 Main Propulsion Diesel Engine (MPDE) Keep Warm System to support maintenance and replacement operations aboard the USS MINNEAPOLIS SAINT PAUL. The procurement is being conducted as a sole source acquisition under FAR 13.501(a) authority, applicable to purchases not exceeding the simplified acquisition threshold. The procurement request/purchase order numbers are 1301332774 through 1301332777, with a required delivery date of November 18, 2026. The contracting officer determined that the material represents the minimum government requirements and is estimated to not exceed the simplified acquisition threshold.

The justification establishes that only one responsible source is available based on exclusive licensing agreements. Fairbanks Morse Defense (FMD) holds exclusive rights to manufacture, sell, install, and provide parts and services for the specified engine types (MAN 28/33D STC, MAN 48/60, MAN 48/60 CR, PC2.5, PC2.5 CR, PA6B, PA6B STC, and PC 4.2) pursuant to license agreements with MAN Diesel & Turbo SE and its affiliates. The manufacturer Everllence confirmed that FMD is the only OEM Pielstick distributor in U.S. territory. A sources sought notice was posted to SAM.gov on February 25, 2026, which resulted in no responses. The J&A was technically and legally certified on February 20, 2026, and approved by the Head of Contracting Activity on March 3, 2026.
