JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This Justification and Approval authorizes and approves on a sole source basis a Firm Fixed Priced contract with Hamilton Sundstrand Corporation (HS), Windsor Locks, CT, the Original Equipment Manufacturer of the NP2000 propeller system and its Support Equipment (SE) in support of the E-2 platform.

3. Description of Supplies/Services.

This acquisition is to procure a total of twenty-eight (28) pieces of SE for maintenance support of the E-2C, E2-D, TPTI test cell and E-2 Foreign Military Sales (FMS) communities. The following list of SE details the twenty-eight (28) items that are required for this effort.

See Appendix A for Estimated Dollar Value

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

HS is the sole designer, developer, and manufacturer of the NP2000 propeller system and its SE, and therefore is the only contractor with the requisite knowledge, proprietary rights, experience, and technical data that can meet the Government’s requirements. The Government does not own the rights to either the NP2000 propeller system or its SE. The cost to acquire the rights is $200 million for the NP2000 propeller system and its related SE. Current system costs and service life of the propeller system and the SE make this cost prohibitive. The technical data and detailed drawings packages are HS proprietary. HS is the only source that possesses the design and performance data necessary to provide flight test and evaluation and maintenance and logistics support to include SE for these propeller systems. Without the technical data and proper documentation, it would not be possible for any other source to develop SE for the NP2000 propeller system.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR 5.201(b)(1), this requirement was synopsized via the Federal Business Opportunities website on 14 November 2014. No responses or inquiries other than HS have been received. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than HS to provide the required supplies. Any future responses will be evaluated by the Contracting Officer prior to award.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that the supplies covered by this document are procured at a fair and reasonable price. The Contractor will submit a formal price proposal and sufficient certified cost and price information to support the accuracy and reliability of the proposed price if necessary. HS's proposal will be reviewed by experienced technical analysts and the contract specialist with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis price analysis as necessary as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVAIR Lakehurst does not have adequate and proprietary rights to compete future contracts for the types of supplies covered by this document at this time. If another potential source emerges, NAVAIR Lakehurst will assess whether competition for future requirements is feasible.
