52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) To be eligible for award, the Offeror must fully comply with the instructions included in Provision 52.212-1
(Instructions to Offerors – Commercial Items), and sufficiently address all solicitation requirements. As such, quoters that take exception to any term or condition of this RFQ, propose any additional term or condition, or omit any required information, may not be considered for award. Alternate quotations are NOT authorized and will be rejected. The following factors shall be used to evaluate quotations:
(I) Technical Capability
(II) Past Performance
(III) Price
I. Technical Capability:
Quotes will first be evaluated under factor (I), Technical Capability and receive a rating of either ‘acceptable’ or
‘unacceptable,’ utilizing the definitions in Table A-1. Technical ‘acceptability’ is defined as a quote priced to include all work detailed in the PWS without taking exception to any terms and conditions detailed in this RFQ and that is in compliance with the quote submittal instructions and requirements detailed under contract provision
52.212-1 as well as acknowledgement of any solicitation amendments.
Table A-1: Technical Capability Ratings:
Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Quote meets the minimum requirements of the solicitation.
Unacceptable Quote does not meet the minimum requirements of the solicitation.
II. Past Performance:
Quotes will next be evaluated under Factor (II), Past Performance. The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. The
Quoter’s past performance submittals (RFQ Attachment J-1) will initially be evaluated to determine whether it is recent and relevant utilizing the following definitions:. Recency is defined as work performed within the past three years and relevancy is defined as work that is similar in scope, magnitude, and complexity of this requirement.
Second, the past performance submittals will be evaluated and receive an overall rating of either ‘acceptable’ or
‘unacceptable,’ utilizing the definitions in Table A-2.
Table A-2: Past Performance Ratings:
Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of a vendor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Sources of Past Performance Information for Evaluation are as follows:
Past performance information may be provided by the offeror, as solicited under Past Performance
Worksheet (RFQ Attachment J-1)
Past performance information shall be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee
Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining
Officials; and the Defense Contract Management Agency.
A rating of “unacceptable” under Factor (I) and/or Factor (II) will render the entire quote unacceptable and ineligible for award.
III Price:
Only those Quoters that have been rated acceptable under Factors (I) and (II), will further be evaluated under factor
(III), Price. The Government shall evaluate the price quote for completeness and to ensure that a fair and reasonable firm fixed price is proposed. Price reasonableness will analyzed via a price comparison with the other quotes, a comparison with the government estimate, or any other pertinent price analysis technique. Award will be made to the lowest price technically acceptable (LPTA) quoter.
(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. CLINs 1001, 1002, 1003, and 1004 consist of option years under FAR
52.217-9. CLIN 1005 consists of a 6 month option period under FAR clause 52.217-8. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of a quotation mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quotation, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept a quotation (or part of a quotation), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal.
