Note also that any references in the solicitation to offer/offeror shall be deemed to mean quotation/quoter.

The following provision is tailored in accordance with FAR Part 12.302(d) and replaces the foregoing provision, FAR 52.212-1, in its entirety:

Instructions to Quoters—Commercial Items (Jan 2017)

The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of quotations. Submit signed and dated quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotations must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotations;

(3) The name, address, and telephone number of the Quoter;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the Quoter shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is “late” and will not be considered unless it is received before issuance of a purchase order and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition

(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(g) Issuance of a purchase order. The Government intends to evaluate quotations and issue a purchase order based upon initial quotations received. Therefore, the Quoter’s initial quotation should contain the Quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to request revised quotations from, or negotiate final purchase order terms with, one or more Quoters if it is later determined by the Contracting Officer to be necessary. However, the Contracting Officer will not establish a competitive range, conduct discussions, or otherwise utilize the formal source selection procedures described at FAR Part 15. CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government intends to award a single Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract to the responsible quoter on a comparative evaluation basis whose quote conforms to the solicitation and represents the best benefit to the government when compared to other quotes and other quotes with a lower price.

The Government will utilize a Comparative evaluation process that:

· compares one quote with another in a uniform and fair manner to determine which quote best provides the Government what it needs; and

· assesses which quotations best as a whole.

· Once a quotation is found acceptable, it is compared side by side to the remaining ones, and the “best” one is chosen for award.

Quoters that take exception to the terms and conditions of this Request for Quote may not be considered for award.

The following factors and subfactors will be used to evaluate the quotation:

Factor 1 – Technical Acceptability (Minimum Requirements) Factor 2 – Capabilities Factor 3 – Past Performance & Experience Factor 4 – Price

Factor 1 – Technical Acceptability

The Government will evaluate whether the offeror has submitted all required certifications per the Instruction to Quoters. With regard to certifications under Factor 1, only final certificates are considered acceptable; providing evidence of application for any of the pertinent certificates, vice providing the certificate, will not be considered sufficient in meeting the technical capability requirements and will render the quote unacceptable. This factor is the minimum requirements and all requirements for this factor shall be met.

Factor 2 - Capabilities

The Capability factor will be evaluated and compared to the other quotes received. The Government is interested in, but not limited to, quotes that clearly demonstrate an understanding of the contract requirements to provide requested car belts, and employ current and innovative processes that align with or are similar to the requirements in the Statement of Work (SOW).

Factor 3 – Past Performance & Experience

Past Performance and Experience Factor will be evaluated comparatively amongst the quotes received.

The Government may verify past performance information and may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews, and existing data sources to include but not limited to Contractor Performance Assessment Reporting (CPARS). The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. The Government is interested in, but not limited to, quotes that clearly demonstrate experience in packing, containerization, local drayage, delivery, unpacking, storage and related services for personal property shipments.

Factor 4 – Price

Price Quotes will be evaluated in accordance with FAR 13.106-3. The quoted prices will be analyzed for completeness and a fair and reasonable determination.

A. Completeness. All information/data required by the solicitation has been submitted. In the event the unit price(s) and extended price(s) are ambiguous, the government shall use the indicated unit price(s) for evaluation purposes.

B. Reasonableness. Prices are fully justified, supported and considered fair and reasonable under current market conditions.

For award purposes, the Government will evaluate prices for the entire 5-year ordering period, and the 6-month option to extend services per FAR 52.217-8. The price for FAR 52.217-8 will be calculated by dividing the total ceiling price of the 5-year ordering period by 10 (10 six-month periods in 5 years) or by dividing the year 5 total price in half (6 months), whichever is greater. Note that the evaluation of the option does not obligate the Government to exercise this option.

.4 CONTRACTOR RESPONSIBILITY

To be eligible for award, the quoter must be determined by the Contracting Officer to be a responsible prospective contractor in accordance with FAR 9.1.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (NOV 2017) ALTERNATE I (OCT 2014)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision-- “Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. “Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
