Note: Charts, graphs, and tables will not count towards the maximum page limitations. Electronic copies shall be submitted on CDROM in a format compatible with Microsoft Office products.

The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer, conforming to the solicitation, will be most advantageous to the Government with price and other factors considered.

The Government reserves the right to judge which proposals show the required capability. The lowest price technically acceptable source selection process will be utilized. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

The Government also reserves the right to eliminate from further consideration those proposals which are considered unacceptable and not capable of being made acceptable without a major rewrite or revision.

The Government may award a contract on the basis of initial offers received without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, if considered necessary by the Procuring Contracting Officer and approved by the Source Selection Authority, discussions will be conducted. The failure of an offeror’s proposal to address any given requirement of the RFP may result in the entire proposal to be found unacceptable and thus eliminated from the competition.

VOLUME I TAB 1: TECHNICAL CAPABILITY (15 Pages Maximum)

Technical Capability/Management Plan- Offerors shall demonstrate an understanding of the solicitation requirements by describing in detail, their approach and plan to perform and manage the work specifically required by the Performance Work Statement (PWS). The technical approach must identify the methodology and analytical techniques the offeror will use to fulfill the PWS requirements; including a specific management plan.

The technical proposal will be evaluated first. An unacceptable rating will render the entire technical proposal unacceptable and render the offer ineligible for award unless discussions are held and an opportunity is afforded the offeror to submit a revised technical proposal. Only a technically acceptable offeror may receive award.

VOLUME I TAB II PAST PERFORMANCE (10 Pages Maximum)

Past Performance

Past performance information considered by the Government for the offeror's performance as a prime Contractor and/or subcontractor and the performance of its key management personnel may include the following areas: Quality of products or services, Cost Control, Timeliness, Business Relationships, Customer Satisfaction and Key Personnel.

In their proposals, offerors shall include reference information as indicated in the Contractor Performance Data Sheet (Attachment 1). Offerors shall provide information on three (3) previous Government contracts whose effort was relevant to the effort required by this solicitation; the contracts provided shall have been performed within the last 3 years from the issue date of the solicitation (including contract numbers, points of contact with telephone numbers and other relevant information). If the offeror has not had 3 Government contracts within the last 3 years, information on relevant subcontracts and/or commercial contracts may be submitted instead (the information must be clear whether the work by the offeror was done as a prime contractor or a subcontractor). Offerors who describe similar contracts and subcontracts shall provide a detailed explanation demonstrating the similarity of the contracts to the requirements of the RFP. For each of the three contracts provided as a reference, the offeror shall provide all of the information specified.

In addition to the information requested above, offerors shall send a Past Performance Evaluation Survey (Attachment 2) to each reference it lists on their past performance data sheet. This survey will be filled out by the offeror’s references and submitted directly to the Contracting Officer. The Government may consider questionnaires received after the due date of the solicitation. The Government reserves the right to contact references for verification or additional information. .

The Government may verify past performance information. The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews and existing data sources to include but not limited to Contractor Performance Assessment Reporting System (CPARS) and DOD Past Performance Automated Information System (DODP AIS). The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. This past performance information will be used for the evaluation of past performance. The Government does not assume the duty to search for data to cure the problems it finds in the information provided by the offeror. The burden of providing thorough and complete past performance information remains with the offeror.

VOLUME II RFP AND PRICE PROPOSAL

This volume shall include the signed SF1149 with all pricing information filled out and all representations and certifications filled in. When filling out the pricing information on the line items, be sure to include the unit price and the extended price (total price for the period of performance).

This volume shall also include signed copies of any and all amendments to the solicitation.

Offerors are hereby notified FAR Part 22.1008-2, Section 4 (c) Successorship with Incumbent Contractor Collective Bargaining Agreement, applies to this procurement. A copy of the current Collective Bargaining Agreement (CBA) is provided at Attachment 11.

Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. BASIS OF AWARD: LOWEST PRICED TECHNICAL ACCEPTABLE OFFEROR

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

Award Consideration

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government with price and other factors considered.

Note: Failure to furnish a complete Request for Proposal package may render your offer/proposal unacceptable.

(b). The following factors shall be used to evaluate offers:

(i) Technical capability of the service offered to meet the Government requirement

(ii) Past performance

(iii) Price

Proposal Submittal Requirements:

TECHNICAL CAPABILITY

Technical Capability - The Contractor shall describe their technical capabilities and approach in meeting the requirements set forth in the Performance Work Statement (PWS). Further, technical capability and approach will be determined solely on the content and merit of the information submitted in response to the RFQ. Therefore, it is incumbent on the interested party to provide sufficient technical documentation in order for the Government to make an adequate assessment of the Contractor’s technical capabilities and approach. The Contractor’s technical capabilities and approach must indicate the ability to meet or exceed all the specifications listed in the Performance Work Statement. The Contractor shall describe the qualifications and expertise of the firm with regard to the types of services required in the PWS. Contractor shall provide information that leaves little doubt to the Government that the Contractor has the expertise and personnel to provide uninterrupted service during the period of performance of this contract.

The following adjectival ratings apply to Technical Capabilities and Approach:

Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

PAST PERFORMANCE

Past performance information considered by the Government for the offeror's performance as a prime Contractor and/or subcontractor may include the following areas: Quality of products or services, timeliness of deliveries, Business Relationships, and Customer Satisfaction.

In their proposals, offerors shall include reference information as indicated in the Contractor Performance Data Sheet (Attachment 9).

In addition to the information requested above, offerors shall send a Past Performance Evaluation Survey (Attachment 8) to each reference it lists on their past performance data sheet.

The following adjectival ratings will apply as set forth below.

Acceptable

Past Performance: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Past Performance: Based on the offeror’s performance record, the Government has a no reasonable expectation that the offeror will successfully perform the required effort.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can reasonably be assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable."

Price Evaluation Factor:

The offeror will submit a price proposal which represents the most cost effective arrangement to fulfill all of the requirements in the Performance Work Statement.

The price proposal will be evaluated based on the total overall cost to the Government for the base period and the four option years.

Price evaluation: The Government will add base period and all option periods for determining lowest overall total evaluated price.

(b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Award Consideration

The lowest price technically acceptable source selection process will be utilized. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

The Government also reserves the right to eliminate from further consideration those proposals which are considered unacceptable and not capable of being made acceptable without a major rewrite or revision.
