JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This Justification and Approval authorizes and approves on a sole source basis a Firm Fixed-Price Delivery Order (DO) on Basic Ordering Agreement (BOA) N68335-15-G-0003 with Rockwell Collins of Cedar Rapids, IA for the procurement of organic depot level maintenance and repair capability for the HF121C Radio, 1939c Radio and accompanying Smart Mount and Radio Turning Panel (RTP) which are part of the P-8A Communications Suite. The organic depot level maintenance repair capability is in support of the Fleet Readiness Center Southwest (FRCSW) depot and Logistics Management Information Team. The estimated period of performance of this requirement is forty-eight (48) months from the date of contract award with a total estimated dollar amount of $28,584,890.

3. Description of Supplies/Services.

The Joint Depot Source of Repair Decision Memorandum dated 7 January 2014 assigned FRCSW North Island as the Government’s Joint Depot Source of Repair site to conduct depot level maintenance for the HF121C Radio System. Currently, FRCSW does not have full capability to repair the HF121C Radios for which Rockwell Collins currently provides depot level maintenance. On 13 May 2015, BOA N68335-15-G-0003 was awarded for the two stage approach that would provide supplies and services in support of PMA290 Airborne Maritime Reconnaissance Programs to implement organic depot repair capability for the HF121C Radio’s and P-8A Communication Suite. On 20 July 2015, the first stage under DO 0001 was awarded to procure a depot assessment that reviewed the current capabilities of FRCSW compared to those of the Original Equipment Manufacturer (OEM) to determine the equipment, training, and support needed by the United States Navy in order to perform depot level repairs on the P-8A Poseidon aircraft Communication Suite.

As a result of the depot level assessment performed under DO 0001 this requirement is for, but not limited to, the procurement of engineering/technical/logistical support, training, assemblies, subassemblies, ancillary equipment, test equipment and other associated equipment, drawings, data, and software to establish organic depot capability for the HF121C Radio, 1939c Radio and accompanying Smart Mount, and RTP at FRCSW. The contractor will manufacture and install all test equipment, associated tooling, and fixtures at FRCSW in order to establish organic depot maintenance facility to support the HF121C Radio, 1939c Radio and accompanying Smart Mount, and RTP at FRCSW. It will include Rockwell Collins commercial Special Test Equipment (STE), any modifications to the STE that may be required for installation/integration into the facility at FRCSW, technical data, provisioning data, Unit Under Test (UUT) “gold boxes” and data to develop Operational Test Program Sets to be used on the Navy’s Consolidated Automated Support System.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

Rockwell Collins is the OEM of the HF121C Radio, 1939c Radio and accompanying Smart Mount, and RTP for use on the P-8A. They are the only known source with the requisite knowledge of the design, technical data, fabrication, performance and operational characteristics of this equipment capable of meeting existing antenna, airframe infrastructure and Interface Control Document and Interface Design Document associated with P-8A requirements. Rockwell Collins developed this equipment at private expense and therefore owns the proprietary rights to the technical data, design drawings, provisioning data, UUT data, training documents and test equipment required to establish organic depot level maintenance repair capability at FRCSW. Rockwell Collins is the only company who is able to provide the depot stand up capability for this equipment at FRCSW in order to allow for organic depot level repairs.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted and determined no sources have the equipment that have the same form, fit and function as the Rockwell Collins equipment for use on the P-8A. Rockwell Collins is the only contractor that can supply all components of the HF121C Radio, 1939c Radio and accompanying Smart Mount, and RTP. In accordance with Department of Defense Federal Acquisition Regulation Supplement 206.303-2, a Request for Information was released on the Federal Business Opportunities website on 06 September 2016 and no responses were received. As required by FAR 5.201, the proposed contract was also synopsized on the Federal Business Opportunities website on 12 September 2016. At this time, no responses have been received, however, prior to proceeding with the plan of a sole source procurement to Rockwell Collins, any response received expressing interest will be reviewed by the Contracting Officer, in coordination with the technical and requirements cognizance.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. Rockwell Collins proposal will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For reasons set forth in paragraph 5, NAVAIR has no plans to conduct a full and open competition for future procurements. If another potential source emerges, NAVAIR will assess whether a full and open competition for future requirements is feasible.
