Justification for other than full and open competition
1. Contracting Activity.
NAVSUP Fleet Logistics Center (FLC) Sigonella, Detachment Naples, Italy (FLC Detachment Naples).
2. Description of the Action Being Approved.
Request authority to issue a sole source Purchase order for Helicopter Underwater Egress Training (HUET) in support of Explosive Ordnance Disposal Mobile Unit Eight (EODMU 8).
Award is to be made to Indra Systems Sociedad Anonima, Rota, Spain. The contract will be for 1 base year and 2 option years to be included in the total evaluated price.
3. Description of Supplies/Services.
The Navy requires all military services and foreign military aviators and aircrew flying in U.S.
Navy/U.S. Marine Corps aircraft to meet U.S. Navy training requirements prior to flight in accordance with OPNAVINST 3710.7U dated 23 Nov 09. Explosive Ordnance Disposal Mobile Unit Eight (EODMU 8) personnel duty assignments necessitate frequent overwater helicopter or tilt-rotor aircraft flights. The risk to our sailors is greatly lessened through this training & their chances for survival greatly enhanced should a mid-flight casualty occur. This training is not currently part of the EOD training pipeline, forcing members of EODMU 8 to travel back to the US to receive this potentially lifesaving training. This training is available locally and has been certified by the US Naval Survival Training Institute (NSTI) to meet basic US Navy training objectives and safety aspects. Achieving this training locally is more cost effective than current methods and is commensurate with responsible fiscal operation in the US Government’s current challenging financial environment per Deputy Secretary of Defense Memorandum dated 10 Jan 2013. Proposed training levels are for 3 classes per year, with a maximum of 20 students per class, 60 students per year, and 180 students for the entire contract.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), "Only One responsible Source and No Other Supplies and Services will Satisfy Agency Requirements” as implemented by Federal Acquisition Regulation (FAR) 6.302-1.”
5. Rationale Justifying Use of Cited Statutory Authority.
Indra is currently the only provider of Underwater Survival Training in Europe that has the requisite certification by the US Naval Survival Training Institute. An evaluation was performed of Indra’s facilities on 21 Nov 2012 and was found to meet all basic US training objectives and safety aspects associated with Underwater Survival Training. Having the ability to conduct this training on Naval Station Rota is far more cost effective than sending personnel back to the US.
Any training received and credit given for military personnel requiring water survival training must meet the certified standards set forth by Naval Survival Training Institute (NSTI). To date, Indra Systems facility is the only site outside of the US that has been certified by NSTI to meet their standards.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Members of EODMU 8’s Technical, Logistics, and Readiness and Training departments have conducted market research IAW Market Research Memorandum dated 14 Jun 2013.
7. Determination of Fair and Reasonable Cost.-
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The IGE was formulated on a quotation provided by Indra Systems to the Explosive Ordnance Disposal Mobile Unit Eight (EODMU 8). The price for training each student will be approximately €1,250 per student which is identical to the price charged to the Spanish Marine Forces. The training costs vary depending in the class sizes. For this particular requirement, 20 students will be trained per class and the cost is expected to remain unchanged.
8. Actions to Remove Barriers to Future Competition.
NAVSUP FLCSI Naples may compete future contacts for these services if other contractors become certified by NSTI, NAVSUP FLCSI.
9. Contracting Point of Contact
The contracting officer has determined that the use of a sole-source contract is in the best interest of the Navy.
