About this file
This document is a justification and approval for using other than full and open competition to award a sole source contract. The Naval Air Warfare Center Aircraft Division will procure peculiar support equipment from The Boeing Company to support depot-level maintenance and repair of vertical stabilizers for F/A-18E/F aircraft. The equipment includes existing tooling such as drill fixtures and hoists, as well as new tools like a sleeve bolt removal tool and drill kit. Boeing designed, developed, and manufactured the aircraft and equipment, holds the technical data rights, and is the only source able to provide the support equipment. Market research found no other viable sources. The contract value is estimated at fair and reasonable cost to be determined during negotiations. The agency will consider future competition if alternative sources emerge.

DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ.
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves on a sole source basis a Firm Fixed-Price contract with The Boeing Company, St. Louis MO, for the procurement of Peculiar Support Equipment (PSE). These items are required to support F/A-18 EFG Aircraft Depot level (D-Level) of maintenance and repair of the Vertical Stabilator.
3. Description of Supplies/Services.
This acquisition is for the procurement, production, and delivery of PSE items listed in section 3.1, as well as the design, development, fabrication and delivery of items listed in section 3.2 in support of the F/A-18 EFG Aircraft D-Level of maintenance and repair of the Vertical Stabilator.
3.1 Existing Tooling Procurement.
The following items of PSE shall be procured, produced and delivered:

RE274230300-1 4920-LLPFSA238 6
3.2 New Tooling Procurement.
The following items are for new PSE items which have not been previously procured by the Government:

(Not SERD’d)
2 Sleeve Bolt Drill Kit 74D110655-1001 None (Not SERD’d)
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
It has been determined by NAVAIR that these items are only available through The Boeing Company. In accordance with FAR 6.302-1(a)(2)(ii) The Boeing Company is the original source and prime integrator of the EA-18G and F/A-18 E/F aircraft and award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The Boeing Company is the original designer, developer and manufacturer and the only source with the requisite knowledge, experience, technical expertise and technical data to provide the PSE for the EA- 18G and F/A-18E/F requirements. Any other source would need to possess the drawings/technical data to be able to perform this requirement. The Government does not possess the drawings/technical data for the EA-18G and F/A-18E/F PSE to support a competitive acquisition. The drawings for EA-18G and F/A- 18E/F PSE have been left under The Boeing Company’s Configuration Management and Boeing is the “Design Activity” for the items, not NAVAIR. Furthermore, the production line is still open for PSE and Aircraft changes, and PSE is still currently being incorporated into drawings.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The F/A-18 EFG Program Technical Team conducted Market Research and internet searches. The Federal Procurement Data System, OneTouch, Haystack, WEBFLIS, Google, Yahoo, and Bing internet search engines were queried for potential sources, and the only result returned was the Original Equipment Manufacturer, The Boeing Company. Additional vendors were identified in the Dynamic Small Business Search engine via NAICS Code, but do not possess Boeing Proprietary data rights or drawing packages to fulfill this requirement.
A Request For Information was posted on 23 March 2020 through 30 March 2020 to the Beta.Sam web portal with no responses received. The synopsis required by FAR 5.201 was published on the Beta.Sam web portal on 03 April 2020 through 20 April 2020, with no responses received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. An analysis of The Boeing Company’s proposal will be performed by technical analysts and contract specialists, with the assistance of Defense Contract Management Agency (DCMA) and Defense Contract Audit Agency (DCAA) auditors as needed. The Contracting Officer will analyze the various cost elements that are presented in the proposal, as well as review the actuals from previous procurements, if applicable. The Contracting Officer will use Government expertise, including DCMA, DCAA, and other Government resources, to evaluate the proposal material, labor, and subcontracts. A detailed report, developed as part of the
Government evaluation, will be utilized to establish a NAVAIR position. As discussed in this paragraph, the Contracting Officer will use cost and price analysis as the basis for negotiating a fair and reasonable price for the supplies and services covered by this J&A.
8. Actions to Remove Barriers to Future Competition.
If another requirement emerges and potential sources for that requirement are identified, NAVAIR will assess whether competition for future requirements is feasible.
