JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ.

2. Description of the Action Being Approved

This Justification and Approval authorizes and approves the issuance of a fixed-price contract for the procurement of Manpack Satellite Communications (SATCOM) Antennas (P/N: TSE-RF-

SAT-MP-A12).

3. Description of Supplies/Services

The NAWCAD Special Communications Mission Solutions (SCMS) Division, St. Inigoes, Maryland, supports the Naval Special Warfare Command (NAVSPECWARCOM).

NAVSPECWARCOM requires Manpack SATCOM antennas to sustain Naval Special Warfare

(NSW) Command, Control, Communications, Computer and Intelligence (C4I) systems for

NSW GROUPS 1 - 4, 10, 11, Naval Special Warfare Development Group, Naval Special

Warfare Center (NSWCEN), and each of the respective NSW Group Subordinate Commands.

The manpack SATCOM antennas must meet both performance and physical requirements for the

NSW. The NSW C4ISR (C4I Surveillance and Reconnaissance) systems require compact, single-hand motion deployable antennas that are capable of being hand-held, ground mounted, or vehicular and used while the operator is on the walk, halt, or driving. The NSW C4ISR systems currently have integrated Manpack SATCOM antennas. The requested antennas will directly replace worn and damaged antennas in the field. The antennas are required to operate in the

NSW C4ISR systems and are the only components that are compatible with the fielded systems and the configuration baselines for the NSW C4ISR systems.

4. Statutory Authority Permitting Other than Full and Open Competition

10 U.S.C. 2304(c) (1), FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements

5. Rationale Justifying Use of Cited Statutory Authority

The NSW requires manpack SATCOM antennas to replace damaged or worn antennas and maintain the same fit and function as those already integrated and fielded. The requested antennas from The requested antenna is the only known antenna which meets the NSW performance requirements and specifically works in conjunction with other equipment integrated into NSW C4ISR systems. The requested antennas are the only items that are compatible with the fielded C4ISR systems and the configuration baselines for those systems.

Should the Government elect to procure another manufacturer’s system, the Government would incur irrecoverable, duplicative costs to replace fielded antennas. Additionally, testing would be required to validate the alternative products ability to meet the Government’s environmental and performance requirements; additional testing costs. In total, the program would experience an unacceptable increase in cost. Without an operational manpack SATCOM antennas, the NSW forces would be at risk due to the inability to initiate and maintain critical communications.

Furthermore, additional testing, Critical Design Reviews, and technical documentation updates would cause a delay in schedule.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was conducted utilizing various methods to identify additional possible sources for the required antennas and to obtain current information in regard to availability, price, and costs. A search was done using the nomenclature “Manpack SATCOM/LOS Antenna Kit” which resulted in several manufacturers with similar equipment. Additional market research was conducted to identify authorized resellers or distributors of the equipment utilizing Google, General Service Administration (GSA), and National Aeronautics and Space Administration

(NASA) Solutions for Enterprise-Wide Procurement (SEWP) websites, however none were found on Google or NASA SEWP.

On 06 June 2018, a Request for Information (RFI) was placed on the Federal Business

Opportunities (FedBizOpps) website to survey the marketplace for additional sources that could meet the requirements. The RFI closed on 14 June 2018 with no responses received. A synopsis was posted to FedBizOpps on 10 July 2018 and closed on 25 July 2018. There were no responses.

7. Determination of Fair and Reasonable Cost

The Contracting Officer shall ensure that the price negotiated for this acquisition is fair and reasonable IAW FAR 15.4. The contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the cost estimate. The proposal will be reviewed by experienced technical personnel at SCMS and the

Contract Specialist. The Contracting Officer will utilize cost and price analysis in accordance with FAR 15.404-1, including a review of historical data, as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition

For the reasons stated in paragraph 5, at this time, only manpack SATCOM antennas can meet the requirements of this effort. The Government will continue to evaluate other technologies that would allow future competition.
