QUESTION AND ANWERS
Question 1: On page 22 section 7.a, the solicitation allows the Government to use an alternate source for the assembly of crates. The solicitation provides, at page 29, ¶ 13, that the contractor will be responsible for claims for Full Replacement Value of up to $50,000.
a. If the Government uses or directs use of an alternative source, will the contractor be relieved of the Full Replacement Value Liability of $50,000 per shipment?
Answer 1a: If the Government uses an alternate source for assembly of crates, the source would be qualified and required to assemble IAW published guidelines. Utilizing an alternate source to assemble would not alleviate the DPM contractor from FRV shipment liability.
b. If not, will the Government permit the successful bidder to decline to utilize crates that the contractor reasonably determines don’t meet the standards established in Pamphlet 55-12?
Answer 1b: If the DPM contractor has concerns about the integrity of the assembly of a container, they can raise their concerns to the government for evaluation and decision at the time of occurrence. The DPM contractor cannot decline to use the containers without Government approval.
Question 2: This question refers to the solicitation language at page 19(included in all DPM solicitations and contracts) that requires the Contractor to “perform all preparation and packing in a manner requiring the least cubic measurement, producing packages that withstand normal movement without damage to the container or contents and at a minimum of weight”; and the language at p.25 that restricts the use of overflow containers (“The overflow container … shall be limited to one per shipment and shall not exceed 50 cube unless approved prior to its use by the Ordering Office/COR .”) There are many foreseeable situations in which compliance with the restrictions placed on the use of overflow containers on page 25 will conflict with the quoted instruction from page
19. For example, in packing a shipment containing one or more small motorcycles or mopeds, use of more than one overflow container could be necessary in order to prepare and pack “packing in a manner requiring the least cubic measurement, producing packages that withstand normal movement without damage to the container or contents and at a minimum of weight”.
a. Please advise what standards the contracting officer will be obligated to apply when considering contractor requests.
Answer 2a: The standards used by the government when evaluating the need for an overflow container are established in part 1.A.7.a.2.a. f. 8-9 of the PWS. Please note that items like motorcycles and sofas are not considered overflow. Those items are not necessarily restricted to one per shipment. However use of an overflow container is restricted to one per shipment.
b. Will the Government consider removing the restriction on use of overflow containers, and permit the contractor to use overflow containers as the contractor deems necessary to comply with the PWS requirements?
Answer 2 b: No. The use of overflow containers is restricted to one container per shipment in accordance with Part 1.A.7.a.2.a.f.8 of the PWS.
c. If not, please advise whether the language at page 19, or the language at p. 25, controls in the event of a conflict?
Answer 2c: When dealing with overflow and oversized items, the PWS language on page 25 of the solicitation establishes procedures. For all property in a DPM shipment that doesn't fall under those two categories, page 19 applies.
d. Please advise if contractors will be automatically relieved of Full Replacement Value Liability of $50,000 per shipment for damage occurring whenever the contractor is not granted permission to use multiple overflow containers on a given shipment.
Answer 2d: The DPM contractor would not be relieved of liability.
e. If so, what procedures must they follow in order to avoid Full Replacement Value Liability?
Answer 2e: The rules regarding FRV liability and instances where liability can be mitigated are outlined in the DTR Part IV Appendix G6.
Question 3: Why does the solicitation omit CLINS for Outbound HHGs Drayage Included? If provided is this service to be invoiced under the Additional Services Line Item?
Answer 3: See bid schedule item 0001 description included in the solicitation. The description states that the rate is inclusive of "drayage of the container within an area of performance."
Question 4: The solicitation lists the maximum daily requirement for schedules I and II as 150 NCWT. Does a 150 NCWT shipment booked under schedule 1 and scheduled for three days meet the maximum daily requirement?
Answer 4: In this example, a 150 NCWT shipment scheduled for 3 days would be annotated as 50 NCWT on tonnage per day. The Joint Personal Property Shipping Office (JPPSO) tracks tonnage scheduled using this method.
Question 5: On Page 25 under the heading of overflow containers, the solicitation seems to indicate that full size containers must be utilized even when the shipment will only occupy 70% of the containers cubic capacity. This contradicts the PWS requirement for the contractor to achieve the best density possible.
a. If this is correct will the government provide dunnage material to fill the remaining 30% void?
Answer 5a: Overflow containers are non-standard sized containers built specifically to accommodate excess property that wouldn't otherwise fit into a standard shipping container. Since the containers are specifically built for overflow items, density standards are met without excessive dunnage.
b. If the contractor is to provide this material should it be invoiced under the Additional Services Line Item?
Answer 5b: N/A. See A.
Question 6: Please explain what information is being requested from offerors on pages 3-13 of the solicitation?
Many of the line items, supplies/services don’t match the contract schedules found farther on in the solicitation.
Answer 6: FAR 52.212-1 Addendum, Instructions to Offerors has been revised to include updated instructions.
Offerors shall include recapitulation prices for each schedule area from the bid schedule to the corresponding CLIN on the DD 1449.
Question 7: Is the estimated quantity given for Item 0031 the government’s intent or an error?
Answer 7: This is the Government best estimate based on known data.
Question 8: Under Schedule III Item 0031 is titled Complete Service Inbound (HHGs). Shouldn’t there also be a CLIN for Outbound (HHGs)? If not should the origin services provided prior to delivery under Item 0031 be invoiced under the Additional Services Line Item?
Answer 8: This is a typo. Schedule III Item 0031 should be titled Complete Service for Intra-City and Intra-Area Moves. Therefore there are no specific origin or destination charges.
Question 9: Item 004AA is for Government Furnished Containers Drayage Included.
a. What are the dimensions for the Government provided containers? Will the containers be large enough to allow the contractor to inter-pack the items being shipped? If not will the contractor be relieved of liability for damage claims?
Answer 9a: Item 0004AA under the bid schedule was changed to N/A. The Government does not furnish UB containers.
b. What is the bursting strength of the Government provided Containers? Will the containers be made of wood or fiberboard? If fiberboard will the containers be double or triple wall containers?
Answer 9b: N/A. See a.
c. Will the Government-provided containers adhere to the standards established in the solicitation? If the Government provided containers do not meet the standards established in the solicitation, will the contractor be relieved of liability for damage claims?
Answer 9c: N/A. See a.
Question 10: With regard to Line 0011. Will all costs for a new crate be taken into consideration?
Answer 10: Costs will be considered as outlined in the description of bid schedule item 0011AB.
Question 11: Since the RFQ was unrestricted, why wasn’t the FAR 52-219-4 Notice of Price Evaluation Preference for HUBZone small business concerns added to the clauses of the contract?
Answer 11: This is 100% small business set-aside. See amendment 00002.
Question 12: Do the estimate annual quantities represent the latest actual quantities per Item? If not, what are the historical quantities under the current contract per item?
Answer 12: This is the Government best estimate based on known data.
Question 13: Will the incumbent’s equipment be available to the successor contractor?
Answer 13: It is the responsibility of the successful offeror to provide all equipment necessary to accomplish services outline in the PWS. Please refer to the minimum recommended equipment list described on page 32, General Specifications, of the solicitation. The Government does not facilitate equipment sales/ arrangements with previous contractors.
252.204-7011 ALTERNATIVE LINE-ITEM STRUCTURE (SEP 2011)
(a) Line items are the basic structural elements in a solicitation or contract that provide for the organization of contract requirements to facilitate pricing, delivery, inspection, acceptance and payment. Line items are organized into contract line items, subline items, and exhibit line items. Separate line items should be established to account for separate pricing, identification (see section 211.274 of the Defense Federal
Acquisition Regulation Supplement), deliveries, or funding. The Government recognizes that the line item structure in this solicitation may not conform to every offeror's practices. Failure to correct these issues can result in difficulties in accounting for deliveries and processing payments. Therefore, offerors are invited to propose an alternative line item structure for items on which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract structure is economically and administratively advantageous to the Government and the Contractor.
(b) If an alternative line item structure is proposed, the structure must be consistent with subpart 204.71 of the
Defense Federal Acquisition Regulation Supplement and PGI 204.71. A sample solicitation line-item structure and a corresponding offer of a proposed alternative line-item structure follow.
