JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This justification and approval authorizes and approves on a sole source basis a Firm Fixed Price contract for the acquisition to procure Organizational Level of Maintenance Peculiar Support Equipment (PSE) initial outfitting for F/A-18 E/F squadron stand-ups (VFA-25, VFA-146, VFA-192 and VFA-151). The itemized list for this procurement is attached identifying 604 items.
3. Description of Supplies/Services.
This acquisition is to procure F/A-18 E/F PSE initial outfitting for emerging squadron stand-ups (VFA-25, VFA-146, VFA-192 and VFA-151). The PSE requirements of 604 items span the full scope of the F/A-18 E/F aircraft Organizational Level maintenance and repair of airframe, avionics, weapons, life system and propulsion systems. Unique airframe and weapon system requirements include Aerial Refueling, On-Board Oxygen Generating System, Navy Aircrew Common Ejection Seat, Active Electronically Scanned Array and F414 engine. The PSE is required for these squadrons to meet safety for flight criteria.
See Appendix A for Estimated Dollar Value
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Boeing Company is the original designer, developer and manufacturer of the F/A-18 E/F aircraft and is the only source with the requisite knowledge, experience and technical expertise to provide the PSE for the upcoming squadrons requirements. The Boeing Company is the Original Equipment Manufacturer (OEM) and prime integrator of the F/A-18 E/F aircraft. The data rights for F/A-18 E/F PSE are proprietary to Boeing and have not transitioned to the Navy to support a competitive acquisition. Another source would need the proprietary data in order to develop the required PSE.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The proposed contract was synopsized on the FEDBIZOPS website on 19 April 2011. No inquiries were received. Market Research was conducted and no other sources were found that could provide these items. The Boeing Company was the only source found to provide the required PSE.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will ensure that all supplies and services provided under this contract are procured at a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
NAVAIR will continue to evaluate the marketplace in the future for any sources that may potentially allow for full and open competition in the future.
Value: $12,500,000.00
