JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Undersea Warfare Center Division, Code 02, Newport, RI.
2. Description of the Action Being Approved
Request approval to solicit and award a Firm Fixed Price (FFP) contract to Bloomy Controls, Inc. on a sole source basis. This requirement is for the procurement of two Factory Acceptance Test (FAT) test sets in support of acceptance testing of the new

The estimated dollar value of this procurement is $650,946.98 and will be funded with
The Government requires the procurement of two (2) FAT test sets, two sets of spare cables and calibratable components, and the accompanying Non-Recurring Engineering (NRE)services. Delivery is estimated to be 34 weeks after date of the contract award.
The Government�s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
In accordance with 41 U.S.C. 1901, as implemented in Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii): Only one responsible source and no other type of supplies or services will satisfy agency require.

5. Rationale Justifying Use of Cited Statutory Authority
Bloomy Controls, Inc. (Bloomy) developed the Government�s existing test set used during testing under the Defense Microelectronics Activity (DMEA) Contract H94003-04-D-0004 with Northrup Grumman Corporation (NGC). An FAT Performance Tester, including NRE services was subsequently procured under contract N6660422P0505 with Bloomy on a sole source basis as Bloomy already had an extensive understanding of the system, the test requirements, and the test set interfaces. Bloomy had also developed the hardware design and software required to interface with the and to execute system testing.
This requirement builds upon the existing design and software, developed under contracts H94003-04-D-0004 and N6660422P0505, to provide additional test capability to the test set which is required for the
. The test set will be used for developmental testing and
If this effort were transitioned to a different manufacturer, that company would need to duplicate efforts already completed by Bloomy on interface and system design and software development under contracts H94003-04-D-0004 and N6660422P0505. The Government estimates a total of $250,000 in duplicative costs for the NRE as follows.
Bloomy tester previously procured under DMEA Contract H94003-04-D-0004 totaled $283,592. The Government estimates this cost is comprised of approximately $150,000 in NRE costs and had a delivery lead time of approximately 18 months. An additional NRE cost of $100,000 was incurred under contract N6660422P0505 for a total of $250,000 in duplicative NRE to build up this capability by another manufacturer. Furthermore, another manufacturer would need to expend a significant effort simply to gain an understanding of the system and the associated test and system requirements before it could even begin the design and development of the test set. That effort would significantly increase schedule as well as cost. This would result in a schedule delay of at least 12 months based on the delivery schedule from the two previous contracts with Bloomy for the test sets. This would delay delivery of the

FAT test set to one year past when it is required for use for acceptance testing of production , which in turn delays delivery of the by one year.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
The proposed contract action was published on the Government-wide Point of Entry, SAM.gov on August 01, 2023.
The notice stated the intention of NUWCDIVNPT to award a contract on a sole source basis to Bloomy Controls, Inc. If a responsible source submitted a capability statement for consideration by the Government prior to contract award, it would be brought to the attention of the Approving Official.
For the reasons presented in this Justification and Approval, it is determined that no other source is capable of meeting the Government�s needs. As a result, no additional market research was conducted.
7. Determination of Fair and Reasonable Costs
The contracting officer will conduct price and/or cost analysis using FAR Parts 13.106-3 and/or 15.404-1(b) and 15.404-1(c) methods, in accordance with FAR 13.003(g)(2).
8. Actions to Remove Barriers to Competition
The Government�s requirement for the Bloomy Controls, Inc.
FAT Tests does not allow for substitution of another manufacturer�s products. In the event that any future acquisition of the Bloomy Controls, Inc. FAT test set is required, the information contained in Section 5 will be revisited and validated to confirm the sole source requirement still exists. Consideration will be given to moving this requirement to full and open competition in the future, if feasible.
