JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ Contracting Officer: Michelle Prinston
2. Description of the Action Being Approved.
This justification and approval authorizes and approves a sole source, firm fixed price contract to GE Inspection Technologies, LP (CAGE code 052B7) for the procurement of ten (10) Defect Measurement Video Borescopes (4mm), Part Number (P/N) XLGOB3920M-N, National Stock Number 6650-01-586-0426, in support of the AV-8B/F402 Harriers Mission Critical Inspections.
3. Description of Supplies/Services.
The Government will procure ten (10) Defect Measurement Video Borescopes (6mm),P/N XLGOB3920M-N. This Video Borescopes is a portable, ruggedized and battery-operated unit used to perform remote visual inspections of the AV-8B/F402 Harrier engine inspection requirements. It is used to inspect, analyze, and record data and measurements for defects found (i.e. cracks, fractures, foreign object damage, wear and erosion) in inaccessible areas of the aircraft during maintenance procedures. The Borescopes and their components shall have a one (1) year warranty.
4. Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C. 1901, Simplified Acquisition Procedures (Certain Commercial Items).
5. Rationale Justifying Use of Cited Statutory Authority.
GE Inspection Technologies, LP is the Original Equipment Manufacturer of the Defect Measurement Video Borescopes, P/N XLGOB3920M-N. The borescopes were developed for the Navy based upon a commercial model that was modified by GE under PMA-260 contract number N68335-10-D-0005 to meet the Navy’s requirements. The Government does not possess the technical data that would be required for an alternate source to manufacture these units.
The GE Defect Measurement Video Borescope is the only borescope that can meet the Navy’s Electro-Magnetic Interference (EMI) and environmental testing requirements for rain, blowing sand, and dust. Video Borescopes found in the commercial market are suitable for industrial, commercial aviation, and automotive applications, but were not designed for use in harsh military environments and do not provide the quality of inspection required in tight space constraints. The inability to properly perform inspections of the AV-8B/F402 engine jeopardizes mission capability.
Additionally, the cost to build, test, and logistically support an alternate Defect Measurement Video Borescope to conform to Navy requirements would add significant cost and timeline to this effort. Non-recurring engineering costs (first article development; design, testing, and production reviews; test plans and reports; software development, engineering data for provisioning, maintenance plan, technical manuals, training, etc.).
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed contract was synopsized on FEDBIZOPPS on 24 February 2016 and closed without any challenges. Market Research was also performed using internet search engines and the Small Business Administration Dynamic Small Business Database. No companies were found in the commercial market that sell Defect Measurement Video Borescopes that meet the Navy’s EMI and environmental testing requirements and are suitable for use in harsh military environments.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal. GE’s proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialist. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
There are no actions that the Government can take at this time to remove barriers to competition. The Government does not possess the technical data that would be required to solicit by full and open competition. The Navy previously fulfilled common support equipment (CSE) requirements for Video Borescopes Sets through PMA-260 IDIQ contract number N68335-10-D-0005. This contract has expired and the next generation, new development, competitive PMA-260 CSE contract is approximately seven years away.
