JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This justification and approval authorizes and approves on a sole source basis a Firm Fixed Price contract to The Boeing Company, St. Louis, MO providing design, development, and fabrication under Basic Ordering Agreement N68335-10-G-0012. This procurement will provide the development and support of logistic elements to meet key milestones of the Distributed Targeting System (DTS), which is an ACAT III system being implemented on the F/A-18E/F aircraft.

3. Description of Supplies/Services.

This procurement is for the design, development, and fabrication of Operational Test Program Sets (OTPSs) that support the Distributed Targeting System (DTS). This requirement shall also include the logistics to support the OTPS. The purpose of these OTPS’s is to implement maintenance capability at the Intermediate Level of maintenance for the F-18 E/F aircraft. The three (3) Weapon Replaceable Assemblies (WRAs) that make up the DTS are as follows:

1) The Distributed Targeting Processor (DTP), P/N 3144520-101 is planned to be supported with the reserved OTPS part number 824.

2) The Mass Storage Unit (MSU), P/N 3157500-101 is planned to be supported with reserved part number 825

3) The Bulk Data Cartridge (BDC), P/N 3157519-101 is planned to be supported with reserved OTPS part number 560.

The contractor shall provide two (2) Engineering Design Models (EDM) to meet I-level stand up for each DTS OTPS developed. The necessary tools to support identified I-level Fiber Optic maintenance tasks shall be provided.

The contractor shall provide the following two items in the OTPS for ease of maintenance of the DT system:

a) DTP module extractor tool,

b) GPP module handling fixture

The OTPS effort in this delivery order is a direct result of F-18 E/F Avionics ECP 6253R1, which defines the necessary weapons system installation to the aircraft and the “I” level maintenance support utilizing CASS OPTS’s.

In addition to the development of the OTPSs and First Article production of OTPSs 824, 825 and 560, this effort also includes On-Site Verifications (OSV) at two US Navy sites (FRC Midlant Oceana and FRC West Lemoore).

In addtion to the OTPS development of CASS OTPS's, the contractor shall update two (2) Engineering Design Models (EDM) for the Fiber Optic Instrumentation Interface Device previously developed under another contract to production equivalence. The Distributed Targeting System (DTS) baseline capability provides real time, precision weapon system target location by geo-registering aircraft sensor imagery and producing a precise target location. Due to the complexity of the Distributed Targeting System and the supplier’s Mean Time Between Failure (MTBF) rates, a CASS OTPS is cost effective. The period of performance for this effort is 48 months ARO. Failure to complete this procurement will significantly impact the readiness of F/A-18 E/F aircraft.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

As part of an Engineering Change Proposal, the Boeing Company was the lead contractor which designed and developed the 2 prototype ‘Technology Development’ (DT ) of the Distributed Targeting System. In addition, Boeing also has been the designer, developer, and Original Equipment Manufacturer (OEM) of previous F-18 E/F CASS OTPSs. With their expertise not only in F/A-18 avionics but also in support equipment, this shared expertise should be beneficial to the government in receiving a quality product. This action is for the development and production of Intermediate level support equipment for the F/A-18 E/F aircraft. The OTPS hardware and software covered by this J&A will be designed and developed and are items that are not assigned a National Stock Number (NSN) and cannot be procured through the Inventory Control Point (ICP).) Since this support equipment is newly identified through the Logistic Support Analysis (LSA)/ Support Equipment Requirements Document (SERD) process, data for breakout or competition does not exist. Boeing has developed the necessary data for newly identified OTPSs as part of the Logistics Support Analysis program under the Engineering, Manufacturing and Development (EMD) aircraft contract. Boeing, therefore, is the only firm that possesses the detailed technical knowledge, engineering expertise, aircraft integration information and technical data for all components involved. Boeing remains the only equipment integrator that has all the required proprietary rights and non-disclosure agreements necessary to develop the required OTPSs, No other source has sufficient technical data, drawings, software, repair parts, and trained technical personnel to perform this effort.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market research was conducted via engine search and industry. Boeing was found to be the only source capable of meeting this requirement. The synopsis required by FAR 5.201 was published in the Federal Business Oppurtunities on 15 February 2011. The primary synopsis period has elapsed with no inquiries received.

7. Determination of Fair and Reasonable Cost.

This procurement satisfies the immediate requirements for supporting the F/A-18 E/F mission. The Navy is buying a full technical data package with this contract to allow for competitive procurements for future requirements.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, (contracting activity) has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, (contracting activity) will assess whether competition for future requirements is feasible.
