About this file

This Justification and Approval (J&A) document from the Department of the Navy, Naval Supply Systems Command Fleet Logistics Center Sigonella seeks non-competitive authorization for shuttle bus services for Civil Service Marines during a ship's Regular Overhaul and Dry Docking (ROH-DD). The requirement is for shuttle transportation between a hotel and shipyard in Genoa, Italy for the USS MOUNT WHITNEY, covering the period from 30 October 2025 to 26 February 2026, with two daily shuttle trips to accommodate personnel.

The J&A cites unusual and compelling urgency under 10 U.S.C. 3204(a)(2) as justification for bypassing full and open competition. Key rationales include the compressed timeline, inability to use existing husbanding service contracts due to a pending OPNAV policy change, and the critical nature of providing transportation for military personnel during the ship's maintenance period. The contracting office determined the cost to be fair and reasonable based on historical pricing and committed to incorporating this requirement in future solicitations to ensure competitive procurement.

5. Rationale Justifying Use of Cited Statutory Authority.

The competitive contract included all of the typical husbanding services such as pilots, tugs, fenders, potable water, Collection Holding, and Transfer (CHT) removal, etc. for this class of vessel. However, the shuttle bus service for transportation of the CIVMARs was not included in the Military Sealift Command (MSC) original requisition package submitted to FLCSI as part of the USS MTW ROH procurement, since it has been historically provided under the Global Service Provider (HSP) husbanding contract. On 22 October 2025, MSC requested a shuttle bus service between the lodging facility and the SGdP shipyard, starting immediately upon the ship’s arrival on 30 October 2025. The customer requested that FLCSI process a Request for Excepted Activities (RFEA) in order to request FY26 funds to initiate the procurement, in the absence of approved FY26 funds authorization. The RFEA No. 5694 was approved on 27 October 2025. Based on this approval, MSC started their funds process for the required funds and the funds were approved by FLCSI on 28 October 2025. The Contracting officer explored all possible avenues to procure these services, including a competitive task order using the WEXMAC solicitation process. The WEXMAC process is estimated to take a minimum of seven (7) days for the customer prepare and submit the requisition package in the WEXMAC system, solicitation, and award. Based on these timelines, use of the WEXMAC process is not feasible to support the commencement of services on 30 October 2025.

On 27 October 2025, the Contracting Officer requested a written confirmation from

HSP Division Director, regarding the use of the Global HSP contract in support of the USS MTW ROH. Mr. Loeffler determined that the requirement was out of scope of the Global HSP Contract, based on guidance related to a forthcoming OPNAV policy change that relates to husbanding services over 14-days long. This determination precludes the usage of the husbanding services contract for the ships during the scheduled mid-term availability and regular overhaul maintenance and repair. All services in support of the ship and the crew force are determined to be part of the ship repair requirements. The Contracting Officer verified consulting the HSP contract portal database that the same shuttle bus service was ordered in the previous FY20 and FY22 ROHs.

This additional requirement is incidental to the CIVMARs lodging in the contract, but was not included on the original solicitation for the reasons explained above. This service is necessary to maintain the safety of the ship’s force within the shipyard and provide required crew transportation from the hotel to and from the vessel. The shuttle bus service must be made available at the time of the ship’s arrival scheduled for 30 October 2025 until 26 February 2026. Without this service the CIVMARs will not be able to complete their duties during the ROH.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Due to the urgency to commence this requirement in a compressed schedule, soliciting other offers will result in unacceptable delays in fulfilling the requirement. Postponing or soliciting these requirements may hinder mission readiness, which is not in the best interest for the Government. If the same service is required in the future, the requirement will be publicized in the initial solicitation in order to obtain competition.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government will be fair and reasonable in accordance with FAR 15.404-1(b)(2)(ii), Comparison of the proposed prices to historical prices paid. The historical prices for this service are available in the FLCSI HSP contract portal. The requiring activity has provided an Independent Government Estimate (IGE) based upon historical prices and paid in Genoa, Italy.

8. Actions to Remove Barriers to Future Competition.

If another similar requirement should emerge in the future, the contracting office will ensure to incorporate corresponding work to the solicitation to ensure adequate competition at the time of contract award.
