SITE VISIT: A site visit is NOT mandatory for contract award but is encouraged. If the offeror attends a site visit, it will be at their own expense. The Government will not compensate or be responsible for any costs associated with the optional site visit.

Site visitation will be conducted on December 8th, 2020 and start at 10:00 am. Visits may be arranged with the Contracting Officer Representative. BASIS FOR AWARD:

The Government will award a contract resulting from this solicitation to the responsible offeror whose quote is technically acceptable, in full compliance to all other requirements set forth in the solicitation, and the lowest price. Award will be made on the basis of the lowest evaluated price of quotes meeting the technical standards in the sow and project delivery schedule. Past performance will be included in the responsibility determination. All proposals will be evaluated for compliance with the terms, conditions, and requirements set forth in the solicitation. With submission of quote, provide three (3) references for performance and two

(2) financial references. Each reference must include the name and phone number of the person to contact.

The Contractor shall complete and submit the following information in reference to the RFQ:

a. Complete Standard Form 1442, “REQUEST FOR QUOTATIONS” blocks 14-20.

b. Provide Pricing for CLINs 0001 through 0004 located in Section 001000

c. Complete all Representations and Certifications located in Section 004500

d. Acknowledge all amendments (if applicable)

e. The contractor shall register in System for Award Management (SAM) or be migrated into SAM from the Central Contractor Registration (CCR) database in order to be eligible for award. SAM means the primary Government repository for prospective federal awardee information and the centralized Government system for certain contracting, grants, and other assistance related processes.

QUESTIONS AND ANSWERS

1. Will contractors be required to furnish as-built drawings for this effort?

See the Statement of Work (SOW) paragraph 2.1.

2. Is it required that concrete surfaces be finished with epoxy?

No. Exposed concrete is acceptable.

3. Will the contractor be responsible for performing soil testing?

No, soil testing has already been done by the government to determine the soil strength/bearing capacity.

Noted changes to the foundation drawings made by this testing can be found in the statement of work.

4. Will the contractor be responsible for performing a “break test” of or otherwise testing the completed foundation?

No.

5. Will the contractor be responsible for protecting existing machinery from dust and debris?

The contractor will be expected to inform the Government at least 24 hours before conducting demolition work to allow the Government to adequately protect the surrounding equipment.

6. What are the Government’s expectations regarding ventilation for gas-powered equipment exhaust?

Due to the large and open work site, most small or handheld equipment may be exhausted within the hangars. The site’s safety officer may require larger equipment to be exhausted outside.

7. How will contractors bring concrete and equipment to the work site?

Contractors may utilize rolling doors located in the rear of the hangars. Any item must fit through both the rolling doors and down the aisle. The door’s dimensions are as follows: 14 feet wide and 17 feet tall. The aisle dimensions are as follows: 10 feet wide.

8. Where can contractors park relative to the work site?

Parking will be available behind the hangars.

9. May the contractor store equipment at the site during performance?

Yes. The Government will zone off a 25’x25’ area in the parking lot behind the building for the storage of equipment. The contractor will maintain all responsibility for its own equipment.

10. Who will provide anchor bolts?

See the SOW paragraph 2.2.

11. At what hours may demolition work be performed?

See the SOW paragraph 2.6.

12. Do prevailing wage rates apply?

See the RFQ Section 01 00 00 – General Requirements.

13. Due to varying thickness of the existing foundation, is the preference that the new pad line up perfectly with the existing floor, or that the pad itself be perfectly level?

The Government’s priority is that any new pad be perfectly level, even if it does not line up evenly with the existing floor.

14. Will the Government clear the work spaces prior to work taking place?

Yes. In general, the Government will clear the work sites of pallets, machines, and all other potential obstructions that can be feasibly removed.

15. What environmental regulations must the contractor comply with?

The contractor will be responsible for complying with all pertinent local, state, and Federal environmental regulations.

16. What bolts will be required?

Contractors must use the bolts specified by the equipment vendor.

17. Who will be responsible for the removal of excess soil, concrete, etc., and the associated costs?

See the SOW paragraph 2.5.

18. Who will be responsible for rerouting or removing existing wires, utilities, or structures necessary to perform the work?

The contractor will be responsible for notifying the Government of any existing wires, utilities, or structures impeding work. The Government will be responsible for rerouting or removing these items subsequent to contractor notification.

19. What form of reinforcement will be required?

See SOW paragraph 2.2 for site-specific reinforcement requirements

20. What form of warranty will be required?

See SOW paragraph 2.1

21. In regards to the Utility Trench required for Site B (70' L x 2' W), please provide details. Is this a concrete trench with a cover? Is this an earth trench with a sand bed?

See SOW paragraph 2.2 under Site B. The trench will be made out of concrete and will be designed to have a cover. The cover will be provided by the government.

22. Appendix ”B” drawing 10-5R5-720-007-3-TS shows concrete pillars “ (used especially when ground is weak)”. As per the discussion at the walkthrough the contractor is to exclude the pillars. If they are required based upon soil conditions, that work will be a change order. Please confirm.

See SOW paragraph 2.2 under Site B.

23. The foundation drawings do not show steel reinforcement details for any of the (4) locations. Please provide details or otherwise clarify so that all bidders include same amount of rebar work in their bid.

See SOW paragraph 2.2 for site details. All sites must have rebar reinforced concrete and achieve desired concrete pad strength.

24. As per NJDEP requirements spoil fill material from construction excavations is to remain on site. If soils are to be transported offsite, they must be sampled for contamination as per NJDEP requirements. Is the bidder to include this sampling in its bid or is the owner to conduct soil sampling prior to transportation and disposal of excess material generated If a new soil test is required for transportation, then the testing will fall under the responsibility of the vendor.

25. Are soil borings samples and testing required for existing sub-base?

No, testing has already been done for soil strength.

26. Do you require the contractor to provide structural drawings and calculations stamped by an engineer?

See SOW paragraph 2.1. Drawings do not need to be stamped by an engineer.

27. During the site visit there were discussions about adding ADD/ALTERNATES and options to the bid schedule. Can you clarify or provide the new bid schedule so all contractors are pricing uniformly?

All changes discussed during site visit are now posed as questions that can be seen online for everyone and clarifications have been made in the SOW to address what is required.

28. Since we were not allowed to take pictures during the site visit, can you provide a few pictures of the four work areas?

No, we are unable to upload pictures of the facilities for this effort at the time.

29. If we were to use a concrete pump truck, what is the maximum height we are allowed to reach?

The doorway entrance to the buildings in which the work is being done is 14 feet wide by 17 feet tall.

30. After Gov't personnel install the conduits in the 70' x 2' trench we are digging, is the contractor providing any kind of backfill? Can you provide a trench detail?

See SOW paragraph 2.2 under Site B for trench details.

31. Can you provide anchor bolt plans for each machine foundation?

Information on anchor bolts is included in drawings.

32. Can you provide the dimensions and depth of the new machine foundations?

Information on foundation dimensions is included in drawings.

33. Can you provide specifications on the concrete mix?

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination.

The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

52.225-13 RESTRICTION ON CERTAIN FOREIGN PURCHASES (JUN 2008)

(a) Except as authorized by the Office of Foreign Assets Control (OFAC) in the Department of the Treasury, the Contractor shall not acquire, for use in the performance of this contract, any supplies or services if any proclamation, Executive order, or statute administered by OFAC, or if OFAC’s implementing regulations at 31 CFR chapter V, would prohibit such a transaction by a person subject to the jurisdiction of the United States.

(b) Except as authorized by OFAC, most transactions involving Cuba, Iran, and Sudan are prohibited, as are most imports from Burma or North Korea, into the United States or its outlying areas. Lists of entities and individuals subject to economic sanctions are included in OFAC’s List of Specially designated Nationals and Blocked Persons at http://www.treas.gov/offices/enforcement/ofac/sdn/. More information about these restrictions, as well as updates, is available in the OFAC’s regulations at 31 CFR chapter V and/or on OFAC’s website at http://www.treas.gov/offices/enforcement/ofac .

52.225-25 PROHIBITION ON CONTRACTING WITH ENTITIES ENGAGING IN CERTAIN ACTIVITIES OR

TRANSACTIONS RELATING TO IRAN--REPRESENTATION AND CERTIFICATIONS. (JUN 2020)

(a) Definitions. As used in this provision--

Person--

(1) Means--

(i) A natural person;

(ii) A corporation, business association, partnership, society, trust, financial institution, insurer, underwriter, guarantor, and any other business organization, any other nongovernmental entity, organization, or group, and any governmental entity operating as a business enterprise; and

(iii) Any successor to any entity described in paragraph (1)(ii) of this definition; and

(2) Does not include a government or governmental entity that is not operating as a business enterprise.

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

(b) The offeror shall email questions concerning sensitive technology to the Department of State at CISADA106@state.gov.

(c) Except as provided in paragraph (d) of this provision or if a waiver has been granted in accordance with Federal Acquisition Regulation (FAR) 25.703-4, by submission of its offer, the offeror—

(1) Represents, to the best of its knowledge and belief, that the offeror does not export any sensitive technology to the government of Iran or any entities or individuals owned or controlled by, or acting on behalf or at the direction of, the government of Iran;

(2) Certifies that the offeror, or any person owned or controlled by the offeror, does not engage in any activities for which sanctions may be imposed under section 5 of the Iran Sanctions Act. These sanctioned activities are in the areas of development of the petroleum resources of Iran, production of refined petroleum products in Iran, sale and provision of refined petroleum products to Iran, and contributing to Iran's ability to acquire or develop certain weapons or technologies; and

(3) Certifies that the offeror, and any person owned or controlled by the offeror, does not knowingly engage in any transaction that exceeds the threshold at FAR 25.703-2(a)(2) with Iran's Revolutionary Guard Corps or any of its officials, agents, or affiliates, the property and interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (see OFAC's Specially Designated Nationals and Blocked Persons List at https://www.treasury.gov/resource-center/sanctions/SDN- List/Pages/default.aspx).

(d) Exception for trade agreements. The representation requirement of paragraph (c)(1) and the certification requirements of paragraphs (c)(2) and (c)(3) of this provision do not apply if—

(1) This solicitation includes a trade agreements notice or certification (e.g., 52.225-4, 52.225-6, 52.225-12, 52.225- 24, or comparable agency provision); and

SYSTEM IN PAST PERFORMANCE EVALUATIONS (SEP 2019)

(a) The Supplier Performance Risk System (SPSR) application (https://www.sprs.csd.disa.mil) will be used in the evaluation of suppliers' past performance in accordance with DFARS 213.106-2(b)(i).

(b) SPRS collects quality and delivery data on previously awarded contracts and orders from existing Department of Defense reporting systems to classify each supplier's performance history by Federal supply class (FSC) and product or service code (PSC). The SPRS application provides the contracting officer quantifiable past performance information regarding a supplier's quality and delivery performance for the FSC and PSC of the supplies being purchased.

(c) The quality and delivery classifications identified for a supplier in SPRS will be used by the contracting officer to evaluate a supplier's past performance in conjunction with the supplier's references (if requested) and other provisions of this solicitation under the past performance evaluation factor. The Government reserves the right to award to the supplier whose quotation or offer represents the best value to the Government.
