INSTRUCTION TO QUOTERS

ADDENDUM TO FAR 52.212-1 - INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JAN 2017)

It is emphasized that this Request for Quotation (RFQ) is issued in accordance with the procedures of FAR Parts 13.5 and 13.106-2(b)(3), which are intended to streamline source selection and be minimally burdensome for both the Government and the Quoters interested in competing for this requirement. Note also that any references in the RFQ to offer/offeror shall be deemed to mean quotation/quoter.

The following provision is tailored in accordance with FAR Part 12.302(d) and replaces the foregoing provision, FAR 52.212-1, in its entirety:

INSTRUCTIONS TO QUOTERS—COMMERCIAL ITEMS (JAN 2017)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of quotations. Submit signed and dated quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotations must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotations;

(3) The name, address, and telephone number of the Quoter;

(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the Quoter shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for holding quotations firm. The Quoter agrees to hold the prices in its quotation firm for 30 calendar days from the date specified for receipt of quotations, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple quotations. Not applicable.

(f) Late submissions.

(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.

(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is “late” and will not be considered unless it is received before issuance of a purchase order and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.

(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(g) Issuance of a purchase order. The Government intends to evaluate quotations and issue a purchase order based upon initial quotations received. Therefore, the Quoter’s initial quotation should contain the Quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to request revised quotations from, or negotiate final purchase order terms with, one or more Quoters if it is later determined by the Contracting Officer to be necessary. However, the Contracting Officer will not establish a competitive range, conduct discussions, or otherwise utilize the formal source selection procedures described at FAR Part 15. The Government may reject any or all quotations if such action is in the public interest; issue a purchase order to other than the Quoter with the lowest price; and waive informalities and minor irregularities in quotations received.

(i) Availability of requirements documents cited in the solicitation.

(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to—

The suffix is assigned at the discretion of the Quoter to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Quoter should indicate that it is a Quoter for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.

(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of a quotation, the quotation or acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a single Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

Factor I – Technical Capability

Factor II – Past Performance

Factor III – Price

(1) Factor I – Technical Capability

Technical Capability will be evaluated on an Acceptable/Unacceptable basis. The Government will evaluate the documentation submitted to evaluate if the quoted products meet the Government’s salient characteristics.

Factor 1 above will be rated using an “Acceptable” or “Unacceptable” methodology, per Table A1 below.

Table A1 - Technical Ratings

RATING
DEFINITION
Acceptable
Quote meets the minimum requirements of this RFQ
Unacceptable
Quote does not meet the minimum requirements of this RFQ

(2) Factor II – Past Performance

Past performance will also be considered and will be rated only on an “acceptable”, “unacceptable”, or “neutral” basis. The Quoter shall describe its past performance on directly related or similar Federal, State and local government, and private contracts and subcontracts which were ongoing or completed within the last five (5) years from the closing date of this RFQ, which are of same or similar scope, magnitude or complexity to that which is detailed in the RFQ (not more than three (3) references). Each Past Performance effort will be preliminarily evaluated for recency AND relevancy. Recency will be defined as those past performance submissions that meet the requirement of having been performed or completed within the past three (3) years from the date of the solicitation release. The Government will evaluate relevancy as follows:

Rating

Definition

Very Relevant (VR)
Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant (R)
Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant (SR)
Present/past performance efforts involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant (NR)
Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

After the Government has determined the recency and relevancy of each past performance effort being evaluated, the quality of the Quoter’s performance, general trends, and usefulness of the information shall be incorporated into an overall Past Performance Assessment rating which will be assigned to each Quoter, consistent with the Past Performance Ratings below.

Past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table A2 below.

Table A2 - Past Performance Evaluation Ratings

RATING
DESCRIPTION
Acceptable
Based on the Quoter’s performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort, or the Quoter’s performance record is neutral
Unacceptable
Based on the Quoter’s performance record, the Government has no reasonable expectation that the Quoter will be able to successfully perform the required effort
Neutral
No relevant past performance or no past performance available or so sparse that no meaningful past performance rating can be made

Note: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)). Therefore, the offeror shall be determined to have neutral past performance. In the context of acceptability/unacceptability, “neutral” shall be considered “acceptable.”

Only quotes that have been evaluated and rated as ‘Acceptable’ in the Technical Capability and ‘Acceptable’ or ‘Neutral’ for Past Performance, will be further evaluated for Price.

(3) Factor III – Price

An adjectival rating will not be assigned to the Price factor. Price Quotes will be evaluated in accordance with FAR 13.106-3. The quoted prices will be analyzed for completeness and a fair and reasonable determination.

A. Completeness. All information/data required by the RFQ has been submitted. In the event the unit price(s) and extended price(s) are ambiguous, the government shall use the indicated unit price(s) for evaluation purposes.

B. Reasonableness. Prices are fully justified, supported and considered fair and reasonable under current market conditions.

The government reserves the right to determine which offers show the capability to meet the requirements of this RFQ. The government reserves the right to eliminate from further consideration those quotes which are considered unacceptable and not capable of being made acceptable without major rewrite or revision.
