LIMITED SOURCE JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE ORDER

1. Agency and Contracting Activity.

The requiring activity is Naval Computer and Telecommunications Area Master Station Atlantic (NCTAMS LANT). The contracting activity is NAVSUP Fleet Logistics Center Sigonella (FLCSI).

2. Description of the Action.

This procurement is conducted under the authority of the Multiple Award Schedule Program (41 U.S.C.

§152(3) and §40 U.S.C. 501). This limited source action will be awarded as a modification to an existing task order, N6817116F0031, issued to Delta Solutions & Strategies, LLC, under GSA contract GS-35F-

277CA.

3. Description of Required Services.1

The original task order is for operations and maintenance services for telecommunications equipment in three locations: Naples, Italy; Deveselu, Romania; and Souda Bay, Greece. It was procured competitively as a small business set-aside and was not issued under sole-source or limited-sources procedures.

The procurement is for additional operations and maintenance services for telecommunications equipment located in Redzikowo, Poland from September 30, 2019 through March 29, 2020. The services required at this new location, which is still within NCTAMS LANT’s area of responsibility, are identical to the services performed at Deveselu and Naples. The Voice over Internet Protocol (VoIP) services for both Deveselu and Redzikowo connect to the VoIP switch at Naples. Additionally, Deveselu and Redzikowo both support the Aegis Ashore Missile Defense mission in the same manner. The Government request is for one additional Outside Plant (OSP) Technician in Redzikowo to perform the required services. Due to the type of new work to be performed, this will make necessary to add one additional Inside Plant (ISP) Technician in Naples.

The estimated total of the modification is

4. Justification Rationale.

The authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-2 is FAR 8.405-6(a)(1)(i)(C), “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or [Blanket Purchase Agreement] BPA must not have been previously issued under sole-source or limited-sources procedures.”

1 A similar modification to incorporate O&M services for telecommunications equipment located in Redzikowo, Poland was contemplated for October 2, 2017 through September 29, 2018, with one option to extend the term of the contract for one year, and a Limited Source Justification was approved on 7 August 2017 but did not occur because the necessary funding was unavailable. SOURCE SELECTION INFORMATION – SEE FAR 2.101 and 3.104

Given that the services to be provided are identical in scope and complexity, it is in the Government’s best interest to modify the existing task order for the additional services rather than to procure the additional service as a new and separate order. By modifying the order, the Government can leverage the incumbent’s knowledge and experience with the telecommunications equipment gained at Deveselu and Naples. The Government will also avoid duplication of costs, which would not be expected to be recovered through competition as the incumbent would not require the same phase-in costs that would be expected if a separate order was issued to a different contractor for six months. Additionally, the work at Redzikowo and Deveselu requires one contractor personnel to always be on-site. By keeping both sites on one task order, one contractor personnel can be assigned to back up both sites. With separate contracts, one additional full time equivalent (FTE) would be required to ensure both sites could be manned at all times. Eliminating this additional FTE saves an estimated year, which is clearly in the interest of efficiency and economy.

5. Determination of the Best Value.

GSA has determined the prices of the schedule contracts to be fair and reasonable for the purpose of establishing the schedule contracts. Ordering activities are responsible to make a separate determination of fair and reasonable pricing for individual orders. Per FAR 8.404(d) DEVIATION, the Contracting Officer will determine, using the procedures in FAR 15.404-1, the price of the modification to be fair and reasonable.

6. Market Research.

NCTAMS LANT and FLCSI relied on the market research among schedule contractors that was conducted for the original task order.

7. Actions to Remove Barriers to Competition.

All future requirements related to the task order will be reviewed and considered for competition amongst GSA schedule contractors. Additionally, this modification is for six months preceding solicitation of the follow-on contract. The follow-on contract will be awarded following competitive guidelines.
