Standards Illegal drug activity. The Secretary of the Navy has determined that the illegal possession or use of drugs and paraphernalia in a military setting contributes directly to military drug abuse and undermines Command efforts to eliminate drug abuse among military personnel. The policy of the Department of Navy (including Marine Corps) is to deter and detect drug offenses on military installations. Measures to be taken to identify drug offenses on military installations, and to prevent introduction of illegal drugs and paraphernalia, include routine random inspection of vehicles while entering or leaving, with drug detection dogs when available and random inspection of personal possessions on entry or exit. If there is probable cause to believe that the contract worker has been engaged in use, possession or trafficking of drugs the contract worker may be detained for a limited period of time until he/she can be removed from the installation or turned over to local law enforcement personnel having jurisdiction. When illegal drugs are discovered in the course of an inspection or search of a vehicle operated by the contract employee, the contract worker and vehicle may be detained for a reasonable period of time necessary to surrender the individual and vehicle to appropriate civil law enforcement personnel. Action may be taken to suspend, revoke, or deny installation driving privileges Implicit with the acceptance of the contract is the agreement by contract employee(s) to comply with all Federal and State laws and well as regulations issued by the Commander of the military installation concerning illegal drug and paraphernalia.
Standards of Conduct. The contractor shall maintain and enforce Standards of Conduct for the contractor employees. The contractor shall take appropriate corrective action in cases of violations of the Standards of Conduct. A report of the corrective action taken shall be provided to the Commander for concurrence. The contractor shall not allow contractor employees whose judgment is impaired by alcohol, drugs or other mood altering conditions to perform under this contract. The contractor shall immediately remove such employee. Further, the Government reserves the right to remove any employee, who, in the judgment of a licensed physician is impaired by drugs or alcohol. The contractor shall provide qualified replacement employees.
Data. All financial, statistical, personnel and technical data which are furnished, produced or otherwise available to the contractor during the performance of the contract are considered confidential business information and shall not be used for purposes other than performance of work under the contract. Such data shall not be released by the contractor without prior written consent of the Contracting Officer. Any presentation of any statistical or analytical materials, or any reports based on information obtained from studies covered by this contract, will be subject to review and approval of the Contracting Officer prior to publication or dissemination.
7.0 SECURITY
The contractor shall comply with the latest version of OPNAV Instruction 5530.14E, "Navy Physical Security and Law Enforcement Program", as applicable.
RAPIDGate® Camp Pendleton currently requires enrollment in RAPIDGate® and will not allow entry without RAPIDGate® clearance. The contractor must take all necessary steps prior to award to obtain RAPIDGate® enrollment in time for the start of performance under this contract. The contractor must demonstrate as part of their proposal that they currently are or will be enrolled prior to the start of performance. Failure to have RAPIDGate® clearance may result in a vendor being turned away from the base and being unable to complete delivery. The contactor is responsible for the additional cost for RAPIDGate® enrollment and must ensure that a RAPIDGate® enrolled driver is available for all deliveries. Currently estimate that RAPIDGate® enrollment will cost about $250 per company and $200 per enrolled employee for 1 year of access to Camp Pendleton, but the cost of RAPIDGate® or other security enrollment may vary, so that contractor should contact RAPIDGate® to determine its own cost. If more than one driver is required, RAPIDGate® enrollment must be obtained for each driver. Note that enrollment can take several weeks, so an offeror that is not already enrolled must begin enrollment as soon as possible. If difficulty or delay in enrollment in RAPIDGate® is encountered, the contractor MUST contact RAPIDGate® and or the Contractor Security (Bldg 41501T) Business Hours: 6:00 a.m. - 4:00 p.m. Monday-Thursday, CLOSED Fridays, Telephone 763-7604/7605.
Contractors who are interested in the RAPIDGate® Program should call (877) 727-4342. The Contractor Security section is responsible for the issuing of a 90 day Business Pass to all Civilian Contractors and Vendors who have a need to access the base and do not participate in RAPIDGate®. A letter from the Employer is required as verification that the individual is currently employed by said Company, as well as a letter from the sponsoring unit/section on the base. A background check is conducted for security purposes at the time of application. Upon successful completion of the background check, the applicant is issued a Business Pass, which may then be used to gain entry onto Camp Pendleton to resolve any issues with processing RAPIDGate® enrollment so that the contractor will be able to deliver as required. For additional information regarding RAPIDGate®, including enrollment instructions, please visit their website at www.rapidgate.com.
Please note that RAPIDGate® is currently a requirement for access to some military bases; however, these and other locations may require enrollment in other security programs at some time in the future. In this event, the contractor is responsible for obtaining all required enrollments and clearances for each of their drivers as soon as they receive notice of such a requirement.
