JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This Justification and Approval authorizes a limited competition for procurement of four (4) Main Engine Cylinders (MEC), Part Number 52-50866-1, NSN 1710-00-868-1912. The MEC’s are Aircraft Launch and Recovery (ALRE) Critical Safety Items (CSI). In accordance with Public Law 108-136, Section 802, Para B(2) only approved sources by the design control activity can be solicited for offers.
3. Description of Supplies/Services.
This procurement is for a total of four (4) MEC, Part Number 52-50866-1, NSN 1710-00-868-1912, for the Mark 7 Mod 3 Arresting Engines on the CVN-73 USS George Washington. In addition, test certifications as specified in the TDR will be a contractual deliverable. This procurement requires First Article Testing of one (1) unit, followed by three (3) production units.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The MECs are designated Aircraft Launch and Recovery (ALRE) Critical Safety Items (CSI). Public Law 108-136 Section 802 Para. B(2) states: “That the head of the contracting activity for an aviation critical safety item enter into a contract for the procurement, modification, repair, or overhaul of such item only with a source approved by the design control activity in accordance with section 2319 of title 10, United States Code." Technical Data Requirements (TDR) 14-17033 identifies four (4) approved sources: Clover Industries, Inc. (CAGE 45X91), 7555 W Stewart Avenue, Wausau, WI 54401-9333; Wellman Dynamics Machining and Assembly, Inc. (CAGE 6JRD9), 706 Willow Springs Lane, York, PA 17406-8434; Honematic Machine Corp. (CAGE 9G619), 222 Shrewsbury Street, Boylston, MA 0105-18700; and Rexroth Hydaudyne BV (CAGE H7984), Kruisbroeksestraat 1, Boxtel, 5281 RV. On-going market research has found additional companies that are capable of performing the work and are being reviewed for the approved sources list. As a result, this will be a limited competition among companies on the approved sources list.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Request for Information was issued on 20 July 2015 soliciting interest from potential manufacturer for the MECs, and no responses were received. In addition, a synopsis was posted on 20 August 2015 and no responses were received. Four (4) vendors have been qualified to make this ALRE CSI designated part by the Technical Authority. Five (5) additional companies were determined to be capable of performing the work by the Technical Authority and are being reviewed as approved sources. Therefore, in accordance with Public Law 108-136 Section 102 Para B(2), all companies determined capable of performing the work and who are listed on the approved sources list will be solicited.
7. Determination of Fair and Reasonable Cost.
In accordance with the FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. A fair and reasonable price will be found upon adequate price competition. In the event only one bid is received, the Contractor will be required to submit cost or pricing data and sufficient information to support the accuracy and reliability of the proposal.
8. Actions to Remove Barriers to Future Competition.
In compliance with Public Law 108-136, Section 802, Para B(2) only approved sources by the design control activity can be solicited for offers. However a standard procedure exists with the design control activity and NAVSUP that outlines the policies and procedures that any vendor can follow to have their company added to the list of approved sources.
