JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves the issuance of firm fixed priced order on a sole source basis under Basic Ordering Agreement (BOA) with Northrop Grumman Corporation (NGC) for the Replacement of the Coolant Pump Test Module (CPTM) obsolete Flow Meters and associated hardware for the U.S. Navy. This order is in support for the Non-Recurring Engineering (NRE) effort to develop, install and test an upgraded FAT CPTM Modification Kit. CPTM supports the Group 2 APS-145 Radar Coolant Pumps in conjunction with operation of the E-2C Radar Test Bench Set (RTBS).
3. Description of Supplies/Services.
NGC contract for the non-recurring engineering will include delivery of upgraded FAT Modification Kit hardware for the CPTM that will contain the new Flow Transducers, Flow Gauges, Flow Straighteners and any other additional hardware and material that is needed for an installation of the new Flow Meters. NGC will also produce CPTM Modification Drawings identifying the new hardware and showing the items to remove and install to facilitate modification of the existing units in the field. The MOD Drawings Parts List shall also serve as a source for development of MOD KIT Parts List. NGC shall also provide the following ILS elements: ECP/SEC/TD/KPL/IDP, PUBs update, Support Hardware (DCNs, ISILs, Provisioning, etc.), Maintenance Plan updates, CMRS for calibration data to USN Corona, data for SERDs update, Test Procedures, First Article Verification Testing and Recurring Acceptance testing and scheduled Design Reviews.
See Appendix A for Estimated Dollar Value
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
NGC is the OEM and prime integrator, and currently holds all of the rights to the technical data on the RTBS and CPTM. The Navy did not procure Level III drawings to make competition possible. NGC is also the designer/manufacturer of the E-2 aircraft and the RTBS bench simulates the radar suite in the aircraft. Since NGC is the design/developer of the E-2 radar, they hold all of the aircraft information to integrate the AN/APM-376 Flow Meters.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
NGC is the OEM and holds all of the proprietary technical documentation for the equipment. Because NGC holds all of the source data, they are the only ones that can update the equipment. Google, Yahoo, and Lycos were queried. No market capability was found to upgrade an existing E-2 Peculiar Radar Test Bench that has Proprietary drawings. Also, the In-Service Engineer for the E-2 Peculiar Support Equipment Radar Program at NAVAIR LKE was contacted. He stated there were no current market capabilities.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine whether the price negotiated for this acquisition is fair and reasonable, pursuant to FAR Part 15. NGC will be required to provide a pricing and technical proposal that will be reviewed by the cognizant government Contracting and Technical personnel.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAWC-AD Lakehurst has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD Lakehurst will assess whether competition for future requirements is feasible.
