J&A No. 19-014

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

(a) Requiring Activity: Trident Refit Facility (TRF)

Naval Submarine Base Kings Bay

Kings Bay, GA 31547

(b) Contracting Activity: NAVSUP Fleet Logistics Center Jacksonville (FLCJ)

Regional Contracting Department

Jacksonville, FL 32212

2. Description of the Action Being Approved

This Justification and Approval (J&A) authorizes issuance of a firm-fixed price purchase order on a sole source basis to Ducommun Labarge Technologies (DLT) to procure three (3) types of Sub-Assemblies and components for the development of a Naval Sea Systems Command (NAVSEA) repair procedure/process for a Virginia class and an Ohio-Class Guided-Missile Submarines (SSGN) Photonics

Mast legacy dip loops. Currently, all Radio Frequency (RF) cable repairs are performed at/by the Original

Equipment Manufacturer (OEM), Ducommun Labarge Technologies (DLT). NAVSEA has a need to develop an internal (Navy) repair process to reduce total ownership and repair costs, as this extension of

Virginia/SSGN Photonics Mast legacy dip loops usage by the fleet, which was not originally projected through 2030, is now a reality. Trident Refit Facility (TRF) in Kings Bay, Georgia will be using the requested three (3) different Sub-Assembly components and on-site damaged Photonics Mast legacy dip loops to conduct the proof of concept and procedure development for on-site repair(s). The Photonics

Mast legacy dip loop assembly is comprised of seven (7) specialized molded cables with the three (3)

Sub-Assemblies requested having the most failures out of the seven (7) cables. By using the Sub-

Assemblies, a repair process can be verified to remove the bad portions of the cables and re-mold the cable in house to make a like new Photonics Mast legacy dip loop cable assembly.

3. Description of Supplies/Services

The proposed procurement action will be one-time purchase order to provide the following Sub-

Assemblies and components to develop a NAVSEA repair procedure/process, with proofing, for the

Virginia class and SSGN class submarines’ Photonics Mast legacy dip loops.

The estimated cost for this acquisition is $565,879.38. Fiscal Year 2019 (FY19), Other Procurement Navy

(OPN), funding is provided on PR N4446619RC087JX through NAVSEA for this procurement action.

The anticipated delivery date for this acquisition is 34 weeks after contract award.

4. Statutory Authority Permitting Other Than Full and Open Competition

The Statutory authority permitting an Other than Full and Open Competition for this requirement is 41

U.S.C. 1901(e)(2), Special Rules for Commercial Items. This sole source acquisition will be implemented by Federal Acquisition Regulation (FAR) 13.501(a), Sole Source Acquisitions.

5. Rationale Justifying Use of Cited Statutory Authority

Pursuant to FAR 13.501(a), DLT is the only entity capable of providing the supplies described above. The cables and sub-assembly components are highly specialized in functionality; built to specification drawings that are owned by the OEM, DLT. All Virginia Class Photonics Mast legacy dip loops and

SSGN Photonics Mast legacy dip loops have been manufactured by DLT. The OEM pursuant to Military

Specification MIL-DLT-31000, Technical data package, developed the Photonics Mast legacy dip loop drawings. The technical development and manufacturing processes of both these items were performed by

DLT during development of the Photonics Mast Program and, as such, DLT controls the drawings and manufacturing procedures for the Photonics Mast legacy dip loops. These drawings and processes are required to manufacture sub-assemblies and the full assemblies of the Virginia and SSGN Photonics Mast legacy dip loops, therefore, all procurements pertaining to Photonics Mast legacy dip loops and Photonic

Mast legacy dip loop materials must go through DLT as they have full proprietary rights and they are not releasing it to any vendor. The sub-assemblies will be used to repair the existing equipment and begin the in house development of approved repair procedures.

It is imperative the proposed action is awarded in order to support the requirement to continue the use of the legacy dip loops through 2030. Failure in accomplishing this task will affect deployment schedules/missions of the Virginia/SSGN submarines.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

This action was synopsized as a Sources Sought Notice (SSN) in the Federal Business Opportunities

(FBO) website on Saturday, 10 August 2019 and closed on Wednesday, 14 August 2019; to determine if there were no other vendors capable of providing these supplies. No other potential sources expressed an interest in the requirement.

Market research was conducted by the Contract Specialist through discussions with the requiring activity, searches of previous acquisitions for the same or similar items through Electronic Data Access (EDA) and the Federal Procurement Data System- Nest Generation (FPDS-NG), and online searches of the sub-assemblies. DLT was the only provider of the required sub-assemblies and components. There are no other vendors or authorized distributors who are capable of providing these sub-assemblies for the Dip

Loops.

7. Determination of Fair and Reasonable Cost

The Contract Specialist will perform analysis of the Contractor’s quote with the assistance of the Cost

Price Analyst to determine if the price is fair and reasonable pursuant to FAR 13.106-3, Award and documentation.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraphs 5 and 6, FLCJ has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, FLCJ will assess whether competition for future requirements is feasible.
