JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This justification and approval authorizes and approves, on a sole source basis, a Firm-Fixed Price contract action to Bell Boeing Joint Project Office (BBJPO) for the design, non-recurring engineering, and fabrication of Peculiar Support Equipment (PSE) for the MV-22 and CV-22 aircraft platforms. The end item being procured is SERD 3213, Environmental Control Unit (ECU) Trailer Adapter, P/N 901-225-036-101. A total of (65) ECU Trailer Adapters are required to service and maintain the MV-22 and CV-22 aircraft.

3. Description of Supplies/Services.

This acquisition is for the non-recurring engineering (NRE), fabrication, and delivery of (65) ECU Trailer Adapters (44 for MV-22 and 21 for CV-22) to support V-22 Organizational (O) Level maintenance requirements. The ECU Trailer Adapter allows the new Block C ECU on the V-22 to properly interface with the SERD 0913 Trailer thereby enabling ground transportation of the ECU during maintenance functions. Also being procured in this acquisition are logistics support, drawings, and a complete technical data package (TDP).

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The ECU Trailer Adapter is a new requirement; therefore, detailed technical data and drawings are not yet available. The Government does not possess technical data for the new Block C ECU aircraft component and is thus unable to organically design the ECU Trailer Adapter or solicit from alternate sources. Boeing, as the aircraft OEM and component integrator, is the only company that has physical access to both the new Block C ECU aircraft component and the ECU Trailer. Furthermore, Boeing is currently manufacturing a rapid prototype for the ECU Trailer Adapter under contract N68335-11-P-0395 which will serve as a proof of concept to expedite NRE efforts and hardware availability. The prototype effort will also enable a Firm Fixed Price contract for NRE and production quantities.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The proposed contract has been synopsized on the FEDBIZOPS website. The ECU Trailer Adapter has not yet been developed and the OEM of the aircraft, Boeing, is the only company with the expertise and knowledge of the aircraft and the interfaces that this adapter requires to be developed for the new Block C ECU to be transported on the current trailer in the fleet. The Government anticipates receiving a complete Level III drawing package 18-24 months after contract award which will enable competitive procurement efforts in the future.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer shall make a determination that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

Technical Data packages with unlimited rights will be procured under this effort which will allow future competition for any new procurement of the ECU trailer adapters required for the V-22 Program.
