PERFORMANCE WORK STATEMENT

DJIBOUTIAN NAVY BASE – NEW FLOATING PIER AND MAINTENANCE

CTG-68.6 MSRON 11D. CAMP LEMONNIER, DJIBOUTI, AFRICA

General information: This is a non-personal services contract to conduct install and maintenance to a floating pier at the Djiboutian Naval Base in Djibouti, Africa. The Government shall not exercise any supervision or control over the Contractor employees performing the services herein. Such Contractor employees shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

1.0 SCOPE

1.1 The purpose of this requirement is to have the contractor provide all materials, parts, labor, transportation, customs duties and supervision to make all maintenance and repairs necessary to return the floating pier at the Djiboutian Naval Base in Djibouti, Africa back to safe operation and use in accordance with this performance work statement.

2.0 GENERAL INFORMATION

2.1 Hours of Operation: The Contractor shall be responsible for conducting business between the hours of 0700-1630 Monday through Friday, except for Federal holidays or when the Government facility is closed due to local national emergencies, administrative closings, or similar Government directed facility closings.

2.2 Place of Performance: Djiboutian Naval Base pier side, Djibouti, Africa.

2.3 Type of Contract: If an agreement can be met between the

parties and funding is available, the Government will award one, Firm-Fixed-Price contract for this performance work statement. Any potential modification to the contract must only be the result of an approved and signed SF-30 from a United States Government appointed Contracting Officer assigned to the issuing office.

3.0 PERFORMANCE REQUIREMENTS

3.1 This work is defined within the Performance Work Statement

(PWS) and is to be performed on Floating Pier called the US Navy MSRON Pier, located in Djibouti Naval Base. Work shall be completed in a manner that will ensure continuous operation and safe use of the Floating Pier at the dock.

Contractor shall observe, on-site, that floating pier is safe to use and is fully-functional after completion of the repair work in done accordance with this PWS and all applicable maritime and equipment criteria.

3.2 Supplies and Equipment: The Contractor shall provide all

materials, parts, labor, transportation, customs duties and supervision necessary to perform the install and maintenance of the new Floating Pier.

3.3 Warranty: The new floating pier include with the 12 months manufacturer’s warranty starting from the date it is put into service. The warranty covers the metal structure, wooden elements (floor or side protections), floats, and aluminum accessories (such as service covers, bollards, and connection parts between elements, screws, shackles. During this period, any correction or modification of the installation (replacement of connection parts, chain tension, etc.) would be carried out free of charge.

3.4 Transportation and Shipping: The Contractor shall provide the transportation, shipping, offloading, and installation of the floating pier include launching, mooring of chains, and launching and installation of gangway.

3.5 Personnel and Supervision: The Contractor is required to

provide personnel, supervision and management necessary to install parts and repair the floating pier, to include placement of concrete anchors, and steel chains to hold the pier in position.

3.5.1 Special Qualifications: The Contractor shall have the

necessary skills, training and expertise required to complete the tasks stated in the Performance Work Statement (PWS). All work shall be performed by personnel who are trained and qualified to perform the required repairs and provide all proper and applicable certifications for final safe usage of the pier as designed.

3.5.2 Emergency Services: Emergency medical treatment and

services for Contractor personnel is the responsibility of the Contractor. The Contractor shall have competent personnel trained and capable of dealing with minor personnel injuries. The Contractor shall notify the KO of any accident requiring emergency medical treatment. The Contractor shall inform the United States Government’s Technical Point of Contact (TPOC) of any potential any realized safety hazards or incidents.

3.6 SPECIFIC TASKS

The Contractor shall provide of its own support as stated in 3.2 above needed to:

3.6.1 Provide a written Safety Plan for approval for the

install and maintenance of, 120 feet long and 1.2 meters wide floating pier, and upgrade any materials of the pier.

3.6.2 After installation the new floating pier, Year 1, the

Contractor shall perform the Standard Maintenance Visits (SMV) to verify the floating pier is in good working condition. The SMV will conduct 6 months after installation of the set. The Contractor shall adjust the SMV as no SMV can be conducted in July and August.

The Contractor shall perform one Monthly Checking Visits (MCV) and repair calls as necessary until the end of the year of installation. During the SMV and MCV, the Contractor shall:

STANDARD MAINTENANCE VISIT (SMV):

3.6.2.1 Scraping of concretions, coral, and algae on

the floaters.

3.6.2.2 Check the fittings, shackles, fasteners, chains, plastic connectors, screws, wheels on the various elements, including the gangway.

3.6.2.3 Check and replace the flooring elements on the

pontoons and the gangway.

3.6.2.4 Verify moorings underwater.

3.6.2.5 Drafting of a report highlighting the work

carried out, the maintenance work to be planned and any emergency repairs to be planned.

3.6.2.6 Careful cleaning with high-pressure washer.

3.6.2.7 Replacement of parts listed in the report of

previous visit SMV OR MCV.

MONTHLY CHECKING VISIT (MCV):

3.6.2.8 Checking of the fittings, shackles, fasteners, chains, plastic connectors, screws, wheels on the various elements, including the gangway.

3.6.2.9 Checking of the flooring elements on the

pontoons and the gangway.

3.6.2.10 Small repairs and corrections

3.6.2.11 Drafting of a report highlighting the work

carried out, the maintenance work to be planned and any emergency repairs to be planned.

3.6.2.12 Careful cleaning with a high-pressure washer.

3.6.3 Maintenance for Year 2.The schedule include two

standard maintenance visit (March & September) and 10 monthly checking visits, and repair calls as necessary during year 2. During a standard maintenance and monthly checking visit the Contractor shall perform as described on section 3.6.2.1-3.6.2.12.

3.6.4 Maintenance for Year 3.The schedule include two

standard maintenance visit (March & September) and 10 monthly checking visits, repair calls as necessary during year 3. During a standard maintenance and monthly checking visit the Contractor shall perform as described on section 3.6.2.1-3.6.2.12. Additional perform below:

3.6.4.1 Replacement of rubber connectors set (4 each)

between the 3 parts of the floating portion.

3.6.4.2 Replacement of set of bollards as necessary.

3.6.5 Maintenance for Year 4. The schedule include one

standard maintenance visit (March & September) and 10 monthly checking visits, many repair calls as necessary, one Complete Maintenance and Repair (CMR) operation in October, replacement of wood fender, replacement of damaged bollards if necessary, replacement of set of chains and shackles, and replacement of broken planks on access bridge and floating pier. During a standard maintenance and monthly checking visit the Contractor shall perform as described on section 3.6.2.1-3.6.2.12 and 3.6.4.1-

3.6.4.2. Additional perform below:

COMPLETE MAINTENANCE AND REPAIR (CMR)

3.6.5.1 Dismantling of the pontoon mooring chains with

marking of the concrete ballast locations.

3.6.5.2 Towing the pontoon entire or in sections to

the water exit area.

3.6.5.3 Pulling out the pier from the water using a

crane per section and positioning on the ground in the work area.

3.6.5.4 Careful dismantling, cleaning with a high-

pressure cleaner, scraping concretions and repairing damaged structures of broken or worn parts and verification of the general condition of the pontoon.

3.6.5.5 Re-assembly of the pontoon and launching with

the crane.

3.6.5.6 Transport of towing of the assembled pier to

the quay.

3.6.5.7 Refitting of the chains with attachment to

concrete ballasts.

3.6.5.8 Reinstallation of the access gateway and

verification of dock plates.

3.6.5.9 Usual checks and return to use.

3.6.6 The Contractor shall furnish all needed support per

3.2 above to meet the requirements under this PWS.

This services relates to the install and maintenance of the floating pier at the Djiboutian Naval Base dock.

3.6.7 The Contractor shall notify the Government Technical

Point of Contact (GTPOC) of any issues regarding the repair and maintenance of the floating pier.

3.6.8 The contractor shall be responsible for the cleaning

of any equipment spaces that are used and the daily cleanup of job site.

3.6.9 The Contractor shall be responsible to ensure that a

monthly check is conducted starting in base year 2024.

Throughout the term of the contract the Contractor shall conduct the following visits:

3.6.9.1 (1) Standard maintenance visit in March

3.6.9.2 (1) Standard maintenance visit in September

3.6.9.3 (10) Monthly check visits

3.6.9.4 Then as many repair calls as necessary during

the base year.

3.6.10 The Contractor shall be responsible to ensure

that a monthly is conducted starting Year 1.

Throughout the term of the contract the Contractor shall conduct the following:

3.6.10.1 (1) Standard maintenance visit in March.

3.6.10.2 (1) Standard maintenance visit in September.

3.6.10.3 (10) Monthly check visits.

3.6.10.4 Then as many repair calls as necessary during

Year 1.

3.6.11 The Contractor shall be responsible to ensure

that a monthly is conducted starting Year 2.

Throughout the term of the contract the Contractor shall conduct the following:

3.6.11.1 (1) Standard maintenance visit in March.

3.6.11.2 (1) Standard maintenance visit in September.

3.6.11.3 (10) Monthly check visits.

3.6.11.4 Then as many repair calls as necessary during

Year 2.

3.6.12 The Contractor shall be responsible to ensure

that a monthly is conducted starting Year 3.

Throughout the term of the contract the Contractor shall conduct the following:

3.6.12.1 (1) Standard maintenance visit in March.

3.6.12.2 (1) Standard maintenance visit in September.

3.6.12.3 (10) Monthly check visits.

3.6.12.4 Then as many repair calls as necessary during

Year 3.

3.6.13 The Contractor shall be responsible to ensure

that a monthly is conducted starting Year 4.

Throughout the term of the contract the Contractor shall conduct the following:

3.6.13.1 Dismantling of the pontoon mooring chains

the water exit area.

3.6.13.3 Pulling out the pier from the water using a

crane per section and positioning on the ground in the work area.

3.6.13.5 Re-assembly of the pontoon and launching with

the crane, transport or towing of the assemble pier to the quay.

3.6.13.6 Refitting of the chains with attachment to

concrete ballasts.

3.6.13.7 Reinstallation of the access gateway and

verification of dock plates

3.6.13.8 Conduct usual checks and return the pier to

normal operating conditions.

3.6.14 The contractor shall supply enough quantity of

chains and shackles to replace the existing ones installed on the pontoon.

3.7 The offer is based on three years of maintenance of the

pier belonging to MESG-1 U.S. Navy and installed at Djibouti Navy Base. Continuing to one additional optional year and one option consisting of supplying a full set of all necessary equipment, personnel, tools, materials, and supplies to complete the task referenced above. Including supply of damaged flooring and fittings that states should require the replacement and after informing the MESG-1 U.S.

Navy representative. In the event that repairs would be made necessary because of accidents or unforeseen events unrelated to normal wear and tear of the installation (storm, collision with boats, etc.), additional estimates will be submitted for approval, these conditions will not include repair of this contract. All prices are duty free and exclusive of taxes, considering the US government as exonerated in Djibouti. In case this regime should change VAT or any additional taxes would become due. Once MESG-1 approves contract a total amount will be completed in the final offer of the contract.

3.8 The Contractor shall furnish all needed support per 3.2

above to meet the requirements under this PWS. This service relates to the repair and upgrade of an existing floating pier at the Djiboutian Naval Base dock.

3.9 The Contractor shall notify the Government Technical Point of Contact (GTPOC) of any issues regarding the repair of the floating pier.

3.10 The Contractor shall be responsible for the cleaning of any equipment spaces that are used and the daily cleanup of the job site.

4.0 PERIOD OF PERFORMANCE

4.1 The period of performance shall be annually immediately

from the award of the contract for a base year and 3 option years.

5.0 CONTRACTOR PERSONNEL

5.1 NON-PERSONAL SERVICES: Contractor employees performing

services under this contract shall be supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the performance work statement. Contractor employees will perform their duties independent of, and without the supervision of, any Government official or other Department of Defense contractor. The tasks, duties, and responsibilities set forth in the contract shall not be interpreted in any manner that results in any contractor employee providing direct personal services.

5.2 INHERENTLY GOVERNMENTAL FUNCTIONS: The Contractor shall not under any circumstance perform inherently governmental functions. Examples of inherently governmental functions include making purchases on behalf of the Government (i.e., office supplies, equipment repair, etc.), approving or certifying employee travel or training, initiating security clearance requests, personnel requests, or making budget decisions, all of which shall remain in the control and authority of the company’s contractor representatives.

6.0 GOVERNMENT TECHNICAL POINT OF CONTACT:

6.1 The Contracting Officer shall designate an authorized

Government Technical Point of Contact (GTPOC) for this contract, which will be established at the time of contract award. The GTPOC does NOT have the authority to make any changes to the terms and conditions of this contract, to include price or any changes that would affect pricing.

Only the Contracting Officer (KO) is authorized to make changes to this contract. All authorized changes will be from the KO in writing or by verbal authority. The GTPOC is responsible for the following:

6.1.1 Providing Technical Direction and interface with the

contractor’s primary person assigned to support the repair requirement.

6.1.2 Determining that the amount invoiced is accurate.

6.1.3 Final inspection and acceptance of all deliverables

under the contract.

7.0 ON-SITE SUPPORT

7.1 The contractor shall designate an individual as the on-site manager and a safety manager with complete authority to make decisions on all technical matters connected with this Contract, throughout the period of performance. The site manager shall be the individual, single point of contact onsite with whom the onsite GTPOC may interact for all contractual requirements and the safety manager may be engaged at any time and report any and all potential or realized near misses and hazards to the GTPOC.

8.0 AUTHORIZED CHANGES MADE ONLY BY THE CONTRACTING OFFICER

8.1 No order, statement, or conduct of Government personnel

shall constitute a change under the Changes clause of the contract. The Contractor shall not comply with any order, direction or request of contractual matters under the control, and distinctly different than changes to the contract under the sole authority of the Contracting Officer, the contractor shall comply with any lawful orders from Government authorities working within their authority regarding their actions while performing the work of this contract; for example, any Government employee raising a safety concern, any Government agent pursuant to his duty under specific authority such as Safety, Coast Guard or Port Authority to name a few, but not limited shall be followed by the contractor, but not be constructed as a contract change. Any such order shall be coordinated with the GTPOC to the greatest extent possible and practicable with Safety as the foremost concern and always shall be reported in any and all cases to the GTPOC.

8.2 The KO is the only person authorized to approve changes in any of the requirements of this contract. In the event that the contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase incurred as a result thereof.

9.0 SECURITY REQUIREMENTS

9.1 Physical Security: The Contractor shall safeguard all

Government equipment, information and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured.

9.2 Key Control: The Contractor shall establish and implement methods of making sure all keys/key cars issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall immediately report any occurrences of lost or duplicate keys to the GTPOC. Issued key cards shall be returned to the GTPOC upon completion of work.

9.3 The Contractor shall prohibit the use of Government issued keys by any persons other than the Contractor’s employees.

The Contractor shall prohibit the opening of locked areas by Contractor by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the KO or GTPOC.

9.4 Identification Badge: Each Contractor employee shall wear an identification badge while performing work under this contract. All identification badges shall be worn prominently on the upper front of the outer garment, unless by Occupational Safety & Health Administration (OSHA) regulations(s).

10.0 SAFETY PRECAUTIONS

10.1 The Contractor shall be responsible for, and take all

necessary and proper safety precautions to protect accident or injury, all persons, including its employees and its subcontractors’ employees, who may be at or on the premises where the work is being performed. Contractor shall establish and enforce adequate, reasonable, prudent and proper safety rules and procedures and emergency procedures necessary for safe completion of the work. Contractor shall coordinate and comply in all respects with Djiboutian Naval Base safety procedures.

10.2 The Contractor shall present a safety plan to the GTPOC

prior to commencement of work onsite or offsite. The Contractor shall obtain specific GTPOC approval for any work conducted onsite.

11.0 THE NAVAL BASE ACCESS REQUIREMENTS

11.1 Operation Security (OPSEC): Contractor personnel shall

ensure all operational security procedures of the naval base are adhered to. Contractor shall report all suspicious activities or violations of OPSEC to the base security office.

11.2 All non-United States citizens who require access to U.S., Host Nation and/or Partner Nation member-controlled facilities must be screened and vetted. Screening methods include, but are not limited to, two forms of identification, the collection of biometric data (picture, fingerprint, iris scan, DNA, etc.) and interviews.

Employees that refuse to provide any requested information or collection samples will not be eligible to work on the resulting contract.

11.3 Contractor Access to the Country of Djibouti: All

contractor employees are responsible for securing a valid U.S. Tourist Passport, Djiboutian Visas or an e-visas prior to arrival in the country of Djibouti. Contractor employees are responsible for all travel information, documentation, and fees required for the entry into the country of Djibouti.

11.4 Contractor Vaccination Requirements: All Contractor

employees must be fully immunized with a COVID-19 vaccine that has been approved for use by the United States Food and Drug Administration (FDA); or the Contractor employee must request an exemption from the COVID-19 vaccination requirement in accordance with the requirements set forth by the Camp Lemonier Commanding Officer.

11.5 Contractor Personnel Conduct: Contractor personnel’s

conduct shall not reflect discredit upon the Government.

The Contractor shall ensure that personnel present a professional appearance. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substances. The Contractor is responsible for ensuring that any Contractor employees providing services under this contract conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove from the job site any employee for reasons of misconduct or security. In accordance with DOD Directive 5500.07-R, “Joint Ethics Regulation”, Contractor employees must avoid being improperly influenced in the execution of their duties under the contract. Particular attention should be paid to acceptance of gifts/ gratuities, and on non-disclosure of sensitive or classified information. The Contractor shall ensure employee conduct complies with 41 U.S.C 2101-2107 relative to release acquisition related information or actions or discussions which may prejudice future competitions. The Contractor shall ensure no Contractor employees conduct politically related activities or events while on the installation.
