This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in using Simplified Acquisition Procedures under found at FAR 13. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on NECO (http://www.neco.navy.mil/ ) and FEDBISOPPS (https://www.fbo.gov/).
The Request for Quote (RFQ) number is N6883624Q0078. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-87 and DFARS Change Notice 20160616. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. Performance Work Statement
2. SCOPE
The Bird Strike Data System shall provide collection, analysis, and presentation of the bird position and movement data to include displays and warning alerts, along with any necessary equipment needed to provide that data and will be referred to in this Performance Work Statement (PWS) as the “Bird Strike System.” The scope of this effort will be that the Contractor shall deliver, set up and maintain a Bird Strike System at NAS Kingsville, which can provide the following:
a. The Bird Strike System must be able to provide avian target counts, total avian radar cross-section, location (bearing, range, and altitude), direction of travel, speed, and size data for the departure and arrival corridors for four runways and provide alerts to specific risks in the critical flight areas during flight operations (i.e. approach and departure corridors to 4 nautical miles and local flight patterns).
b. Bird Strike System must provide 3-dimensional data (bearing, range, and altitude) to include avian target counts, total avian radar cross-section, direction of travel, speed, and size data, to include presentation of that data, for 360-degrees of coverage out to 4 nautical miles (nm) minimum during flight operations. This capability will be augmented with an Electro-Optical/Infra-Red (EO/IR) camera (or similar) to provide visual verification (via pan and zoom to selected targets) and tracking during day and night operations of flying birds and drones. This capability shall be able to detect animals on any runway.
c. Bird Strike System must provide 2-dimensional data (bearing and range) to include avian target counts, total avian radar cross-section, direction of travel, speed, and size of large targets, to include presentation of that data, for 360-degrees of coverage out to 8 nm minimum during flight operations. Both range and altitude discrimination are preferable; however, altitude discrimination is essential in the departure and arrival corridor to an altitude of 2000 ft. or more. Thermal modeling shall be employed into risk analysis to better target altitudes of concern with thermals utilized by raptors/vultures.
d. Bird Strike System must be capable of providing both visual and audible alarms for condition changes.
e. Bird Strike System shall be capable of providing alarms for sectors, including active runway patterns, when requested.
f. The Contractor shall work with TW-2 personnel and station Wildlife Biologist to establish initial operational parameters and Bird Strike System set up to include alarm thresholds for moderate, high, and severe BASH conditions which will be established following annual risk assessment of NASK strike and Bird Strike System data. Alarm thresholds shall be set based on number, size, altitudes, and direction of travel of avian targets in each sector. Determination of size and shape of sectors shall be established during Bird Strike System set up. Subsequent periodic updates to alarm thresholds and sectors size and shape are essential and shall be based on the needs of the customer. They shall be completed quarterly, as well as in conjunction with yearly risk assessments using NASK strike data and Bird Strike System target passage rate data.
g. Bird Strike System must provide daily, weekly, and monthly target passage rates and directional distributions of targets by hour both horizontally and vertically. These reports are vital in creating historical data and in determining migration patterns and peak target passage rates for NAS Kingsville.
h. All major components of the Bird Strike System equipment must be configured to accept external power. During power outages, the Bird Strike System must be able to provide data for 2 hours. Backup Uninterrupted Power Supply (UPS) with additional battery units or backup generator will be added to the system to provide at least 2 hours run time during power outages.
i. Bird Strike System should be mobile to facilitate relocation if required due to extreme weather. With respect to safeguarding the equipment the contractor shall provide an actionable plan that will ensure survivability of leased equipment during the planned Atlantic Hurricane Season. Specifically, the contractor shall take action to ensure maximum equipment survivability once Commander Naval Region Southeast, declares Condition Of Readiness of Four (COR 4) described as destructive force winds (50mph) are forecasted within 72 hours, or higher due to the threat of damaging tropical and sub-tropical storms or dangerous forecast weather conditions. The contractor shall directly coordinate with Base Operations and provide all necessary material, logistical support, facilities, and administrative support required to move and protect leased proprietary equipment. If conditions or time do not permit the relocation of equipment by the contractor, then contractor may authorize Base Operations support personnel in writing (email) to relocate equipment into a suitable protected shelter of the governments choosing and will provide any and all detailed documentation detailing the activities/actions required to move system into a protected shelter. Additionally, if contractor authorizes movement of leased equipment, the contractor shall hold the government harmless from the loss of or damage to property.
j. Bird Strike System must be self-contained and will not be connected to any government owned/operated computer systems or networks unless authorized. Data collection and dissemination will be achieved by a Contractor provided computer system or network with high-speed data service or capability with bandwidth sufficient to stream a minimum HD video resolution of 720p or 1080p and other required data for normal operations to include remote updates; EO/IR camera streaming; web page feeds; and other data visualization requirements. Data shall be monitored and displayed in a secure manner that allows for access through a standard web browser by computers provided by and connected to the Navy Marine Corps Intranet (NMCI) network. The Bird Strike System shall be fully operated and maintained by the contractor, to include end user technical support.
k. The Bird Strike System shall include at a minimum two monitors or displays with one in the NAS Kingsville Wildlife Biologist Office and one in the Wing Duty Office spaces with point-to-point wireless receive capability (or other available data connections) from the Bird Strike System. Additionally, there should be an optional third monitor or display located in the NAS Kingsville Air Traffic Control (ATC) tower. Ruggedized tablet-style monitor or portable laptop display is preferred.
l. All Bird Strike System data collected shall be shared to Commander, Training Wing TWO upon contract fulfillment or termination in a format consistent with data accessibility principles. The Contractor must provide sufficient data storage of all raw data collected for up to 5 years to allow for historical data analysis.
m. Operating procedures must be provided for the Bird Strike System, monitors, and emergency generator.
n. The Contractor will conduct two scheduled site visits to the System Location each year. During these visits the contractor will provide preventive maintenance on the system to include System checks, installation of software upgrades, defective or failed component replacement or repair, and performance testing. All site visits will be coordinated and scheduled with NAS Kingsville. This does not preclude the vendor from conducting additional assist visits at times agreeable to Training Air Wing TWO. The contractor will also provide remote 24-7 telephone and internet technical support, remote system monitoring (via FileWatcher®) and remote specialized radar operating system software upgrades.
o. The Contractor shall provide a minimum of quarterly (4 per year) reoccurring training sessions to the Wing Duty Officers at the TRAWING TWO Safety Stand-downs on reading and interpreting data from the system. There will be approximately five hundred attendees during each session. These training sessions can be part of regularly scheduled assist visits.
p. The Contractor shall provide training for users on Bird Strike System operation, minor Bird Strike System maintenance, monitor/display operation, and data extraction and evaluation in association with site visits. The contractor shall ensure that appropriate on-station personnel fully understand technical system use, to include data capture, storage, and extraction.
q. Contact numbers shall be provided by the Contractor if distance troubleshooting is needed.
The Contractor shall comply with all applicable laws and regulations, including, but not limited to, Federal Law(s), State Law(s), Occupational Safety and Health Administration (OSHA) regulations, Navy, and installation regulations.
3. PERIOD OF PERFORMANCE
The period of performance shall be for one (1) 12-month Base Period and One (1), 12-Month, Option Period and One six (6 month extension). The period of performance shall read as follows:

b. When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the proceeding Friday is observed as a legal holiday. This list of holidays relates to Government duty days and is not intended to supplement or otherwise alter the provisions of any Wage Determination regarding applicable paid holidays.
c. It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event the Contractor’s personnel work during the holiday, the Contractor may reimburse them; however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked, unless stipulated otherwise. This provision does not preclude reimbursement for authorized overtime work if applicable.
d. When the Department of Defense grants excused absence to its employees, the Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and shall be guided by the instructions issued by the Contracting Officer (KO) or the Designated Government Representative (DGR). Changes in employee work schedules shall comply with the terms and conditions of the contract, to include payment provisions.
e. If Government personnel are furloughed, the Contractor shall contact the KO or the DGR to receive direction. It is the Government’s decision as to whether the contract price/cost will be affected because of Government shutdown and/or furloughed Government employees. In the event of a Government shutdown or furloughed Government employee(s) impacts contract price/cost, a negotiated settlement will be reached as deemed appropriate by the KO.
3.2 INCLEMENT WEATHER OPERATIONS
The contractor shall perform services as scheduled including during periods of inclement weather unless specific approval to delay is requested by the contractor and approved by the DGR. Such approval will normally be granted only in cases of severe weather, such as hurricanes or tornados, etc. The contractor shall not request additional cost for schedule changes due to inclement weather.
3.3 PLACE OF PERFORMANCE
The work to be completed on-site shall be performed at Naval Air Station (NAS) Kingsville.

3.4 HOURS OF OPERATION
The work to be completed on-site shall be performed during the core business hours of 0700 (7:00AM) through 1700 (5:00PM) Monday thru Friday Central Time (CT) except on Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
4. REQUIREMENTS
Any Bird Strike System shall be set up at a pre-established site on the airfield. A self-contained trailer system is preferred. Every attempt will be made to connect electrically run components of the Bird Strike System to airfield power. The Contractor shall provide Naval Station POC with power requirements within two weeks of contract award. The Contractor shall complete a SECNAV 5512/1 form and provide Naval Station Security Department with all personnel associated with installation or Bird Strike System management at least two weeks prior to delivery and installation. Naval Station security department can be reached at (361) 516-6555. All personnel will be required to comply with Defense Biometric Identification System (DBIDS) to ensure uninterrupted base access. All personnel who require driving on the airfield must attend a one-hour airfield driving course conducted by the Airfield Manager. This must be coordinated in advance by calling (361) 516-4331. Airfield and flight line driving instructions will be provided upon delivery and prior to Bird Strike System setup.
5. TECHNICAL REQUIREMENTS
The Contractor shall provide descriptive literature of the Bird Strike System being proposed and demonstrate that the system meets requirements outlined in the Performance Work Statement.
The Contractor shall implement procedures, maintain equipment, and schedule monitoring procedures adequate to provide performance reporting and timely identification and resolution of all problems that effect proper Bird Strike System operation.
The Contractor shall provide technical assistance on short notice if Bird Strike System degradation is experienced. Due to the criticality of the Bird Strike Data to flight operations, the Contractor shall provide available technical and operations & maintenance support within 2 hours upon notification during normal working hours (0700-1700 M-F) and onsite support within 48 hours of notification Monday through Friday and 72 hours during the weekend and/or holidays for major equipment malfunctions not associated with operator negligence.
6. TYPE OF CONTRACT
The Government will award a Firm Fixed Price Contract.
7. QUALITY CONTROL
Quality Control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality services to the Government in accordance with (IAW) the terms and conditions contained in Federal Acquisition Regulation (FAR) Subpart 52.212-4 entitled, “Contract Terms and Conditions - Commercial Items” and applicable sub-clauses pertaining to quality control.

9. CORRECTIVE ACTIONS
If at any time, it is determined by the KO that the quality control system, personnel, instructions, controls, tests, or records are not providing results that conform to contract requirements, action shall be taken by the Contractor to correct the deficiency. If a Contract Deficiency Report (CDR) is issued, the Contractor shall develop a Corrective Action Plan (CAP) that identifies the root cause, Corrective Action (CA) for the root cause, CA for the specific non-conformance and CA to the root cause to prevent recurrence and a corrective action including the timeline for completion.
10. NAVY COMMERCIAL ACCESS CONTROL SYSTEM (NCACS) STATEMENT
“Commander, Navy Installations Command (CNIC), has established the Navy Commercial Access Control System (NCACS), a standardized process for granting unescorted access privileges to vendors, contractors, suppliers, and service providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seeks access to and can provide justification to enter Navy installations and facilities. Visiting vendors may obtain daily passes directly from the individual Navy Installations by submitting identification credentials for verification and undergoing a criminal screening/background check. Alternatively, if the vendor so chooses, it may voluntarily elect to obtain long-term credentials through enrollment, registration, background vetting, screening, issuance of credentials, and electronic validation of credentials at the vendor’s own cost through a designated independent contractor NCACS service provider. Credentials will be issued every five years and access privileges shall be reviewed/renewed on an annual basis. The costs incurred to obtain Navy Installation access of any kind are not reimbursable, and the price(s) paid for obtaining long-term NCACS credentials will not be approved as a direct cost of this contract.
11. DEFENSE BIOMETRIC IDENTIFICATION SYSTEM (DBIDS)
Defense Biometric Identification System (DBIDS). The Defense Biometric Identification System (DBIDS) is a DoD-owned and operated system developed by Defense Manpower Data Center as a force protection program to manage personnel identity and access at DoD installations. DBIDS is a network database system designed to easily verify access authorization of personnel entering military installations by using barcodes and fingerprint biometric identifications.
To improve management and force protection at Navy installations, the Navy is transitioning from using the Navy Commercial Access Control System (NCACS) to the Defense Biometric Identification System (DBIDS) for Contractors and vendors requiring access to an installation at no cost to them. The transition will begin 17 April 2017 and individuals will have up to 180 days to obtain the permanent card. After August 14, 2017, NCACs cards will no longer be accepted.
In order to obtain base access, an individual needs to acquire DoD sponsorship, have a thorough identity check, be properly vetted, and have a legitimate reason for base access. Identity checks require a passport or a Real ID Act-compliant state driver's license. Vetting occurs when the individual's background and ID are compared against authoritative criminal justice data bases, and the individual has a letter or official document from the sponsoring organization which articulates the reason for access. When the above criteria are satisfactorily met, DBIDs credentials are issued.

12. Contractor Unclassified Access to Federally Controlled Facilities, Sensitive Information, Information Technology (IT) Systems or Protected Health Information (July 2013)
Homeland Security Presidential Directive (HSPD)-12 requires government agencies to develop and implement federal security standards for federal employees and contractors. The Deputy Secretary of Defense Directive-Type Memorandum (DTM) 08-006 – “DoD Implementation of Homeland Security Presidential Directive – 12 (HSPD-12)” dated November 26, 2008 (or its subsequent DoD instruction) directs implementation of HSPD-12. This clause is in accordance with HSPD-12 and its implementing directives.
APPLICABILITY
This clause applies to contractor employees requiring physical access to any area of a federally controlled base, facility or activity and/or requiring access to a DoN or DoD Computer/network/system to perform certain unclassified sensitive duties. This clause also applies to contractor employees who access Privacy Act and Protected Health Information, provide support associated with fiduciary duties, or perform duties that have been identified by N68836-15-P-1119 DON as National Security Position, as advised by the command security manager. It is the responsibility of the responsible security officer of the command/facility where the work is performed to ensure compliance.
Each contractor employee providing services at a Navy Command under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.
ACCESS TO FEDERAL FACILITIES
Per HSPD-12 and implementing guidance, all contractor employees working at a federally controlled base, facility or activity under this clause will require a DoD CAC. When access to a base, facility or activity is required contractor employees shall in-process with the Navy Command’s Security Manager upon arrival to the Navy Command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.
ACCESS TO DOD IT SYSTEMS
In accordance with SECNAV M-5510.30, contractor employees who require access to DoN or DoD networks are categorized as IT-I, IT-II, or IT-III. The IT-II level, defined in detail in SECNAV M-5510.30, includes positions which require access to information protected under the Privacy Act, to include Protected Health Information (PHI). All contractor employees under this contract who require access to Privacy Act protected information are therefore categorized no lower than IT-II. IT Levels are determined by the requiring activity’s Command Information Assurance Manager. Contractor employees requiring privileged, or IT-I level access, (when specified by the terms of the contract) require a Single Scope Background Investigation (SSBI) which is a higher level investigation than the National Agency Check with Law and Credit (NACLC) described below. Due to the privileged system access, a SSBI suitable for High-Risk public trusts positions is required. Individuals who have access to system control, monitoring, or administration functions (e.g. system administrator, database administrator) require training and certification to Information Assurance Technical Level 1 and must be trained and certified on the Operating System or Computing Environment they are required to maintain.
Access to sensitive IT systems is contingent upon a favorably adjudicated background investigation. When access to IT systems is required for performance of the contractor employee’s duties, such employees shall in-process with the Navy Command’s Security Manager and Information Assurance Manager upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual’s performance under the contract. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The decision to authorize access to a government IT system/network is inherently governmental. The contractor supervisor is not authorized to sign the SAAR-N; therefore, the government employee with knowledge of the system/network access required or the COR shall sign the SAAR-N as the “supervisor”.
The SAAR-N shall be forwarded to the Navy Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.
When required to maintain access to required IT systems or networks, the contractor shall ensure that all employees requiring access complete annual Information Assurance (IA) training and maintain a current requisite background investigation. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.
INTERIM ACCESS
The Navy Command's Security Manager may authorize issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results. When the results of the investigation are received and a favorable determination is not made, the contractor employee working on the contract under interim access will be denied access to the computer network and this denial will not relieve the contractor of his/her responsibility to perform.
DENIAL OR TERMINATION OF ACCESS
The potential consequences of any requirement under this clause including denial or termination of physical or system access in no way relieves the contractor from the requirement to execute performance under the contract within the timeframes specified in the contract. Contractors shall plan ahead in processing their employees and subcontractor employees. The contractor shall insert this clause in all subcontracts when the subcontractor is permitted to have unclassified access to a federally controlled facility, federally controlled information system/network and/or to government information, meaning information not authorized for public release.
CONTRACTOR’S SECURITY REPRESENTATIVE
The contractor shall designate an employee to serve as the Contractor’s Security Representative. Within three workdays after contract award, the contractor shall provide to the requiring activity’s Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the Contractor’s Security Representative. The Contractor’s Security Representative shall be the primary point of contact on any security matter. The Contractor’s Security Representative shall not be replaced or removed without prior notice to the Contracting Officer and Command Security Manager.
BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL PROCESS FOR CONTRACTORS ASSIGNED TO NATIONAL SECURITY POSITIONS OR PERFORMING SENSITIVE DUTIES
Navy security policy requires that all positions be given a sensitivity value based on level of risk factors to ensure appropriate protective measures are applied. Navy recognizes contractor employees under this contract as Non-Critical Sensitive [ADP/IT-II] when the contract scope of work requires physical access to a federally controlled base, facility or activity and/or requiring access to a DoD computer/network, to perform unclassified sensitive duties. This designation is also applied to contractor employees who access Privacy Act and Protected Health Information (PHI), provide support associated with fiduciary duties, or perform duties that have been identified by DON as National Security Positions. At a minimum, each contractor employee must be a US citizen and have a favorably completed NACLC to obtain a favorable determination for assignment to a non-critical sensitive or IT-II position. The NACLC consists of a standard NAC and a FBI fingerprint check plus law enforcement checks and credit check. Each contractor employee filling a non-critical sensitive or IT-II position is required to complete:
SF-86 Questionnaire for National Security Positions (or equivalent OPM investigative product) Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission) Original Signed Release Statements
Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date. Background investigations shall be reinitiated as required to ensure investigations remain current (not older than 10 years) throughout the contract performance period. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.
Regardless of their duties or IT access requirements ALL contractor employees shall in-process with the Navy Command’s Security Manager upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual’s performance under the contract. Employees requiring IT access shall also check-in and check-out with the Navy Command’s Information Assurance Manager. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The SAAR-N shall be forwarded to the Navy Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date.
The contractor shall ensure that each contract employee requiring access to IT systems or networks complete annual Information Assurance (IA) training and maintain a current requisite background investigation. Contractor employees shall accurately complete the required investigative forms prior to submission to the Navy Command Security Manager. The Navy Command’s Security Manager will review the submitted documentation for completeness prior to submitting it to the Office of Personnel Management (OPM). Suitability/security issues identified by the Navy may render the contractor employee ineligible for the assignment. An unfavorable determination made by the Navy is final (subject to SF-86 appeal procedures) and such a determination does not relieve the contractor from meeting any contractual obligation under the contract. The Navy Command’s Security Manager will forward the required forms to OPM for processing. Once the investigation is complete, the results will be forwarded by OPM to the DON Central Adjudication Facility (CAF) for a determination.
If the contractor employee already possesses a current favorably adjudicated investigation, the contractor shall submit a Visit Authorization Request (VAR) via the Joint Personnel Adjudication System (JPAS) or a hard copy VAR directly from the contractor’s Security Representative. Although the contractor will take JPAS “Owning” role over the contractor employee, the Navy Command will take JPAS "Servicing" role over the contractor employee during the hiring process and for the duration of assignment under that contract. The contractor shall include the IT Position Category per SECNAV M-5510.30 for each employee designated on a VAR. The VAR requires annual renewal for the duration of the employee’s performance under the contract.
BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL PROCESS FOR CONTRACTORS ASSIGNED TO OR PERFORMING NON-SENSITIVE DUTIES
Contractor employee whose work is unclassified and non-sensitive (e.g., performing certain duties such as lawn maintenance, vendor services, etc. ...) and who require physical access to publicly accessible areas to perform those duties shall meet the following minimum requirements:
Must be either a US citizen or a US permanent resident with a minimum of 3 years legal residency in the United States (as required by The Deputy Secretary of Defense DTM 08-006 or its subsequent DoD instruction) and Must have a favorably completed National Agency Check with Written Inquiries (NACI) including a FBI fingerprint check prior to installation access.
To be considered for a favorable trustworthiness determination, the Contractor’s Security Representative must submit for all employees each of the following:

The contractor shall ensure each individual employee has a current favorably completed National Agency Check with Written Inquiries (NACI) or ensure successful FBI fingerprint results have been gained and investigation has been processed with OPM.

* Consult with your Command Security Manager and Information Assurance Manager for local policy when IT-III (non-sensitive) access is required for non-US citizens outside the United States.
13. PERSONNEL
For purposes of this paragraph, the term “personnel” or “employee(s)” refers to any person performing work related to this contract, including but not limited to, the Contractor’s employees, agents, representatives, or subcontractor. The Contractor shall staff this effort with trained, competent, and capable employee(s) for the discipline they are assigned to. Contractor personnel shall present a clean, neat, and professional appearance. The Contractor shall ensure that employees meet all applicable federal, state, local, and installation certification, licensing, medical requirements, and qualifications to perform all assigned tasks and functions as defined in this contract prior to commencement of work. The Contractor shall not permit any personnel to work under this contract if such person is identified by a Government authorized representative to the Contractor as a potential threat to the health, safety, security, general well-being, or operational mission of the Navy. All Contractor personnel shall comply with installation security and access procedures and the Contractor’s final Safety Plan.
13.1 AUTHORIZATION TO WORK
Contractor’s personnel shall either be a United States Citizen or authorized to work in the United States or possess a valid U.S. Immigration T-151 or I-94, Alien Registration Card. If Contractor person is not a US Citizen, they must submit a foreign national visit request through the State Department and their embassy. This process can take up to 60 days.
13.2 SPEAKING, READING, AND UNDERSTANDING ENGLISH
Contractor shall hire and staff personnel who can communicate with Government representatives and where reading, understanding, and discussing environmental, health, and safety warnings are an integral part of an employee’s duties. Contractor’s employee shall be able to understand, read, write, and speak the English language fluently. English shall be the only language used regarding this contract for written correspondence, discussions and other business transactions.
13.3 IDENTIFICATION (ID) BADGE
The Contractor (to include subcontractors) shall provide each employee an Identification (ID) Badge, which includes at a minimum, the Company Name, Employee Name, and a color photo of the employee. ID Badges shall be always worn during which the employee is performing work under this contract. Each Contractor (to include subcontractors) employee shall wear the ID Badge in a conspicuous place on the front of exterior clothing and above the waist except when safety or health reasons prohibit. The Contractor (to include subcontractors) shall be responsible for collection of ID Badges upon completion of the contract or termination of employee. A listing of issued identification cards shall be furnished to the KO prior to the contract performance date and updated as needed to reflect Contractor and subcontractor personnel changes.
13.4 NON-PERSONAL SERVICE STATEMENT
Contractor management will ensure that employees properly comply with the performance work standards outlined in this performance work statement. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in this project may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
13.5 PERSONNEL COMPLIANCE
The contractor shall ensure that contractor employees observe and comply with all local and higher authority policies, regulations, and procedures concerning fire, safety, environmental protection, sanitation, security, traffic, parking, energy conservation, flag courtesy, “off -limits” areas, and possession of firearms or other lethal weapons. When two or more directives or instructions apply, the Contractor shall comply with the more stringent of the directives or instructions.
13.6 SMOKING/DRUG/ALCOHOL POLICY
The contractor shall comply with local command smoking policies and workforce requirements. The contractor shall also comply with all Federal statues, laws, and regulations to implement a Drug Free Workplace Program (DFWP) as well as work force requirements and local command policies.
13.7 PERSONNEL CONDUCT
The selection, assignment, reassignment, transfer, supervision, management, and control of contractor personnel employed to perform the work specified herein shall be the responsibility of the contractor. The contractor shall be responsible for the performance and conduct of contractor and subcontractor employees at all times. The contractor shall ensure that personnel present a professional appearance. Personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the installation shall abide by the security regulations listed in the contract and shall be subject to such checks by the Government as deemed necessary. The contractor shall not employ for performance under this contract any person whose employment would result in a conflict of interest with the Government’s standards of conduct.
13.8 CONTRACTOR ADVERTISING
The Contractor shall not place or display advertising of any kind on Government property.
13.9 SUPERVISION OF CONTRACTOR EMPLOYEES
The Government will not exercise any supervision or control over Contractor or Subcontractor employees while performing work under the contract. Such employees shall be accountable solely to the Contractor, not the Government. The Contractor, in turn, shall be accountable to the Government for Contractor or Subcontractor employees.
13.10 PERSONNEL REMOVAL
Government rules, regulations, laws, directives, and requirements that are issued during the term of the performance period relating to law and order, installation administration, and security shall be applicable to all contractor employees and representatives who enter the installation. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site or installation. Removal of employees does not relieve the contractor from the responsibility for the work defined in this performance work statement. The contractor is expected to provide support services despite personnel removal or other unforeseen condition(s). Should replacement become necessary, the government reserves the right to review all resumes of proposed candidates.
• Removal by Installation Commander: The Installation Commander may, at his/her discretion, bar an individual from the installation under the authority of 18 U.S.C. 1382 (1972), for conduct that is determined to be contrary to good order, discipline, or installation security and safety.
• Removal Requested by Designated Government Representative (DGR): The DGR may require the contractor to remove am employee working under this contract for reasons of misconduct or security violations. Contractor employees shall be subject to dismissal from the premises upon determination by the DGR that such action is necessary in the interest of the Government.
• Removal by Military Police: Contractor employees may be denied entry to or may be removed from the installation by Military Police if it is determined that the employee’s presences on the installation may be contrary to good order, discipline, or installation security and safety.
• Removal for Unsatisfactory Performance: The government reserves the right to require the Contractor to remove and replace any personnel who provide unsatisfactory performance, demonstrate insufficient knowledge, or possess inadequate skill levels necessary to complete assigned tasks. The skill level of the staff provided shall be current and consistent with new technologies.
14. INTERACTION WITH OTHER ACTIVITIES
Government and contractor personnel will be working in common areas during working hours. Contractor performance shall not interfere with Government work in the area where any service or maintenance work is being performed. In the event the contractor believes that Government and other contractor personnel are interfering with the performance of the tasks described in this PWS, the contractor shall notify the Designated Government Representative immediately. The contractor is obligated to continue performance of the effort described in this contract unless there is authorization from the KO or Designated Government Representative to stop work. Failure by the contractor to notify the Designated Government Representative and receive necessary instructions could result in denial of any additional costs incurred in performance of the contract under such conditions. Other Government contractor’s may be performing required services in areas that interrelate with the requirements of this contract. The Government will facilitate initial contact between contractor’s performing other contracts and this contract. The contractor shall provide all further required coordination between other contractors for any task specified in this contract that relates to or impacts on any other contracted work.
15. SAFETY
The Contractor is solely responsible for compliance of all safety regulations of employees while working on government owned facilities. All accidents which may arise out of, or in connection with, performance of services required herein which result in injury, death, or property damage, shall be reported in writing to the Contracting Officer and Designated Government Representative within twenty-four hours of such occurrence. Reports shall provide full details of the accident, including statements from witnesses. The fore-going procedures shall also apply to any claim made by a third party against the contractor because of any accident that occurs in connection with performance under this contract.

Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
