ADDENDUM TO FAR 52.212-1
It is emphasized that this is solicitation is issued in accordance with the procedures of FAR Parts 13.5 and 13.106-2(b)(3), which are intended to streamline source selection and be minimally burdensome for both the Navy and the quoters interested in competing for this requirement. Note also that any references in the solicitation to offer/offeror shall be deemed to mean quotation/quoter.
The following provision is tailored in accordance with FAR Part 12.302(d) and replaces the foregoing provision, FAR 52.212-1, in its entirety:
Instructions to Quoters—Commercial Items (Jan 2017)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of quotations. Submit signed and dated quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotations must show—
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotations;
(3) The name, address, and telephone number of the Quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the Quoter shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for holding quotations firm. The Quoter agrees to hold the prices in its quotation firm for 30 calendar days from the date specified for receipt of quotations, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.
(f) Late submissions.
(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.
(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is “late” and will not be considered unless it is received before issuance of a purchase order and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition
(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(g) Issuance of a purchase order. The Government intends to evaluate quotations and issue a purchase order based upon initial quotations received. Therefore, the Quoter’s initial quotation should contain the Quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to request revised quotations from, or negotiate final purchase order terms with, one or more Quoters if it is later determined by the Contracting Officer to be necessary. However, the Contracting Officer will not establish a competitive range, conduct discussions, or otherwise utilize the formal source selection procedures described at FAR Part 15. The Government may reject any or all quotations if such action is in the public interest; issue a purchase order to other than the Quoter with the lowest price; and waive informalities and minor irregularities in quotations received.
(h) Multiple awards. The Government may issue a purchase order for any item or group of items in a quotation, unless the Quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. Quoter who describe similar contracts and subcontracts shall provide a detailed explanation demonstrating the similarity of the contracts to the requirements of the RFQ. The quoter is required to submit ELIN pricing for each ELIN by completing Exhibit A, ELINs Pricing & Worksheet. The Government provided Estimated Quantities are the government’s forecasted quantities for the duration of the contract, and should not be changed by the Quoters in their quote. Quoters are advised that the Total Estimated Contract Value for all five years stated in CLIN 0001 shall be the Quoter’ s total proposed price in response to the solicitation, and this amount WILL BE CONSIDERED FOR CONTRACT AWARD.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government intends to award a single Indefinite Delivery Requirements contract with Firm Fixed Price Line Items to the quoter who presents the lowest price that meets all the technical requirements and has acceptable Past Performance.
Quoters that take exception to the Government’s requirements may not be considered for award.
The following factors will be used to evaluate the quotation:
Factor 1 – Technical Capability Subfactors -
· 1.a Warehouse Inspection
· 1.b A current Company Registration issued by the Chamber of Commerce
· 1.c Warehouse Permit (Copy of the Lease, if the warehouse is leased)
· 1.d Copy of Vehicle Registrations for each vehicle to be used under this contract
Factor 2 – Past Performance Factor 3 – Price
Factor 1 – Technical Capability
Technical Capability will be rated using an “Acceptable” or “Unacceptable”, per Table A-1.
A Quoter rated ”Unacceptable” in any sub-factor of Technical Capability will not be considered for contract award.
Table A-1. Technical Acceptable/Unacceptable Ratings
Rating
Description
| Acceptable | |
The quote clearly meets the requirements of the solicitation.
| Unacceptable | |
The quote does not clearly meet the requirements of the solicitation.
Factor 2 – Past Performance
Only quotes that have been evaluated and rated as ”Acceptable” in the Technical Capability factor will be further evaluated for the Past Performance factor. An adjectival rating will be assigned to the Past Performance factor as defined in in Table A-2. The assessment of the Quoter’s past performance will be used as a means of evaluating the relative capability of the Quoter to successfully meet the performance objectives. The Past Performance Factor will be evaluated according to time and relevancy.
The Government may verify past performance information and may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews, and existing data sources to include but not limited to Contractor Performance Assessment Reporting (CPARS). The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. The Government will determine the relevance of the past performance information received on other projects, as well as consider the source, context and currency of such information in its evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the quoter.
Table A-2. Past Performance Evaluation Ratings
Rating
Description
Acceptable
Based on the Quoter’s performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort, or the Quoter’s performance record is unknown. (See note above).
Unacceptable
Based on the Quoter’s performance record, the Government does not have a reasonable expectation that the Quoter will be able to successfully perform the required effort.
Note: In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Factor 3 – Price
Only quotes that have been evaluated and rated as ”Acceptable” in both Technical Capability and Past Performance factors will be further evaluated for Price. An adjectival rating will not be assigned to the Price factor, but the Price Quote will be evaluated in accordance with FAR 13.106-3. The quoted prices will be analyzed for completeness and reasonableness.
A. Completeness. All information/data required by the solicitation has been submitted. In the event the unit price(s) and extended price(s) are ambiguous, the government shall use the indicated unit price(s) for evaluation and award purposes.
B. Reasonableness. Prices are fully justified, supported and considered fair under current market conditions.
For award purposes, the Government will add the prices contained in the SF 1449 for the entire 5-year ordering period, and the 6-month option to extend services per FAR 52.217-8. The price for FAR 52.217-8 will be calculated by dividing the total ceiling price of the 5-year ordering period by 10 (10 six-month periods in 5 years) or by dividing the year 5 total price in half (6 months), whichever is greater. Alternate price arrangements will not be considered. Note that the evaluation of this option does not obligate the Government to exercise the option.
.4 CONTRACTOR RESPONSIBILITY
To be eligible for award, the quoter must be determined by the Contracting Officer to be a responsible prospective contractor in accordance with FAR 9.1.
