About this file
This is a Justification and Approval (J&A) document for other than full and open competition under FAR 13.5 simplified procedures for a sole source contract award to Gannon & Scott Phoenix Inc. The document justifies a five-year Firm Fixed Price, Indefinite Delivery/Indefinite Quantity (ID/IQ) contract for non-paper waste destruction services supporting the Naval Sea Systems Command, Naval Undersea Warfare Center Division in Newport, RI.
The contract has a total potential value of $300,000 based on estimated annual usage of $60,000, with a minimum guarantee of $2,500. The services involve bulk destruction of classified and unclassified non-paper waste material, requiring strict chain of custody and sanitation regulations compliance. Gannon & Scott, located in Cranston, RI, is identified as the only DoN-approved vendor in the region authorized by both the DoN Special Access Program Central Office and NSA/CSS to perform these services, as documented in DoN memorandum 0021-20 dated February 18, 2020. A notice was published on SAM.gov on April 9, 2024, and no other vendors submitted capability statements for consideration.

V3.1_JULY2020
PID #: 10-0139
P.R. Number: 1301134439
In accordance with 41 U.S.C. 1901, as implemented in FAR Subpart
13.501(a)(q)(ii); Only one responsible source and no other type of supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Naval Undersea Warfare Center Division, Newport Code 105 requires bulk destruction of Classified and Unclassified non-paper waste material. The services procured must be in accordance with DoDM 5205.07, Volumes 1-4, Disposition of DOD
Information Technology Devices dated 27 July 2017, and the
National Security Agency Central Security Service NSA/CSS Policy
Manual 9-12, see DoDM 5205.07 and NSA/CSS Policy Manual 9-12 provided, as Attachments 1 and 2 to this document.
The items being destroyed are subject to strict chain of custody and sanitation regulations. As such, bulk items can only be destroyed by a Department of Navy (DoN) approved vendor and facility. The DoN memorandum “Disposition of DOD Information
Technology Devices” dated 27 July 2017 dictates the requirement for such destruction. Gannon & Scott, located at 33 Kenney Drive in Cranston, RI is the only approved facility in this region that is approved by the DoN Special Access Program Central
Office (SAPCO), per DoDM 5205.07, and the National Security
Agency Central Security Service NSA/CSS Policy Manual 9-12. The
Director of Security for the Department of the Navy has authorized use of Gannon & Scott’s facility in memorandum DON
0021-20, titled “Destruction Site Approval for Gannon & Scott” from 18 Feb 2020, provided as Attachment 3 to this document.
Therefore, this requirement can only be met by Gannon & Scott as there is no other known facility that can meet the Government’s minimum requirements.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A combined synopsis and solicitation notice was published publicly on the Government-wide Point of Entry (GPE), SAM.gov on 09 April 2024. This notice stated the intention of
NUWCDIVNPT to award a contract to Gannon & Scott on a sole source basis. The notice also stated that “if a responsible source submits a capability statement for consideration by the
Government prior to contract award, it will be brought to the attention of the Approving Official.” No offers were submitted to the Government for consideration. For the reasons presented in this Justification and Approval, it is determined that no other source is capable of meeting the Government’s needs.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will conduct price and/or cost analysis using FAR parts 13.106-3 and/or 15.404-1(b) and 15.404-1(c) methods, in accordance with FAR 13.003(g)(2).
8. Actions to Remove Barriers to Competition
The Government’s requirement for the non-paper destruction services does not allow for the substitution of another source’s services. In the event that any future acquisition of these services is required, the information contained in Section 5 will be revisited and validated to confirm the sole source requirement still exits. Consideration will be given to moving this requirement to full and open competition in the future, if feasible.
