PBSOW/CDRL Reference RFP Reference Question Governments Reponse N/A Section B Notes, Pages 74 and 75 Specifically FAR 32.703-2 states:

(c) Acceptance of supplies or services. The Government shall not accept supplies or services under a contract conditioned upon the availability of funds until the contracting officer has given the contractor notice, to be confirmed in writing, that funds are available.

With reference to the Government's response pertaining to the availability of funds concern, it is understood that the Government will monitor adjustments on an annual basis.

Given the statement in B-1 Demand Band Adjustment for Repairable paragraph states, "All pricing adjustments are subject to the availability of funding", how will the Government ensure funding would be available should a surge situation occur? How can the contractor be assured that this is a cost that would be covered should surge situations arise? Put another way, once the Government has consumed the maximum allowable demands (by month/or year), will the PCO issue a letter confirming availability of funds to pay a subsequent claim for surge since it cannot accept services conditioned on the availability of funds without confirming funds are available?

The process for availability of funds and surge requirements w will be discussed after contract award.
