About this file

This Justification and Approval (J&A) document supports a sole-source contract award to Micro Engineering Corporation (MEC) by the Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT). The five-year, firm-fixed-price, indefinite-delivery/indefinite-quantity (IDIQ) contract is for fabrication, testing, evaluation, and repair of Periscope and Photonics antenna assemblies critical to US Fleet operations. The total contract includes four Contract Line Item Numbers (CLINs): Antenna Element Production, Antenna Element Test & Evaluation, Antenna Element Standard Repairs, and Technical Insertion Readiness for New Antenna Element Variants.

The sole-source justification is based on MEC being the original sub-manufacturer of unique antenna elements for these specific assemblies, with certified design and manufacturing capabilities that cannot be easily replicated. The contract quantities vary by year, ranging from 6-13 units in the first year across different antenna element types, with consistent reduced quantities in subsequent years. The procurement will be funded by Working Capital funds, with an anticipated ordering period of 60 months from the award date. No additional market research was conducted, and no alternative sources were identified during the solicitation period.

Statutory Authority Permitting Other Than Full and Open Competition.

In accordance with 41 U.S.C. 1901, as implemented in Federal Acquisition regulation (FAR) 13.501(a)(1)(ii): Only one responsible source and no other type of supplies or services will satisfy agency requirements.

4. Rationale Justifying Use of Cited Statutory Authority.

NUWCDIVNPT Code 34, as the designated , , and for

Periscope and Photonics antenna assemblies (per the Participating Acquisition Resource Manager (PARM), , is required to fabricate and repair Periscope and Photonics antenna assemblies. These are critical assemblies integrated on all for the US Fleet. Each antenna assembly requires unique antenna elements specifically designed for undersea Radio Frequency (RF) reception application.

Micro Engineering Corp. (MEC) is the original sub-manufacturer for the antenna elements utilized in the production of under the competitive major acquisition production contract awarded by NUWCDIVNPT to SenSyTech Inc. (Contract # ).

The design for the was qualified by NUWCDIVNPT Code 34 and certified by the PARM , as the design met First Article Acceptance Testing and subsequential production units met Factory Acceptance Test functional and performance requirements provided under this contract. Later variants along with Photonics Antenna variants utilize these specific antenna elements under PARM follow-on contracts with L3-Harris KEO and Lockheed Martin, Syracuse.

Micro Engineering Corp. (MEC) is the only approved source certified by the PARM to meet all antenna assembly and Imaging Mast Specification requirements. Micro Engineering Corp. (MEC) possesses the unique knowledge, expertise, and manufacturing facilities required to produce and deliver the antenna

6. Determination of Fair and Reasonable Cost.

The Contracting Officer will conduct price and/or cost analysis pursuant to FAR 13.106-3 and/or 15.404-1(b) and 15.404-1(c) methods to determine the prices fair and reasonable prior to contract award.

7. Actions to Remove Barriers to Future Competition.

The Government’s requirement for the supplies and services provided by MEC does not allow for substitution of another contractor’s services, for the reasons set forth in Paragraph 5. In the event that any future acquisition of these services is required, the information contained in Section 5 will be revisited and validated to confirm the sole source requirement still exists. Consideration will be given to moving this requirement to full and open competition in the future, if feasible.
